As widely disseminated throughout 2025, the Brazilian Navy (Maritime Authority) has implemented new mandatory requirements for biofouling management under Portaria DPC/DGN/MB No. 180/2025 (NORMAM-401).
Enforcement Timeline and Potential Postponement
While the initial deadline for administrative penalties was set for February 2026, there are recent market rumors indicating a possible postponement of fines until June 2026.
However, no official extension has been confirmed by the Maritime Authority to date. We strongly advise all vessels to continue full preparation to meet the original requirements and avoid any issues or legal risks.
To ensure compliance, all vessels over 24 meters must have the following documents updated and available on board, strictly following the IMO Resolution MEPC.378(80) standards:
1. Biofouling Management Plan (BMP)
Vessel Particulars:
Name, IMO, Flag, and Dimensions.
Anti-Fouling System (AFS) History:
Paint details, last dry-dock application, and expected service life.
Niche Areas Mapping:
Description and photos of Sea Chests, gratings, Bow Thrusters, rudder, and propellers.
Management Procedures:
Visual inspection intervals and contingency actions.
2. Biofouling Record Book (BRB)
Mandatory chronological log of dry-docking, underwater inspections (Diver/ROV), cleaning or polishing operations, and maintenance of internal systems (e.g., MGPS).
Records must be kept for at least 2 years
3. Inspection and Fouling Rating
The Brazilian Navy will use a Fouling Rating (0 to 5) scale. Vessels rated Level 2 or higher (over 6% macrofouling coverage) face high risks of penalties, mandatory cleaning, or entry refusal.
Important Recommendation
We suggest that each Shipowner consults their respective Classification Society to obtain the most suitable BMP and BRB templates for their specific fleet. Regardless of the template used, the information listed above is essential and mandatory for Brazilian inspections.
