特朗普称，美国是世界上唯一一个承认出生公民权（birthright citizenship）的国家，这是非常荒谬的。（实际上，美国并非世界上唯一承认出生公民权的国家。）
“A person comes in, has a baby, and the baby is essentially a citizen of the United States for 85 years with all of those benefits. It’s ridiculous, it’s ridiculous and it has to end,” he said.
“一个人到美国来，生个孩子，然后这个孩子成为美国公民，切实地享受了85年的公民福利。这太荒谬了，必须终止。”他说。

The impact could be substantial. Just looking at undocumented parents, Pew estimates that their babies counted for 275,000 of U.S. births in 2014, roughly 7 percent of all births that year.

终止出生公民权拦路虎：美国宪法
出生公民权的“靠山”是美国宪法第十四条修正案（Fourteenth Amendment to the United States Constitution）。
这一修正案于1868年通过，旨在解决南北战争后遗留的奴隶问题，保护其平等权益。修正案的第一项便提到了出生的公民所享有的权利：

"All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States, and of the state wherein they reside."
所有在合众国出生或归化合众国并受其管辖的人，都是合众国的和他们居住州的公民。
这意味着，无论父母的国籍，任何在美国出生的婴儿都将获得公民权及相关福利。而有关于出生公民权的争议，就在于对这条修正案的不同阐释：宪法并没有对婴儿的父母是否必须为美国公民作出界定。

“The Supreme Court of the United States has never ruled on whether or not the language of the 14th amendment, subject to the jurisdiction thereof, applies specifically to people who are in the country illegally,” he said in an interview with Politico.
“联邦最高法院从未裁决过第十四条修正案所说的‘受其管辖’是否针对性地适用于美国非法移民。”他在政客新闻网的采访中说道。

Earlier this month, Michael Anton, a former Trump administration official, claimed in a Washington Post op-ed it was “absurd” that “simply being born within the geographical limits of the United States automatically confers US citizenship”.
本月初，前特朗普政府官员迈克尔·安东在《华盛顿邮报》上发专栏文章表示，“仅仅只是出生在美国的地界上就自动获得公民身份，是荒诞的。”
然而，特朗普也深知修宪难度之大，所以他打算通过签署行政令来达到目的。
举步维艰的“违宪”之路
到目前为止，废除出生公民权还只是特朗普的“计划”，但反对者的呼声已成排山倒海之势。法律流程，美国核心价值观，经济发展，政治阴谋的指控都是特朗普的“违宪”之路上的“拦路虎”。
据美国全国广播公司（NBC）报道，很少反驳特朗普（rarely breaks with the president）的众议院议长，共和党的“灵魂人物”保罗·瑞恩 （Paul Ryan），在第一时间批评了这个决策：

Ryan told WVLK radio. "I'm a believer in following the plain text of the Constitution, and I think in this case, the 14th Amendment's pretty clear, and that would involve a very very lengthy Constitutional process.

“If you make it harder for people to be in the United States — especially high-skilled immigrants — then you’re going to reduce innovation, output, growth going forward.”
