近日,前华为员工李洪元因一笔30万元的离职赔偿款被公司起诉敲诈勒索,羁押251天后,因犯罪事实不清、证据不足无罪释放,获得约10万元的国家赔偿。


该案件经由媒体报道后,引起广泛热议,华为陷入舆论风波。


Chinese technology company Huawei has found itself in a controversy after a former employee was wrongfully detained for more than eight months on extortion charges.

12月2日晚,华为回应前员工李洪元事件称:华为有权利,也有义务,并基于事实对于涉嫌违法的行为向司法机关举报


Huawei issued a statement on Monday night, saying that the company has the right to report suspected illegal behavior to law enforcement authorities.


声明还表示:


如果李洪元认为他的权益受到了损害,我们支持他运用法律武器维护自己的权益,包括起诉华为。

If Li thinks his rights and interests have been violated, we support his right to use legal means to protect them, including suing the company.




因30万元离职补偿金被诉敲诈


据《南方都市报》报道,龙岗区人民检察院出具的不起诉决定书及刑事赔偿决定书显示,李洪元于2005年10月入职华为,2018年1月离职。其因离职补偿金额与公司意见不一,双方商谈同意给李洪元补发331576.73元离职补偿。


2018年3月8日,该笔款项扣除税费后由部门秘书的个人银行账户转款304742.98元到李洪元账户,交易摘要为“离职经济补偿”。


Li joined Huawei in 2005, and left in January 2018. After negotiation, the company agreed to pay Li 331,576.73 yuan as departure compensation.


In March, 2018, Li received the money from a secretary who worked with Li in his department.


据澎湃新闻报道,李洪元表示在与公司商谈时,他提出了有关“2N(N为工作年限)赔偿金”问题,并得到了其部门主管何某东的同意。但是报道中也指出,华为离职赔偿金一般是“N+1”,“2N”很少见,并推断这也是后来华为向公安机关举报李洪元涉嫌“敲诈勒索”的重要原因。


2018年12月16日,深圳市公安局以涉嫌敲诈勒索罪将李洪元刑事拘留,经检察院批准,李洪元于2019年1月22日被深圳市公安局逮捕。


公安机关审查起诉认定,2017年12月至2018年3月期间,李洪元以向华为公司上级审计、稽查部门举报其部门主管在部门业务上存在违规操作的行为进行要挟,从其部门主管处勒索人民币30万元。2018年3月8日,被害人被迫通过部门秘书的个人银行账户向李洪元的银行账户转款人民币30万元。


Huawei alleged that Li had extorted 330,000 yuan from the company to keep quiet about his supervisor's misconduct. The supervisor had asked his secretary to pay Li out of the secretary's private account, the documents said.


但在8月22日,龙岗区检察院就对李洪元做出了不起诉决定,《不起诉决定》中显示,深圳市公安局认定的犯罪事实不清、证据不足,不符合起诉条件。8月23日,李洪元被释放,期间他被羁押了251天。

11月25日,龙岗区人民检察院又出具刑事赔偿决定书,决定对李洪元予以国家赔偿。同时向李洪元原工作单位(华为技术有限公司)、其父亲所在的工作单位发函,为其消除影响、恢复名誉。


The procuratorate decided to drop the charges after police investigations failed to provide enough evidence.


It also decided to give Li compensation of more than 100,000 yuan for damage to his physical freedom and reputation, they said.


Further, the procuratorate has sent letters to Huawei and the employer of Li's father to restore Li's reputation.

据澎湃新闻报道,李洪元最终能避免被定罪是因为他把离职赔偿金谈判过程录了音。李洪元的妻子将这两小时的录音作为证据呈交


Li was released from custody in August after his wife found a two-hour audio recording of Li’s severance negotiations with the company’s HR department and presented it to the procuratorate as proof of her husband’s innocence.


李洪元称,2018年1月31日下午,人力资源部的主管何某东让他到他办公室谈离职补偿的事。而进入办公室前,他打开了录音笔,并解释道此前主管也没有说不允许这样做。


作为关键证据,录音笔在网络上成为热门词汇。有网友认为这一举措可以有效保护自己,也有网友质疑李洪元的录音是否完整。


该事件将华为推上风口浪尖。据环球时报英文版网站报道,不少网友质疑华为的管理系统存在漏洞。


Some netizens raised concerns about whether there are significant flaws in Huawei's management system. While some netizens argued that a telecoms empire like Huawei, with more than 100,000 employees, should have a more mature management mechanism. Huawei's failure to resolve the conflict in a more reasonable way reflects loopholes in its management, they said. 

有网友质疑华为的管理系统中存在重大缺陷,像华为这样大体量的电信巨头,拥有超过10万名员工,应当建立更成熟的管理机制。华为没能够以更理智的方式处理这一矛盾,凸显出其管理中存在的漏洞。


也有网友持反对意见,认为不应当以单个事件判定华为的整个系统有问题。


It was reported that Huawei invests heavily every year to optimize its management. It is not only leading the world in 5G network technology, but has also trained a large number of IT talent for China.

据报道华为每年都在优化管理方面投入大量资金,其不仅仅是5G科技的先锋,也为中国培养了海量IT人才。


12月1日,李洪元告诉澎湃新闻,目前人在深圳,最大的诉求是希望华为跟自己道歉。李洪元表示,“(华为)能不能坐下来当面和我好好沟通,见我一面?”
