
报道称,旧金山一位名为比勒(Laurel Beeler)的地方法官在一份命令中表示,发起起诉的WeChat用户已经对“第一修正案”的价值提出了严重质疑,并且在两相权衡后,倾向于支持起诉方。
US Magistrate Judge Laurel Beeler in San Francisco said in an order that WeChat users who filed a lawsuit "have shown serious questions going to the merits of the First Amendment claim, the balance of hardships tips in the plaintiffs’ favor."
the First Amendment:美国宪法第一修正案:“国会不得制定关于下列事项的法律:确立国教或禁止信教自由;剥夺言论自由或出版自由;或剥夺人民和平集会和向政府请愿伸冤的权利。”
The alliance has argued that Mr. Trump’s attempt to ban WeChat violates several constitutional provisions, including the right to free speech, due process and equal protection against arbitrary discrimination.
Beeler wrote “But on this record — while the government has established that China’s activities raise significant national security concerns — it has put in scant little evidence that its effective ban of WeChat for all US users addresses those concerns.”
The WeChat Users Alliance that had sued praised the ruling "as an important and hard-fought victory" for "millions of WeChat users in the US."
