近日,一种名为“假装上班公司”的企业在网上引发广泛讨论。



据潮新闻报道,近日,杭州出现一家名为“假装上班无限公司”的机构,提供“朝九晚五”的付费上班服务,每天收费30元。


老板介绍,两个多月来已有三四十人前来“上班”,来这里“假装上班”的人只有少数是确实不想工作的,“过来拍个照片发给家里人看一下就走了,给了我们50元”。其它多为暂时没找到工作或需要办公场地的人。


A "pretend to work company" has emerged in Hangzhou, Zhejiang province, offering a paid "9-to-5" service for 30 yuan per day. The owner revealed that over the past two months, thirty to forty people have used the service. Only a small fraction are genuinely work-averse, with some simply taking photos to send to family before leaving. Others are primarily individuals temporarily unemployed or in need of workspace. 


有网友认为,去“假装上班公司”,经济实惠,非常方便。也有网友表示不理解,认为“去这里不如去图书馆”。


据荔枝新闻此前报道记者探访发现,一些写字楼的空闲办公室已经变身成“假装上班公司”,事实上更像是“共享办公室”。不仅是写字楼里的工作室,有些画室、咖啡店,也蹭着热度,纷纷发布带有“假装上班公司”话题的帖子。

Some netizens find it cost-effective and convenient, while others question its value compared to libraries. Reportedly, vacant offices in commercial buildings are being repurposed into these "pretend to work" spaces, which function more like shared offices. Beyond dedicated studios, art spaces and coffee shops are also capitalizing on the trend by posting related hashtags. 


记者注意到,自去年12月起,全国多地注册有“假装上班公司”甚至还有部分商家宣称可以提供“代缴社保”“伪造实习证明”“制造工资流水”等服务。国是直通车也在报道中指出,“该行业已出现异化倾向”。

Since December last year, similar companies have registered across the country, with some businesses even offering additional services like "social security payment on behalf", "forged internship certificates", and "fabricated payroll records".



律师提醒:“假装上班”可能存在法律风险


北京市盈科律师事务所律师邱跃指出,此类行为涉嫌伪造劳动关系、骗保及提供虚假证明,违反《社会保险法》《劳动合同法》。同时提醒求职者,切勿因“隐瞒失业”而参与伪造文件,一旦被用人单位查实可能承担违约责任。


Qiu Yue, an attorney at Yingke Law Firm in Beijing, said that such practices potentially violate the relevant laws by forging labor relationships, committing insurance fraud, and providing false documentation. He cautioned job seekers against participating in document forgery to conceal unemployment, as discovery by employers could lead to liability for breach of labor contract.


江苏振泽律师事务所律师杨旭进一步提醒:作为“假装上班公司”,应考虑如何有效进行人员管理,避免非法经营或者被利用从事非法活动。

作为“假装上班者”,应当避免被洗脑或被动参与有关违法犯罪行为,并保护好个人隐私。
