国家统计局官方网站《2021年居民收入和消费支出情况》公布的2021年全国城镇居民人均可支配收入为47,412元。依据《工伤保险条例》第三十九条第一款第(三)项规定,一次性工亡补助金标准为上一年度全国城镇居民人均可支配收入的20倍。据此计算的2022年一次性工亡补助金为948,240元。


According to the Resident Income and Consumption Expenditure in 2021 released by official website of the National Bureau of Statistics, the urban per capita disposable income nationwide (UPDI) in 2021 is 47,412 yuan. According to Article 39, Paragraph 1 (3) of the Regulations on Industrial Injury Insurance, the standard of one-time subsidy for work-related death shall be 20 times as much as the UPDI of the previous year. Accordingly, the one-time subsidy for work-related death in 2022 is 948,240 yuan.


10.3亿人 / 1.03 Billion People

我国企业职工基本养老保险制度自上世纪90年代建立以来,从县级统筹起步,逐步提高统筹层次。2018年7月,我国建立实施了基金中央调剂制度,迈出了全国统筹的第一步。2018至2021年中央调剂制度实施4年间,共跨省调剂资金6,000多亿元,其中2021年跨省调剂规模达到2,100多亿元,适度均衡了省际之间养老保险基金负担。截至2021年末,全国企业职工基本养老保险参保人数达10.3亿人。


Being established in 1990s, the Basic Pension Insurance system started from the county-level and gradually increased to overall planning level. In July 2018, our country took the first step of overall planning by establishing and implementing the central fund adjustment system. During the four years of implementing the central adjustment system, from 2018 to 2021, a total of more than 600 billion yuan has been adjusted inter-provincially, among which the scale in 2021 has reached more than 210 billion yuan, moderately balanced the burden of pension insurance funds between provinces. By the end of 2021, individuals participating in the basic pension insurance across the country have reached 1.03 billion.

2022年1月起,全国各地将统一执行国家核准的参保单位和个人缴费比例,调整后,养老保险缴费统一为:单位缴费比例为16%,个人缴费比例8%。


As of January 2022, the state-approved payment ratio for social insurance of entity and individual will be uniformly implemented nationwide. After this adjustment, the pension insurance payment will be unified as follows: the entity payment ratio is 16%, and the individual payment ratio is 8%.


750元 / RMB 750、1,200元  / RMB 1,200

春节期间,上海市人力资源和社会保障局对家庭生活困难的登记失业人员发放节日补助,补助标准为每人750元;市退役军人事务局对享受国家抚恤补助的重点优抚对象(含农村籍退役士兵)发放节日补助,补助标准为每人1200元。


During the Spring Festival, Shanghai Municipal Human Resources and Social Security Bureau provided holiday subsidies to registered unemployed individuals in difficulties, at the standard of 750 yuan per person; the Municipal Bureau of Veterans Affairs provided holiday subsidies to key individuals (including rural retired soldiers) who receive national pension, at the standard of 1,200 yuan per person.

最高院、人社部联合发布《关于劳动人事争议仲裁与诉讼衔接有关问题的意见(一)》

The Supreme People's Court and the Ministry of Human Resources and Social Security jointly issued the Opinions on Issues Related to the Connection Between Labor and Personnel Dispute Arbitration and Litigation (1)


近日,为贯彻党中央关于健全社会矛盾纠纷多元预防调处化解综合机制部署,落实加强劳动人事争议仲裁与诉讼衔接机制建设要求,人力资源社会保障部、最高人民法院联合印发《关于劳动人事争议仲裁与诉讼衔接有关问题的意见(一)》,该《意见》规范了调解协议后续程序性保障,完善了诉裁调对接机制,明确了终局裁决范围,确立了仲裁证据的司法审查规则,有利于推动矛盾纠纷源头化解,降低社会治理成本,提高调解协议履行率,有利于提高仲裁终结率,高效便捷维护劳动者合法权益;细化了有关法律适用标准条件,有利于发挥仲裁前置的功能作用,促进裁审法律适用统一,有利于培养用人单位、劳动者的自觉守法用法意识,提升仲裁、司法质量、效率和公信力。


Recently, in order to implement the Party Central Committee’s deployment of a comprehensive mechanism for improving the multi-dimensional prevention, mediation and resolution of social conflicts and disputes, and to implement the requirements for strengthening the construction of the mechanism for the connection between labor and personnel dispute arbitration and litigation, the Ministry of Human Resources and Social Security and the Supreme People’s Court jointly issued the Opinions on Issues Related to the Connection between Labor and Personnel Dispute Arbitration and Litigation. The Opinions regulates the follow-up procedural guarantees of mediation agreements, improves the mechanism for connecting litigation, adjudication, and mediation, clarifies the scope of final rulings, and establishes rules for judicial review of arbitration evidence, which is conducive to resolving the source of conflicts and disputes, reducing the cost of social governance, improving the performance rate of mediation agreements, improving the arbitration clearance rate, and safeguarding the legitimate rights and interests of employees in an efficient and convenient manner. The Opinions also specifies application standards of laws, which is conductive to promoting the unification of the application of adjudication laws,  cultivating employers and employees' awareness law-abiding and usage, and improving arbitration and judicial quality, efficiency and credibility.


企业职工基本养老保险全国统筹2022年1月已启动实施

The national overall planning of basic pension insurance for enterprise employees being implemented in January 2022


根据国家部署,2022年1月1日起实施企业职工基本养老保险全国统筹,统一养老保险缴费比例和缴费基数是全国统筹制度的重要内容。据悉2021年11月-12月,山西、陕西等地已向全国社保系统迁移数据,且养老金发放时间也从20日变动到15日,为全国职工社保的统筹做准备。全国统筹制度实施后,将在全国范围内对地区间养老保险基金当期余缺进行调剂,从制度上解决基金的结构性矛盾,困难地区的养老金发放将更有保障。


According to the national deployment, the national overall planning of basic pension insurance for enterprise employees has been implemented as of January 1, 2022, stressing on the unified pension insurance payment ratio and payment base under the national overall planning system. It is reported that from November to December 2021, Shanxi, Shaanxi and other places have transferred data to the national social security system, and the pension payment time has also changed from the 20th to the 15th, in preparation for the overall planning of social security for employees across the country. After the implementation of the national overall planning system, the current surplus and shortage of pension insurance funds between regions will be adjusted nationwide, and the structural contradictions of the funds will be resolved systematically, and pensions in difficult areas will be more guaranteed.


人力资源社会保障部等四部门再次对美团、饿了么、滴滴等11家平台企业保障新就业形态劳动者权益开展行政指导

日前,人力资源社会保障部会同交通运输部、市场监管总局、全国总工会再次就维护新就业形态劳动者劳动保障权益对美团、饿了么、滴滴、曹操、达达、闪送、货拉拉、满帮、到家集团、阿里巴巴、腾讯等11家头部平台企业联合开展行政指导。会议肯定了头部平台企业贯彻落实《关于维护新就业形态劳动者劳动保障权益的指导意见》等政策取得的阶段性成效,要求平台企业全面准确理解政策要求,在前期工作基础上,深入了解劳动者诉求,加大对用工合作企业保障劳动者权益的监督力度,持续完善平台算法和劳动规则,健全企业保障新就业形态劳动者权益的制度机制。


Recently, the Ministry of Human Resources and Social Security, together with the Ministry of Transport, the State Administration of Market Supervision, and the All-China Federation of Trade Unions, once again provided administrative guidance regarding safeguarding the labor security rights and interests of workers in the new form of employment to 11 leading platform companies including Meituan, Ele.me, Didi, Caocao, Dada, iShansong, HuoLala, Manbang, Daojia Group, Alibaba and Tencent. The meeting affirmed the phased results achieved by leading platform companies in implementing the Guidance on Safeguarding Labor Security Rights and Interests of New Employment Forms and other policies, requiring platform companies to fully and accurately understand the policy requirements, and to have an in-depth understanding of employees’ interests, increase the supervision of labor cooperative enterprises to protect the rights and interests of laborers, continue to improve the platform algorithm and labor rules, and improve the system and mechanism for enterprises to protect the rights and interests of employees in new employment forms on the basis of previous work.


最高人民法院与人力资源社会保障部建立“总对总”在线诉调对接机制

The Supreme People's Court and the Ministry of Human Resources and Social Security have established a "head-to-head" online litigation and mediation connecting mechanism


为落实最高人民法院与人力资源社会保障部等部门联合印发的《关于进一步加强劳动人事争议调解仲裁完善多元处理机制的意见》等文件要求,构建互联网时代劳动人事争议在线多元解纷新格局,降低劳动者维权成本,全面提升劳动人事争议多元化解质效,日前,最高人民法院办公厅与人力资源社会保障部办公厅联合印发《关于建立劳动人事争议“总对总”在线诉调对接机制的通知》(以下简称《通知》),对完善劳动人事争议调解与诉讼实质化衔接机制,推动劳动人事争议“总对总”在线诉调对接工作提出明确要求。

人力资源社会保障部废止《社会保险费申报缴纳管理规定》

The Ministry of Human Resources and Social Security abolished the Regulations on the Administration of Declaration and Payment of Social Insurance Premiums


为贯彻落实党中央、国务院深化“放管服”改革决策部署,持续优化营商环境,落实社会保险费征收体制改革要求,人力资源社会保障部决定,对《社会保险费申报缴纳管理规定》(人力资源社会保障部令第20号)予以废止。


In order to implement the deployment of the Party Central Committee and the State Council to deepening the reform of "Streamlining administration, combining decentralization and management, and optimizing services", and in order to continuously optimize the business environment and implement the requirements for the reform of the social insurance premium collection system, the Ministry of Human Resources and Social Security has decided to abolish the Regulations on the Administration of Declaration and Payment of Social Insurance Premiums (Order No. 20 of the Ministry of Human Resources and Social Security).

1月11日,在国务院新闻办举行的《“十四五”公共服务规划》新闻发布会上,住房和城乡建设部住房保障司负责人表示:去年,按照国务院支持多渠道灵活就业相关部署和国务院常务会议要求,住房和城乡建设部在重庆、成都、广州、深圳、苏州、常州6个城市开展了灵活就业人员参加住房公积金制度试点,引导和鼓励灵活就业人员参加住房公积金制度,并享受相应的权益。从试点的情况来看,目前运行平稳,受到了灵活就业人员的广泛欢迎。


On January 11, at the press conference of the "14th Five-Year" Public Service Plan held by the State Council Information Office, the head of the Housing Security Department under the Ministry of Housing and Urban-Rural Development announced that, last year, in accordance with the State Council's requirements for supporting multi-channel flexible employment related deployment and the requirement of the executive meeting of the State Council, the Ministry of Housing and Urban-Rural Development has carried out pilot projects for flexible employees to participate in the housing provident fund system in 6 cities, including Chongqing, Chengdu, Guangzhou, Shenzhen, Suzhou and Changzhou, to guide and encourage flexible employees to participate in the housing provident fund system and enjoy corresponding benefits. According to current the situation, the pilot projects are running smoothly at present and has been widely welcomed by flexible employees.
