4月8日,国务院办公厅印发《关于推动个人养老金发展的意见》。为推进多层次、多支柱养老保险体系建设,促进养老保险制度可持续发展,满足人民群众日益增长的多样化养老保险需要,国家将建立个人养老金制度。个人养老金实行个人账户制度,缴费完全由参加人个人承担,实行完全积累。个人养老金参加人每年缴纳个人养老金的上限为12,000元。


On April 8, the General Office of the State Council issued the Advice on Promoting the Development of Individual Pension. Aiming at promoting the construction of multi-level and multi-pillar pension system, enhancing the sustainable development of the pension insurance system, and meeting the ever-growing needs for diversified pension insurance, China will establish the Individual Pension System. Citizens participate in the system will set up an individual account and will be responsible for the payment of all premiums, which will be fully accumulated in such account. The upper limit of individual pension premium paid by individuals is RMB 12,000 per year.

近日,国务院印发《关于设立3岁以下婴幼儿照护个人所得税专项附加扣除的通知》,要求自今年1月1日起,纳税人照护3岁以下婴幼儿子女的相关支出,按照每个婴幼儿每月1,000元的标准定额扣除。具体扣除方式上,父母可以选择由其中一方按扣除标准的100%扣除,也可以选择由双方分别按扣除标准的50%扣除。


Recently, the State Council issued the Notice on Tax-relief for Parents Rearing Children under 3 Years Old, requiring that starting from January 1, 2022, the taxable expenses on rearing children under 3 years old may be reduced by RMB 1,000 per month for each child. The deduction may be applied in full by one parent or split evenly.

近日,人社部发布全国各地区最低工资标准情况。截至2022年4月1日,上海以2,590元位居榜首。13个地区月最低工资标准已经达到2,000元以上,分别为上海、深圳、北京、广东、江苏、浙江、天津、山东、四川、重庆、福建、湖北、河南。


Recently, the Ministry of Human Resources and Social Security issued the minimum wage standard in various regions. As of April 1, 2022, the amount of minimum wage in Shanghai ranks first at RMB 2,590. The minimum wage standards in 13 regions have reached RMB 2,000. They are Shanghai, Shenzhen, Beijing, Guangdong, Jiangsu, Zhejiang, Tianjin, Shandong, Sichuan, Chongqing, Fujian, Hubei and Henan.

3月29日,北京市人力资源和社会保障局发布2022年城乡居民基本养老保险缴费标准。今年的缴费标准与去年相同,最低缴费标准为年缴费1,000元,最高缴费标准为年缴费9,000元。符合条件的参保人从今年4月1日起到12月10日,均可以办理参保缴费手续。参保人在参保缴费时,可以根据自身实际情况,在1,000元到9,000元之间自行选择缴费金额。


On March 29, Beijing Municipal Human Resources and Social Security Bureau announced the payment standard for pension insurance for urban and rural residents in 2022. As in last year, the minimum payment standard is RMB 1,000 per year, and the maximum is RMB 9,000 per year. From April 1 to December 10, 2022, all the eligible may participate in the pension scheme, and choose premiums amount from RMB 1,000 to RMB 9,000.

全国人民代表大会常务委员会批准通过两项强迫劳动有关的国际公约

The Standing Committee of the National People's Congress adopted two international conventions related to forced labor


04月20日,第十三届全国人民代表大会常务委员会第三十四次会议决定批准1930年6月28日在日内瓦举行的第14届国际劳工大会上通过的《1930年强迫劳动公约》和1957年6月25日在日内瓦举行的第40届国际劳工大会上通过的《1957年废除强迫劳动公约》。通过批准两项公约,中国进一步承诺在其所辖范围内消除一切形式的强迫劳动。


On April 20, the Thirty-Fourth Session of the Standing Committee of the Thirteenth National People's Congress decided to ratify the Forced Labor Convention of 1930 and the Convention on Abolition of Forced Labor of 1957, adopted respectively at the 14th and the 40th International Labor Conference in Geneva on 28 June 1930 and 25 June 1957. By ratifying both Conventions, China has further committed to eliminating all forms of forced labor within its jurisdiction.

Li Keqiang presided over an executive meeting of the State Council: Defer the payment of pension premiums among financially distressed industries in stages


4月6日,国务院常务会议决定对特困行业实行阶段性缓缴养老保险费政策,加大失业保险支持稳岗和培训力度。具体政策如下:一是对餐饮、零售、旅游、民航、公路水路铁路运输等特困行业,在今年二季度实施暂缓缴纳养老保险费,并将已实施的阶段性缓缴失业和工伤保险费政策范围,由餐饮、零售、旅游业扩大至上述5个行业,缓解这些行业特别是中小微企业、个体工商户资金压力。二是延续执行失业保险保障阶段性扩围政策,今年底前继续向参保失业人员发放失业补助金,向参保失业农民工发放临时生活补助。三是提高中小微企业失业保险稳岗返还比例,符合条件的地区可从60%提至最高90%;允许地方再拿出4%的失业保险基金结余用于职业技能培训,并向受疫情影响、暂时无法正常经营的中小微企业发放一次性留工培训补助。


On April 6, the executive meeting of the State Council decided to implement a phased deferred payment of pension premiums among financially distressed industries, and to enhance the employment stabilizing and training function of the unemployment insurance. The specific policies are as follows: First, for financially distressed industries such as catering, retail, tourism, civil aviation, road, water, and railway transportation, the payment of pension premiums will be deferred in the second quarter of this year, and the deferring of unemployment and work-related injury insurance premiums implemented in catering, retail and tourism industries will be extended to the abovementioned five industries, in order to alleviate the financial pressure of these industries, especially small and medium-sized enterprises and individual commercial households. The second is to continue the phased scope expansion of unemployment insurance, continue to provide unemployment subsidies to the insured unemployed before the end of this year, and provide temporary living subsidies to the insured unemployed migrant workers. The third is to increase the ratio of employment-stabilization fund within the unemployment insurance fund for small, medium and micro enterprises, which in some areas can be raised from 60% to a maximum of 90%. Local governments are allowed to use an additional 4% of the unemployment insurance fund balance for vocational skills training. Small, medium and micro enterprises affected by the pandemic that are temporarily unable to operate normally will be provided a one-time training subsidy for employee retention.

The 34th session of the Standing Committee of the 13th National People's Congress revised and adopted the PRC Vocational Education Law


4月20日,第十三届全国人民代表大会常务委员会第三十四次会议修订通过《中华人民共和国职业教育法》,推动职业教育高质量发展,提高劳动者素质和技术技能水平,促进就业创业。该法对实习生的劳动权利义务及劳动者就业前培训等问题进行了规定,包括不得通过人力资源公司、劳务派遣公司组织安排学生实习;劳动者上岗前必须接受职业教育;实习生实习期间实习单位需给其参加相关险种、给予报酬等。


On April 20, the 34th session of the Standing Committee of the 13th National People's Congress revised and passed the Vocational Education Law of the People's Republic of China to promote high-quality development of vocational education, improve the quality and technical skills of workers, and promote employment and entrepreneurship. The law stipulates the employment rights and obligations of interns and the pre-employment training of workers, including prohibiting arrangement of student internships through human resources companies and labor dispatch companies; requiring mandatory vocational education before commencement of work; requiring employers to provide relevant insurance and renumeration for interns.


上海市经信委发布《上海市工业企业复工复产疫情防控指引(第一版)》

Shanghai Municipal Commission of Economy and Information Technology issued the Guidelines for Pandemic Prevention and Production Resumption for Industrial Enterprises in Shanghai (First Edition)


4月16日,上海市经信委官方微信发布《上海市工业企业复工复产疫情防控指引(第一版)》,指引各区政府和街镇、园区积极支持企业复工复产,指导企业“一企一策”,切实做好疫情防控工作。《指引》要求企业强化企业员工管理,制定完善的配套规定,将员工在工作期间不佩戴口罩、不如实申报健康信息、伪造疫情有关的检测报告等违反防疫政策的行为纳入劳动纪律管理范畴,明确列举违纪类型、处罚类别等,一方面引导员工遵守防疫政策,另一方面也可以确保发生劳动争议时有章可依。


On April 16, the official WeChat account of Shanghai Municipal Commission of Economy and Information Technology issued the Guidelines for Pandemic Prevention and Production Resumption for Industrial Enterprises in Shanghai (First Edition), instructing district governments, streets, towns, and plants to actively support enterprises in resuming work and production, and instructing enterprises to enact the most suitable pandemic prevention and control policies. The Guidelines require enterprises to strengthen the management of employees, formulate complete supporting regulations, and include violations of pandemic prevention policies into the scope of disciplinary misconducts, such as work without wearing a mask, falsely reporting health information, and falsifying pandemic-related testing reports. The enterprises shall enumerate the types of misconducts and disciplinary actions, which will guide employees to abide by the pandemic prevention policies, and will also provide supporting policies in case of labor disputes.


北京市积分落户申报启动

Beijing started the application for credit-based household registration


北京市2022年积分落户申报工作于4月14日早8时正式启动,申报期限为30个自然日,至5月13日20时截止。积分落户申报工作分为五个阶段:一是申报阶段(4月14日8时至5月13日20时,共计30个自然日);二是部门审核结果汇总阶段(5月14日至6月2日,共计20个自然日);三是审核结果查询阶段(6月3日8时至6月10日20时,共计8个自然日);四是部门复核及积分排名阶段(6月11日至7月10日,共计30个自然日);五是公示和落户办理阶段(7月11日起,公示8个自然日,经公示取得落户资格的申请人可办理落户手续)。2022年,北京市积分落户规模将继续保持稳定,为6,000人,并实行同分同落。


The application for 2022 credit-based household registration in Beijing was officially launched at 8:00 a.m. on April 14. The application will last for 30 natural days and will end at 20:00 on May 13th. The application will go through five stages: first, application (from 8:00 on April 14 to 20:00 on May 13, a total of 30 natural days); second, summary of the primary review results (from May 14 to June On June 2, a total of 20 natural days); third, results available online (from 8:00 on June 3 to 20:00 on June 10, a total of 8 natural days); fourth, department review and credit ranking (June 11th to July 10th, a total of 30 natural days); fifth, publication and registration (from July 11th, the publication will last for 8 natural days, and applicants who are eligible for registration can go through the registration proceedings). In 2022, the quota for credit-based household registration continued to remain stable at 6,000, and applicants with the same number of credits will all be eligible.


重庆市推动基层快递网点从业人员工伤保险“应保尽保”

Chongqing Municiplity promotes an overall participation in work-related injury insurance for delivery persons


为切实维护快递员群体合法权益,重庆市人社局与市邮政管理局密切协作,有效推进基层快递网点优先参加工伤保险工作,推动实现全市基层快递网点从业人员工伤保险“应保尽保”。基层快递网点为从事快递收寄、分拣、运输、投递和查询等服务的灵活就业人员申报缴纳工伤保险费,个人不缴费。基层快递网点依法参加工伤保险后,参保人员在参保缴费期内遭受事故伤害或者患职业病的,按照《工伤保险条例》等规定享受待遇。


In order to effectively safeguard the legitimate rights and interests of delivery persons, Chongqing Municipal Human Resources and Social Security Bureau closely cooperated with the Municipal Postal Administration, effectively expand work-related injury insurance coverage over local level courier outlets and promote delivery persons working therein to participate work-related injury insurance on a priority basis as much as possible. Local level courier outlets engaging in package’s reception, delivery, sorting, transportation, status tracking and other services shall apply work-related injury insurance for flexible employees and pay relevant premiums on their behalf. After participating in work-related injury insurance in accordance with the law, if the insured suffers an accident injury or suffers from an occupational disease during the insurance payment period, they shall enjoy benefits in accordance with the Regulations on Work-related Injury Insurance and other regulations.
