导读：尽管你是大律师，但是在大多数人都不咋戴假发的时代里，还是要提高政治意识和政治站位啊。

我们专业人士有个说法，叫不露怯。

啥意思？

就是说如果你只有对一个事儿真懂，才能在干事儿的时候不显得因为能力或者知识的不足而搞出乌龙来。或者说这个不露怯要求你做事儿的时候，去找专业的人先询问，再做决策。

校长曾经写过一篇被删除的文章，是讲的在中美贸易战的过程中，因为中国没有批准高通收购恩智浦的交易而使得该交易黄摊儿的事儿。后来的中美关于贸易会谈中，竟然爆出了说，中国说可以再考虑批准通过的事儿。

这个事儿其实就是露怯。露怯的根本原因就是不了解国际并购的交易机制。一个交易已经因为long stop date过去而未能获得政府审批、支付了反向分手费（Reverse Break fee）的的事儿是不能回转的，所以提出这个说法就是露怯。

再回来这两天制裁某埃塞克斯大律师办事处的事儿。校长坚决支持外交部宣布的对英国的某些个人和实体采取制裁措施。很多法律圈儿的人讨论，如果在制裁大律师办事处的时候，能考虑到大律师办事处的自身的运作特点和里面的大律师工作的独立性的话，把制裁的范围搞到大律师办事处出具某些意见的律师身上，这个是不是会显得就更加的专业和合理？

这个事儿，是不是露怯两说。

被制裁之后，埃塞克斯大律师办事处出来发了一个声明，核心的意思还是说，我不是一个像律师事务所那样的实体，每个律师在里面都是独立的个人，我们是个类似共享办公版Wework的东东，就是个独立在一起共享办公、分摊成本的办公室而已。

The members of Essex Court Chambers were made aware earlier today that the Government of the People’s Republic of China has placed “Essex Court Chambers” on a list of persons or entities subject to international sanctions. This decision is understood to be related to the fact that four members of chambers wrote a legal opinion dated 26 January 2021 concerning the treatment of the Uyghur population in the Xinjiang Uyghur Autonomous Region (“Legal Opinion”).

The Legal Opinion was written by the four members of chambers concerned pursuant to instructions received from Global Legal Action Network (GLAN) in association with the World Uyghur Congress (WUC) and Uyghur Human Rights Project (UHRP). In writing that opinion, each of these four individuals was providing independent legal advice in accordance with their professional obligations and qualifications as members of the Bar of England and Wales subject to regulatory supervision by the Bar Standards Board. The Legal Opinion received significant publicity in international media following its publication last month. None of the four relevant members of chambers published the Legal Opinion.

Essex Court Chambers is not a law firm and has no collective or distinct legal identity of any kind. Members of chambers are self-employed sole practitioners each regulated in their own capacity as separate individuals by the Bar Standards Board. Members of Chambers are commonly retained by opposing sides in the same dispute, both in litigation and arbitration, with protocols in place to safeguard confidentiality. No other member of Essex Court Chambers was involved in or responsible for the advice and analysis contained in the Legal Opinion or its publication.

不过制裁以后，估计更多的在这家Essex Court Chambers的大律师们会离开，你看，这不就有人在被制裁后离开了么？

JERN-FEI NG QC TO LEAVE ESSEX COURT CHAMBERS

Members of Essex Court Chambers announce that Jern-Fei Ng QC is leaving as a member of Essex Court Chambers and will no longer be practising from Chambers with effect from midnight tonight.

Jern-Fei joins 7 Bedford Row barristers’ chambers tomorrow, from where he will no doubt continue to excel as a leading silk in the many areas of practice he specialises in. He was a valued member of Essex Court Chambers and leaves with full support.

这位在中国还比较有名的大律师已经离开了Essex Court Chambers，加入伦敦贝德福德大律师办事处。毕竟这位搞国际仲裁多，不离开对自己影响很大。

从这个角度上看，比起高通那个事儿，外交部这个制裁也不能说叫露怯，还是起到了很大的震慑作用，你不能一边挣了中国企业的钱，一边还出具伤害中国国家利益和人民感情的事儿。你一个大律师办事处的律师，凑什么热闹。而且你把法律意见书贴自己网站上干啥？自作孽不可活啊。
