With the continuous opening-up of China's cross-border employment market, an increasing number of foreign professionals are choosing to develop their careers in China. First-time applicants often face issues such as conceptual confusion, complex documentation requirements, and tight timelines. In some cases, inadequate preparation even disrupts onboarding arrangements. This article systematically outlines the full application process, essential documents, and key considerations for foreign nationals and their employers.

Five Basic Eligibility Criteria for Working in China


In accordance with the "Regulations on the Administration of Employment of Foreigners in China," foreign nationals applying for their first work visa to China must meet all five of the following criteria:

  1. Age and Health Requirements: Applicants must be at least 18 years old. For Category A high-end talents, the age limit may be relaxed to over 60 years old in recognition of their outstanding professional contributions and extensive experience. This policy adjustment aims to attract more top international talents and inject strong momentum into China's science and technology, culture, economy, and other fields.   2. No Criminal Record Requirement: Applicants must submit a no-criminal-record certificate issued by the police of their home country or region. To ensure the authenticity and legality of the certificate, it must undergo "three-level authentication" or "Apostille certification." Three-level authentication typically includes notarization by a local notary public, authentication by the Ministry of Foreign Affairs, and authentication by a Chinese embassy or consulate abroad. Apostille certification applies to countries and regions party to the Hague Convention, simplifying the process and improving efficiency.
     
  3. Legal Qualifications of the Employing Unit: The employer must be a legally registered enterprise, public institution, or social organization in China, and must provide a valid copy of its business license and relevant industry permits. When employing foreign nationals, the employer must ensure that the salary paid is not lower than the local minimum wage standard, an important measure to protect the basic living rights and interests of foreign employees.
     
  4. Valid Document Guarantee: The applicant's passport must have a validity period of at least 6 months from the date of application, a basic requirement to ensure legal status and smooth entry/exit during the stay in China. Additionally, the passport must have at least 2 blank visa pages to accommodate visa issuance and entry/exit stamps. If the passport is about to expire, applicants are advised to renew it before submitting the visa application to avoid delays in the approval process due to document issues.

Application Process for a Work Visa in China


  1. Apply for the "Notification Letter of Foreigner's Work Permit in China"


    This document is an important qualification certificate for foreign nationals to enter China. The employing organization must act as the applicant and submit the application to the local foreigner work administration department. Core documents include:

    (a)Scanned copy of the employer's business license

    (b)Employment contract

    (c)Applicant's academic degree certificate

    (c)Medical examination report issued within 6 months by an international travel healthcare center in China

Classification Standards and Application Differences for Category A/B/C Talent


  1. Category A (High-End Talents): No restrictions on age, academic background, or work experience. Experts over 60 years old may exceed the age limit. The application is mainly based on achievement certificates (awards/employment documents), with an approval cycle of usually 7 working days.


  2. Category B (Professional Talents): The most applied category, targeting individuals with a bachelor's degree or above and at least 2 years of relevant work experience. Approval follows the regular process, with a cycle of approximately 15 working days.


  3. Category C (Other Talents): For skilled personnel meeting the needs of China's labour market, such as seasonal workers and specific technical positions. Applicants must provide proof of labour market demand, and the visa period is generally shorter. The approval cycle is more than 20 working days.


Key Considerations and Timeline Recommendations


  1. Advance Document Preparation: The authentication process for criminal record certificates may take 4–6 weeks, so it is advisable to start early. Academic degree authentication usually takes 2–3 weeks and should be completed as soon as possible.


  2. Timeline Coordination: The Z Visa is generally valid for 3 months, and entry must be completed within this period. A residence permit must be applied for within 30 days of entry; overdue applications may result in penalties.


  3. Document Detail Control: All foreign-language documents must be accompanied by formal Chinese translations. Employment contracts should clearly specify job responsibilities, salary standards, and contract duration. Medical examination reports must be issued by designated institutions.


  4. Employer Responsibilities: Employers must accurately determine the talent category to avoid misdirection in the application. They must promptly complete accommodation registration for foreign employees and ensure the authenticity and validity of all submitted documents.


For foreign nationals and employers, understanding the process in advance, preparing documents thoroughly, and planning timelines carefully are crucial to securing a work visa smoothly. It is recommended to consult professional institutions or local exit-entry administration departments before applying to obtain the latest policy information, avoiding approval delays caused by minor mistakes that could impact career plans and work arrangements.
