CHINA LAW 101
article 279
Boss: Your two-year labor contract has expired. The company has decided not to renew it. Please sign this resignation handover form.
Employee: Wait a minute, why does it say that I’m not renewing the contract for personal reasons? If you’re the one not renewing it, you need to issue me a Non-Renewal Notice. Also, if the contract expires and you don’t renew it, you’re required to provide me with severance compensation. I’ve worked here for 3 years, so you owe me 3 months’ salary.
Boss: We don't provide severance pay to expats. But whatever, we’ll renew the contract, but your position will be changed to intern, and your salary reduced to 5,000.
Employee: The law requires that when a contract is renewed, the employer must maintain or improve the terms of the original contract. That means my position and salary cannot be reduced. I was earning 20,000 before, and now you are shaving 15,000 off. If I refuse under these circumstances, you still have to pay me severance compensation.
Boss: We’re not paying you anything. If you have the guts, go ahead and file for labor arbitration. Do you even have any evidence?
Employee: I’ve recorded our entire conversation. I have you dead to rights here.
Boss: How do you know all of this?
Employee: I watched Edgar's videos!
