Recently, the Beijing Municipal Bureau of Commerce, in conjunction with nine other departments, jointly issued the "Notice on Several Measures for Further Optimizing the Business Environment and Promoting High-Quality Development of Beijing's Catering Industry." The notice aims to enhance the business environment for enterprises, promote high-quality development in the catering sector, stimulate service consumption, and provide greater operational convenience for catering businesses.

Simplify the construction permit for decoration

For interior renovation projects of catering establishments with an investment exceeding RMB 1 million or a construction area exceeding 300 square meters, the processing time for obtaining a construction permit has been reduced to three working days. For renovation projects with an investment of RMB 1 million or less (inclusive) or a construction area of 300 square meters or less (inclusive), no construction permit is required.

Classified and graded management of fire safety acceptance and filing

For catering establishments with a construction area between 300 and 2,500 square meters and a building height not exceeding 24 meters, enterprises may voluntarily apply for fire safety acceptance and filing under the notification-and-commitment system. For projects with an investment of RMB 1 million or less (inclusive) or a construction area of 300 square meters or less (inclusive), separate fire safety acceptance and filing are not required.

Optimize the food operation permits

When catering enterprises apply for food operation licenses, those applying for catering service management and catering service chain management business projects are exempted from on-site verification. Remove the restrictions on the area of catering service business premises and dedicated rooms, and simplify the requirements for equipment and facilities such as water pools for cleaning raw materials and tableware for the production and sale of homemade beverages and simple production and sale.

Enhance financing support

Small, medium, and micro-sized catering enterprises registered in Beijing that obtain their first loan through the Beijing Loan Service Center or the "Beijing Enterprise Financing Comprehensive Credit Service Platform" will be eligible for interest subsidies. Within one year of the initial disbursement under the first loan agreement, eligible enterprises will receive a subsidy covering 20% of the actual interest incurred, with the total subsidy capped at 1% of the loan amount. For innovative small and medium-sized enterprises recognized at the time of disbursement, the subsidy rate increases to 40%, with the total subsidy not exceeding 2% of the actual loan amount.

Implement tax and fee preferential policies

Until December 31, 2027, value-added tax (VAT) will be exempted for VAT small-scale taxpayers in the catering industry whose monthly sales do not exceed RMB 100,000 (inclusive), in accordance with national policies applicable to small-scale taxpayers, small and low-profit enterprises, and individual businesses. Sales revenue subject to a 3% VAT levy rate will be taxed at a reduced rate of 1%. Small and low-profit enterprises will calculate taxable income at 25% of the actual amount and pay enterprise income tax at a 20% rate. Additionally, the following taxes and fees will be halved: resource tax (excluding water resource tax), urban maintenance and construction tax, property tax, urban land use tax, stamp duty (excluding securities transaction stamp duty), farmland occupation tax, education surcharge, and local education surcharge.

Optimize fire safety service guarantees

Catering establishments with a construction area of 300 square meters or less (inclusive) are not required to undergo pre-operation fire safety inspections; however, voluntary applications will be accepted by the fire department. Applications for fire safety inspections can be submitted online via the "Beijing Municipal Government Services Network" or the "Jing Tong" APP, where applicants may track processing progress and obtain electronic certificates. The fire department shall complete the inspection and notify the applicant of the result within seven working days of application acceptance.

Implement flexible law enforcement

For catering operators, the first violation is not punished, or minor violations are exempted from punishment. They shall be ordered to stop the illegal act. A combination of persuasion and education, guidance and demonstration, and guidance and interviews shall be adopted to urge rectification and guide them to operate in accordance with laws and regulations. Guide enterprises to issue prepaid cards in accordance with laws and regulations and optimize the prepaid consumption environment.
