NPC Standing Committee Seeks Comments on Draft Amendment to the Cybersecurity Law and 11 Other Laws

全国人大常委会就网络安全法修正草案等十二部法律征求意见


Recently, at the 17th Session of the Standing Committee of the 14th National People's Congress (NPC), lawmakers deliberated on 12 draft laws, including the Cybersecurity Law of the People's Republic of China (Draft Amendment) (the "Draft"), the Book on General Provisions of the Ecological and Environmental Code (Second Draft for Review), the Book on Ecological Protection of the Ecological and Environmental Code (Second Draft for Review), the Book on Green and Low-Carbon Development of the Ecological and Environmental Code (Second Draft for Review), the Enterprise Bankruptcy Law of the People's Republic of China (Draft Revision), the Environmental Protection Tax Law of the People's Republic of China (Draft Amendment), and the Foreign Trade Law of the People's Republic of China (Draft Revision). The full texts of these drafts have been released to the public for comment, with a 30-day consultation period.


The Draft contains nine articles, with the following highlights: (1) improving legal liability for failure to perform cybersecurity protection obligations in accordance with the law; (2) improving legal liability for failure to perform obligations to address illegal information in accordance with the law; (3) ensuring consistency in legal liability for acts infringing on personal information rights and interests; and (4) adding provisions on circumstances for lighter, reduced, or exempted administrative penalties.


日前,第十四届全国人民代表大会常务委员会第十七次会议对《中华人民共和国网络安全法(修正草案)》(下称《草案》)、《生态环境法典总则编(草案)(二次审议稿)》、《生态环境法典生态保护编(草案)(二次审议稿)》、《生态环境法典绿色低碳发展编(草案)(二次审议稿)》、《中华人民共和国企业破产法(修订草案)》、《中华人民共和国环境保护税法(修正草案)》、《中华人民共和国对外贸易法(修订草案)》等十二部法律草案进行审议,并对外公布全文,面向社会征求意见,征求期限均为30日。


《草案》共9条,主要内容包括:一是完善不依法履行网络运行安全保护义务行为的法律责任。二是完善不依法履行违法信息处置义务行为的法律责任。三是做好侵害个人信息权益等行为法律责任的衔接。四是增加从轻、减轻或者不予行政处罚的规定。

[Automotives] MIIT Seeks Comments on Intelligent and Connected Vehicle - Safety Requirements of Combined Driver Assistance System

[汽车] 工信部就《智能网联汽车 组合驾驶辅助系统安全要求》征意


Recently, the Ministry of Industry and Information Technology (MIIT) has issued the Intelligent and Connected Vehicle — Safety Requirements of Combined Driver Assistance System (Draft for Comment) (the "Draft") and is now soliciting public comments. The deadline for submitting comments is November 15, 2025.


The Draft sets out safety requirements for the basic single-lane combined driver assistance system, basic multi-lane combined driver assistance system, and navigation-based combined driver assistance system of intelligent and connected vehicles (ICVs), as well as the corresponding inspection and testing methods. The Draft includes the following key points: (1) specifying functional performance requirements and establishing a product safety baseline; (2) proposing process management requirements to ensure product safety throughout; and (3) standardizing system usage to guide reasonable and safe application. The Draft strictly limits the "design operating conditions" of the systems, requiring that they may only be activated within their design operating conditions. For different functions, the Draft establishes comprehensive safety technical requirements covering human-machine interaction, functional safety and expected functional safety, information security, and data recording, and sets out a multi-tier verification scheme comprising proving ground tests, road tests, and document inspections.


近日,工业和信息化部发布《智能网联汽车 组合驾驶辅助系统安全要求(征求意见稿)》(下称《征求意见稿》),现公开征求意见,征求截止于11月15日。


《征求意见稿》拟规定智能网联汽车基础单车道组合驾驶辅助系统、基础多车道组合驾驶辅助系统、领航组合驾驶辅助系统的安全要求,描述相应的检验与试验方法。《征求意见稿》内容包括:一是明确功能性能要求,构建产品安全基线;二是提出过程管理要求,全面保障产品安全;三是规范系统使用方式,引导合理安全应用。《征求意见稿》严格限定系统的“设计运行条件”,要求系统只能在其设计运行条件下激活。针对不同功能设置了包括人机交互、功能安全和预期功能安全、信息安全、数据记录等在内的全方位安全技术要求,构建由场地试验、道路试验和文件检验等在内的多层级验证方案。

[Financial Service] SAFE to Deepen the Reform of Foreign Exchange Administration for Cross-border Investment and Financing

[金融服务] 国家外汇局发文深化跨境投融资外汇管理改革


Recently, the State Administration of Foreign Exchange (SAFE) has issued the Circular on Matters Related to Deepening the Reform of Foreign Exchange Administration for Cross-border Investment and Financing (the "Circular"), which shall take effect on the date of issuance.


The main contents of the Circular are as follows: (1) deepening the reform of foreign exchange administration for cross-border investment; (2) deepening the reform of foreign exchange administration for cross-border financing; and (3) optimizing policies for facilitating receipts and payments under capital accounts. Specifically, the Circular cancels the requirement for basic information registration of preliminary expenses for foreign direct investment (FDI). It also abolishes the registration requirement for reinvestment in China by foreign-invested enterprises (FIEs), extending the pilot policy of exemption from such registration—previously limited to certain provinces and municipalities—to the whole country. The Circular allows reinvestment in China of foreign exchange profits under FDI. In addition, the pilot policy permitting domestic non-enterprise research institutions to receive overseas funds, once limited to certain provinces and municipalities, will be expanded nationwide. The Circular further expands the facilitation of cross-border financing. It raises the cross-border financing facilitation quota for high-tech enterprises, "specialized, sophisticated, and innovative" enterprises, and technology-based SMEs to the equivalent of USD 10 million. For certain eligible enterprises selected under the "innovation points system," the quota will be further increased to the equivalent of USD 20 million.


近日,国家外汇管理局发出《关于深化跨境投融资外汇管理改革有关事宜的通知》(下称《通知》),自发布之日起实施。


《通知》主要内容包括:一是深化跨境投资外汇管理改革;二是深化跨境融资外汇管理改革;三是优化资本项目收入支付便利化政策。其中,《通知》取消外商直接投资前期费用基本信息登记。取消外商投资企业境内再投资登记,将在部分省市试点的外商投资企业境内再投资免登记政策扩大至全国。允许外商直接投资项下外汇利润境内再投资。将在部分省市试点的境内非企业科研机构接收境外资金政策扩大至全国。《通知》还扩大跨境融资便利,将高新技术、“专精特新”和科技型中小企业的跨境融资便利化额度统一提高至等值1000万美元。将部分依托“创新积分制”遴选的符合条件的企业的跨境融资便利化额度进一步提升至等值2000万美元。
