Chile accepts patent types such as invention, utility model, and design. The Chilean National Institute of Industrial Property (Inapi) is responsible for the unified management of related affairs. This issue mainly introduces the appearance design.

Applying for a Chilean design patent can be directly submitted at Inapi.

Applicants can submit invention patent applications through the electronic services provided by Inapi. The application documents include: a six sided view of the design and an explanation of the design.

For those who request priority, proof documents are required. The application documents need to be in Spanish.

Inapi conducts a formal review of the general registration process for exterior designs, and designs that meet the formal requirements are authorized.

During the validity period of the design, that is, from the date of publication of the application in the official gazette, any interested party may request substantive examination of the design at their own expense.

If the examination finds that there are formal issues, Inapi will issue a notice of correction, and the applicant should respond within 30 days from the date of submission. If no response is received, the application will be deemed not submitted.

Once the formal requirements are met, Inapi will issue a patent certificate, and the applicant is required to publish the abstract in the official gazette at their own expense.

The publication request should be completed within 20 days from the date of certificate issuance, otherwise the authorization request will be deemed not submitted.

The protection period of a Chilean design patent starts from the date of application and is 15 years.
