巴林商标申请主管机构
巴林现行商标法律为2006年第11号《商标法》。巴林是世界知识产权组织成员国，1997年10月29日成为巴黎公约成员国。
2005年12月5日加入马德里议定书，属纯议定国国家，协定于2007年6月正式在巴林生效。在巴林的商标权基于注册，商标制度是单类别制度。巴林采用尼斯协定作为商品和服务分类。
巴林之工业产权事务均由工贸及旅游部下之工业产权局管辖。

巴林商标申请流程
1.商标查询：申请前审查申请的商标是否有在先商标或者违法禁注条款；
2.提交申请：经查询后申请人将商标申请材料递交到巴林国家知识产权局，并缴纳申请费用；
3.形式审查：审查员对申请提交的应备文件是否满足法定要件的审查，如查核申请书内容填写是否充份、清晰；提交书证或有关手续是否完备，经初步审查没有问题后对该商标予以受理并发送官方回执；
4.实质审查：初步审查后，审查员审查申请的商标是否违反法律禁止使用和禁止注册的条款或者在先权利；
5.公告：商标申案经审查没有问题即会公告，进入异议阶段。任何人可在商标公告之日起60日内向巴林国家知识产权局提出异议。 商标申请人须于收到异议后2个月内提出答辩。申请人如无法在期限内对异议提出答辩，该商标申请将被视为被放弃；
6.商标注册：商标注册申请被核准后，便会把该商标的详细资料录入注册纪录册，并向申请人发出注册证明书。
注：a.整个顺利的申请过程（如果没有驳回、异议等情况出现）大概需要18-36个月。
b.巴林商标的有效期为10年，从商标申请之日起算。到期可以续展，申请续展应该在有效期满前6个月办理，每次续展的有效期同为10年，商标续展期内未提交商标续展申请，该商标注册将被撤销。
商标使用证明
商标必须在注册日起连续5年内使用，以避免成为商标未使用的撤销目标。要避免商标成为未使用的撤销目标，商标须于巴林境内进行商业上、针对指定商品∕服务进行使用，但并不需要定期提出使用证据。
如有进口限制、其他政府政策、不可抗力以及其他不可预见事由导致商标无法使用，则可免于被撤销。巴林商标法并未明确定义商标未使用之正当事由，当事人可尝试提出具说服力之理由，或可为法院所接受。
如实际使用的商标与注册商标略以不同的形式使用，并不会影响商标注册之效力，并且只要不是变更商标的本质，即原则上允许该情况。只要该修改不影响商标本质及其主要特征，已注册的商标可以透过修改变更。
Basis of Trademark Application in Bahrain

The current trademark law of Bahrain is trademark Law No. 11 of 2006. Bahrain is a member of the World Intellectual Property Organization and became a member of the Paris Convention on 29 October 1997. It joined the Madrid Protocol on December 5, 2005, and is a purely agreed state.
The agreement officially came into force in Bahrain in June 2007. Trademark rights in Bahrain are based on registration and the trademark system is a single class system. Bahrain has adopted the Nice Agreement as a classification of goods and services.
All industrial property matters in Bahrain are governed by the Industrial Property Office under the Ministry of Industry, Trade and Tourism.

Note: a. The trademark authorization letter shall be certified by the consulate.
b. Foreign basic certificate and business registration certificate must be certified.
Application Process
1. Trademark inquiry: before the application, check whether the applied trademark has a prior trademark or illegal prohibition clauses;
2. Application submission: The applicant shall submit the trademark application materials to bahrain National Intellectual Property Office after inquiry and pay the application fee;
3. Form review: the examiner's review of whether the documents submitted by the application meet the statutory requirements, such as checking whether the content of the application is full and clear; Whether the documents submitted or the relevant procedures are complete, the trademark shall be accepted and the official receipt shall be sent after the preliminary examination;
4. Substantive examination: After the preliminary examination, the examiner will examine whether the trademark application violates the provisions of prohibition of use and registration or prior rights;
5. Announcement: Trademark claim will be announced once there is no problem after examination and enter the stage of objection. Any person may file an objection to the National Intellectual Property Office of Bahrain within 60 days from the date of the trademark announcement. The trademark applicant must file a defense within 2 months of receipt of the objection. If the applicant is unable to defend the objection within the time limit, the trademark application will be deemed to have been abandoned；
6. Trademark Registration: After an application for trademark registration is approved, details of the trademark will be entered in the Register and a certificate of registration will be issued to the applicant.
Note：a.The entire application process (if there are no rejections, objections, etc.) takes about 18-36 months.
b. Bahraini trademarks shall be valid for 10 years from the date of application. The application for renewal shall be handled 6 months before the expiration of the validity period, and the validity period of each renewal shall be 10 years. If the trademark renewal application is not submitted during the renewal period, the trademark registration will be revoked.
Certificate of Trademark Use
Trademarks must have been used for five consecutive years from the date of registration to avoid being the target of revocation for unused trademarks. To avoid the mark being the target of revocation for unused use, the mark must be used commercially in Bahrain for specified goods/services without regular evidence of use.
The trademark may not be revoked due to import restrictions, other government policies, force majeure or other unforeseen circumstances. The Bahraini Trademark Law does not clearly define the legitimate reasons for trademark non-use, and the parties may try to make a convincing argument, or it may be accepted by the court.
If the actual trademark is used in a slightly different form from the registered trademark, the validity of the trademark registration will not be affected, and as long as it does not change the nature of the trademark, this situation is allowed in principle. A registered trademark may be altered by amendment provided that such amendment does not affect the essence and main features of the trademark.
