The EU treats geographical indications as a separate type of intellectual property from trademarks, with specific legislation for geographical indications and specific protection.
The registration of a geographical indication recognizes that a particular quality, characteristic or reputation of a particular product is primarily derived from its geographical origin.
In addition to the system of protected geographical indications, the EU also has protected appellations of origin.
The European Commission is responsible for the uniform registration of PGIs and PDOs, and registered PGIs/PDOs are valid throughout the EU, while individual EU countries are responsible for the protection and enforcement of registered PGIs/PDOs in accordance with the law.
If the PGI/PDO is filed and registered first, a mark may not be registered and used if its use might infringe the registered PGI/PDO, and the registration should be invalidated.
If the use of a trademark is likely to infringe the registered PGI/PDO and the trademark has been registered in the EU in good faith or has acquired a certain reputation through use before the PGI/PDO was filed for registration, the trademark may continue to be used.
