在瑞士，外观设计（Design）是独立于专利之外的一类知识产权，是指可以注册并获得保护的新设计。
设计可以是平面的，如纺织品的花纹或瓶子的标签，也可以是一种形状，如钟表、灯具或椅子的外观。
瑞士联邦知识产权局（IGE）负责授予和管理瑞士外观设计，但不对其新颖性和独创性进行审查。
申请人需要在提交外观设申请前，自行检查该设计是否与已申请或已公开的设计相同或相似。
在瑞士，注册外观设计权属于最先提起外观设计注册申请的人。
申请人可以通过两种途径申请瑞士外观设计注册：一是通过IGE递交瑞士国内外观设计注册申请；二是可通过海牙协定提交外观设计国际注册申请。
直接向IGE申请注册瑞士外观设计的程序
1.申请前准备
IGE负责授予和管理瑞士外观设计，但不对其新颖性和独创性进行审查。申请人需要在提交外观设申请前，自行检查该设计是否与已申请或已公开的设计相同或相似。
2.准备申请材料
申请外观设计所需要的材料相对简单，申请人需要对设计进行充分的描述，并提交《外观设计注册申请表（Eintragungsgesuch für Designs）》。
提交时有以下方面需要注意：
申请人必须写明完整的姓名，如果有多名申请人，必须指定一个代理人，并填入下一项中。如果申请人在瑞士没有居住地或营业地，必须指定一个瑞士代理人或指定一个在瑞士的收件地址。
如果在一项申请中包含多个外观设计，这些设计必须属于同一个类别，不属于同一类别的的设计不可以组合申请。
如果申请人不想将设计提供给公众，可以将公开时间从申请日或优先权日起最多延期30个月。
如果6个月内首先在其他国家提出过外观设计申请，并要求优先权的，需要写明首次提出申请的国家、申请日期及申请号。
3.提交申请
外观设计注册申请可通过电子邮件提交，也可邮寄或直接向IGE提交。
申请文件应选择一种瑞士官方语言（德语、法语或意大利语）撰写，一旦提交就不可更改，之后的程序将全部使用该语言。
4.审查
IGE将向申请人寄出付款账单，其中的收费包括基本费用和公开费。收到款项后，IGE审查申请文件是否符合法律要求，并且至少有一个附图可用。
如果申请文件存在缺陷，IGE将向申请人发出书面形式的审查意见。申请人必须在规定的期限内予以纠正，否则IGE将拒绝注册申请。
5.注册
一旦成功完成上述各项流程，设计将获得注册，申请表和附图的信息将公开。申请人将收到注册证书。
瑞士外观设计的保护期限为5年，自申请日起算。期限届满前12个月内（最迟不得超过届满后6个月）可以申请续展，每次续展不超过5年。保护期最长不超过25年。
In Switzerland, a design (Design) is a category of intellectual property rights separate from patents and refers to a new design that can be registered and protected.
A design can be flat, such as a pattern on a textile or a label on a bottle, or it can be a shape, such as the appearance of a clock, a lamp or a chair.
The Swiss Federal Institute of Intellectual Property (IGE) grants and administers Swiss designs but does not examine them for novelty or originality.
Applicants are required to check for themselves whether the design is identical or similar to a design that has already been filed or disclosed before filing a design application.
In Switzerland, the right to register a design belongs to the first person to file an application for design registration.
Applicants can apply for the registration of a Swiss design in two ways: firstly, by filing an application for the registration of a Swiss domestic design through the IGE; secondly, by filing an application for the international registration of a design through the Hague Agreement.
The procedure for applying for registration of a Swiss design directly with IGE:
1. Pre-application preparation
IGE is responsible for granting and administering Swiss designs, but does not examine their novelty or originality.
The applicant is required to check on his own whether the design is identical or similar to a design that has already been applied for or disclosed before filing the design application.
2. Preparation of application materials
The materials required for filing a design application are relatively simple. The applicant needs to give a full description of the design and submit the "Eintragungsgesuch für Designs".
The following aspects need to be noted when submitting:
The applicant must be named in full, and if there is more than one applicant, a representative must be appointed and entered in the next item. If the applicant does not have a place of residence or business in Switzerland, he must appoint a Swiss agent or designate an address for receipt in Switzerland.
If more than one design is included in a single application, the designs must belong to the same class; designs that do not belong to the same class may not be combined.
If the applicant does not wish to make the design available to the public, he may extend the time for disclosure by up to 30 months from the date of filing or the priority date.
If a design application has first been filed in another country within 6 months and priority is claimed, the country where the application was first filed, the date of filing and the application number need to be stated.
3. Filing an Application
An application for registration of a design may be filed by e-mail, by post or directly with the IGE.
The application document should be written in one of the official Swiss languages (German, French or Italian), which cannot be altered once it has been filed and will be used for all subsequent proceedings.
4. Review
IGE will send the applicant a bill for payment, in which the charges include the basic fee and the publicity fee. Upon receipt of payment, IGE examines the application for compliance with legal requirements and the availability of at least one accompanying drawing.
If there are deficiencies in the application file, IGE will send the applicant a review in written form. The applicant must rectify the defects within a specified period of time, otherwise IGE will reject the application for registration.
5. Registration
Upon successful completion of the above processes, the design will be registered and the information in the application form and accompanying drawings will be made publicly available. The applicant will receive a certificate of registration.
The term of protection of a Swiss design is five years from the date of filing. Renewals may be applied for up to 12 months before the expiry of the term (at the latest 6 months after the expiry of the term), with each renewal not exceeding 5 years. The maximum period of protection is 25 years.
