捷克专利包含发明、实用新型、外观设计三类，由捷克工业产权局（Indutrial Property Office of The Czech Republic）负责审查、授予与保护。本期主要介绍发明专利。
捷克是WIPO成员国、PCT缔约国以及EPO成员国，因此捷克发明专利可以通过：PCT途径指定捷克申请、直接向捷克工业产权局递交以及通过EPO指定捷克生效三种方式申请。
提交发明专利申请时，申请人至少需要提交说明书、至少一项权利要求、必要的附图，如果申请人在捷克没有经营地址或经常居住地，需要委托当地的律师进行。要求优先权的申请人，需要在申请时同步提交优先权证明文件。
自申请日或优先权日起18个月内，专利申请公布，申请人可以要求提前公布，也可以要求在公布时不提及发明人名称。
自申请日起三年内，申请人需要主动提起实质审查请求（全面审查）并缴纳官费，否则申请会视为撤回。前述的三年期限不能延长。
通过实质审查的专利，将被授予专利权，并进行公告。自申请日起，专利权有效期为20年。
捷克设有补充保护制度，对于符合要求的药品或植物类专利，可以给予补充保护证书（SPC）。
1.发明专利申请费：CZK 1200
2.实质审查（全面审查）费：CZK 3000
3.专利授权费（页数在10页以内）：CZK 1600，每增加一页加收CZK 100
4.SPC请求费：CZK 5000
Czech patents include three categories: invention, utility model, and design, which are reviewed, granted, and protected by the Industrial Property Office of the Czech Republic. This issue mainly introduces invention patents.
Czech Republic is a member of WIPO and a contracting party to PCT, therefore Czech invention patents can be designated as Czech applications through the PCT pathway or directly submitted to the Czech Industrial Property Office.
Apply for a Patent
When submitting an invention patent application, the applicant needs to provide at least a specification, at least one claim, and necessary drawings. If the applicant does not have a business address or habitual residence in the Czech Republic, they need to hire a local lawyer to handle the matter.
Applicants who request priority rights need to submit priority proof documents simultaneously with the application.
Within 18 months from the date of filing or priority, if a patent application is published, the applicant may request early publication or request that the inventor's name not be mentioned at the time of publication.
Within three years from the date of application, the applicant must initiate a request for substantive examination (comprehensive examination) and pay official fees, otherwise the application will be deemed withdrawn. The aforementioned three-year period cannot be extended.
Patents that have passed substantive examination will be granted patent rights and announced. The patent right is valid for 20 years from the date of application.
The Czech Republic has a supplementary protection system, and for drugs or plant patents that meet the requirements, a Supplementary Protection Certificate (SPC) can be granted.
