乌克兰专利包含发明、实用新型、外观设计，由乌克兰知识产权研究所（UIPI）负责审查、授予与保护。本期主要介绍外观设计。
乌克兰是外观设计海牙体系成员国，因此申请乌克兰外观设计有两种途径：直接向UIPI递交申请、通过海牙途径指定乌克兰。
乌克兰外观设计保护产品的局部外观。乌克兰外观设计申请文件必须包含：外观设计图片（六面视图）、对外观设计的简要说明、委托书（如有）。
同一申请可以至多包含100项外观设计，但需要属于同一洛迦诺分类，且申请人与设计人相同。后期也可将同一申请中的多项外观设计拆分为多个申请。
申请文件需要使用乌克兰语，提交时可以使用其他语言，但申请日起2个月内需要提交乌克兰语翻译文件。申请之日起2个月内需要缴纳申请官费，此期限可以延长，但不得超过6个月。
非乌克兰居民或企业或在乌克兰无常用地址的申请人，需要委托乌克兰专利律师进行专利申请。
审查中，如UIPI认为申请不符合相关法律法规的要求，会发出补正通知或审查意见，申请人收到后，需要在2个月内进行答复。如单个申请超过100项外观设计或涉及的外观设计不属于同一分类，申请人需要在收到通知后3个月内进行分案。
审查通过或补正后无问题的，申请会被接受，申请人在收到UIPI的授权通知后，应在3个月内支付相应授权费。外观设计授权的同时会在公报中进行公告。
缴纳完成授权费后，外观设计获得正式注册，注册之日起1个月内，会下发证书。
如果UIPI的决定是不予注册，申请人在收到决定后2个月内提起上诉。
乌克兰外观设计专利有效期为自申请日起5年，可以续展，每次续展保护5年，可以续4次，即乌克兰外观设计专利权保护期最长为25年。
需要注意，在乌克兰公开但未注册（即未向UIPI申请）的外观设计，自其在乌克兰境内公开之日起，保护三年。

Ukrainian patents, including inventions, utility models and designs, are examined, granted and protected by the Ukrainian Intellectual Property Institute (UIPI). This issue focuses on designs.
Ukraine is a member of the Hague System for Designs, so there are two ways to apply for a Ukrainian design: filing an application directly with the UIPI, or designating Ukraine through the Hague route.
Apply
A Ukrainian design protects the partial appearance of a product. The Ukrainian design application file must contain: a picture of the design (six-sided view), a brief description of the design, and a power of attorney (if any).
The same application may contain up to 100 designs, provided that they belong to the same Locarno classification and that the applicant and the designer are the same. It is also possible at a later stage to split a number of designs from the same application into multiple applications.
The application documents are required to be in Ukrainian, while other languages may be used for filing, but a translation into Ukrainian is required within 2 months of the filing date.
Payment of the official fee is required within 2 months from the date of filing, which may be extended for a period not exceeding 6 months.
Applicants who are not residents or enterprises of Ukraine or who do not have a usual address in Ukraine are required to appoint a Ukrainian patent attorney to prosecute the patent application.
During the examination, if the UIPI considers that the application does not comply with the requirements of the relevant laws and regulations, it will issue a notice of correction or an opinion on the examination, which the applicant is required to respond to within 2 months after receiving it.
If there are more than 100 designs in a single application or the designs involved do not belong to the same classification, the applicant needs to make a division within 3 months after receiving the notice.
If the examination is passed or there is no problem after correction, the application will be accepted and the applicant should pay the corresponding authorisation fee within 3 months after receiving the notification of authorisation from UIPI. The authorisation of the design will be published in the Gazette at the same time.
Upon payment of the authorisation fee, the design is duly registered and a certificate is issued within 1 month from the date of registration.
If the UIPI decides not to register the design, the applicant has 2 months from the date of receipt of the decision to file an appeal.
A Ukrainian design patent is valid for 5 years from the date of filing and may be renewed for a period of 5 years for each renewal, which may be renewed 4 times, i.e. the maximum period of protection of a Ukrainian design patent right is 25 years.
It should be noted that designs disclosed but not registered in Ukraine (i.e. not filed with the UIPI) are protected for three years from the date of their disclosure in the territory of Ukraine.
Office Fees
1.Application official fee (only 1 design): 1600UAH
2.Additional fee (for each item starting from the 2nd design): 500UAH
3.Extension of time to respond to an examination: 800 UAH
4.Appeal against the examination decision: 4000UAH
5. Declaration of invalidity: 32,000 UAH.
