秘鲁1995年1月11日加入《保护工业产权巴黎公约》，1995年4月11日生效；2009 年3月6日加入《专利合作条约》（PCT），2009年6月6日生效。
秘鲁可接受专利类型为发明、实用新型、外观设计。秘鲁国家竞争和知识产权保护署（INDECOPI）负责统一管理相关事务。本期主要介绍发明。
因秘鲁是PCT成员国，故申请秘鲁专利可以直接在INDECOPI提交，也可以通过PCT途径指定秘鲁。
申请人可通过INDECOPI提供的电子服务提交发明专利申请。
申请文书包括：说明书、摘要、权利要求书、说明书附图（如有）。请求优先权的，需要证明文件。申请文件需要使用西班牙语。
申请日起30个工作日内，INDECOPI会进行形式审查，若有问题，申请人需要在收到通知后2个月内补正或答复。专利申请自申请日或优先权日起18个月内公布，可以请求提前公布。
专利公布之日起60个工作日内，利害关系人可以对该发明的可专利性提出异议意见。INDECOPI收到异议意见后，会要求申请人在30个工作日内进行答复。
没有异议或异议不成功的，进入实质审查阶段。申请人在收到审查意见后，要在意见给给出的期限前进行答复，否则申请视为撤回。
实质审查通过，INDECOPI会发放专利证书与授权公告。秘鲁发明专利保护期自申请日起计算，为20年，每年年费到期日为申请日所在月的最后一天，未缴纳则权利终止。需要注意，秘鲁发明专利在审查过程中，就需要开始缴纳专利年费。

Peru joined the Paris Convention for the Protection of Industrial Property on January 11, 1995, which came into effect on April 11, 1995; two thousand and nine
Joined the Patent Cooperation Treaty (PCT) on March 6, 2009 and came into effect on June 6, 2009. Peru accepts patent types such as invention, utility model, and design.
The Peruvian National Agency for Competition and Intellectual Property Protection (INDECOPI) is responsible for the unified management of relevant affairs. This issue mainly introduces inventions.
As Peru is a member of the PCT, patent applications for Peru can be submitted directly at INDECOPI or designated through the PCT pathway.
Applicants can submit invention patent applications through the electronic services provided by INDECOPI.
The application documents include: specification, abstract, claims, and accompanying drawings (if any). For those who request priority, proof documents are required.
The application documents need to be in Spanish. Within 30 working days from the application date, INDECOPI will conduct a formal review.
If there are any issues, the applicant needs to make corrections or respond within 2 months after receiving the notification.
The patent application shall be published within 18 months from the date of application or priority, and early publication may be requested.
Within 60 working days from the date of patent publication, interested parties may raise objections to the patentability of the invention.
After receiving objections, INDECOPI will request the applicant to respond within 30 working days. If there are no objections or the objections are unsuccessful, proceed to the substantive examination stage.
After receiving the examination opinions, the applicant must respond before the deadline given in the opinions, otherwise the application will be deemed withdrawn.
After the substantive examination is passed, INDECOPI will issue a patent certificate and authorization announcement.
The protection period of Peruvian invention patents starts from the date of application and is 20 years. The annual fee expires on the last day of the month in which the application date is located. Failure to pay the fee will result in the termination of the rights.
It should be noted that Peruvian invention patents require payment of patent annual fees during the examination process.
