The South African company and Intellectual Property Office (CIPC) are responsible for the unified management of related affairs. This issue mainly introduces the appearance design.
According to South Africa's Design Act, design includes both aesthetic and functional designs.
Aesthetic design "refers to any design that is applicable to any object, whether it is a pattern, shape, construction, decoration, or a combination of any two or more of the above, regardless of the implementation method, regardless of aesthetic quality, capable of acting on the visual perception and whose characteristics are solely judged by the visual perception.
For example, the design of a ring is often associated with aesthetic features.
Functional design "refers to any design that is applicable to any item, whether it is a pattern, shape, structure, or any combination of two or more of the above, regardless of the implementation method, and includes necessary features that can achieve the functions required for the item to which the design is applied.
In functional design, it also includes integrated circuit topology (referring to three-dimensional functional design composed of electrical, electromagnetic, or optical components and integrated circuits), mask work (referring to integrated circuits or a part of an integrated circuit), or a series of mask works.
The aesthetic design registration of South African exterior design is in section A of the exterior design registration book, and the functional design registration is in section F.
Applicants can directly apply to CIPC to obtain a South African design patent, and the specific procedures are as follows:
1. Appearance design search
Retrieval is not mandatory, but it is recommended to conduct a search before applying to ensure the originality of the design or that identical or similar designs have not been registered.
The search can be conducted at the Design Registration Office in Pretoria, and the applicant can go there on their own or entrust an agent to handle it.
2. Registered users
Before submitting the application, the applicant must first register as a user on the CIPC website or at their office to obtain a user code in order to make payments to CIPC.
After registration, the website will automatically create a virtual account for the applicant under their username.
Applicants need to deposit funds into their CIPC virtual account before submitting their application. Afterwards, all fees related to the application will be deducted from the virtual account.
3. Submit an application
The application requires a paper version to be submitted, and some documents can be submitted online. The applicant shall mail pictures or photos (A4 paper size) of the appearance design with novelty and distinctiveness to CIPC, fill out and submit the required form:
D1: Two "Application and Confirmation Forms" can only be submitted in paper form. The applicant needs to fill in the classification number according to the Locarno classification.
If the classification number cannot be determined, they can request the assistance of the design registrar to determine it, but they need to pay an additional 220 South African rand. Please note that the user code should be filled in on D1.
D2: Two copies of the "Appearance Design Registration Form" can only be submitted in paper form.
D3: A Power of Attorney can be submitted online.
D6: Two sets of 'Definitive Statements and Explanatory Statements' can only be submitted in paper form.
A deterministic statement must be filled out to explain the scope of protection provided by the design registration.
An explanatory statement is optional, used to explain the features of the item using the design, including the functionality of the item and/or the method or principle of constructing the item.
If the applied design is an integrated circuit topology diagram, mask work, or a series of mask works, explanatory statements must be provided regarding its functions and operations.
D8: Two copies of the 'Public Details Form' can only be submitted in paper format. Among them, the brief statement of features should not exceed 150 words and is a summary of deterministic and explanatory statements.
This form needs to be accompanied by accompanying drawings for public disclosure.
Representation: Seven copies in A4 paper size, one of which needs to be submitted in electronic format, and the rest in paper format.
The attached diagram should include different perspectives, such as top, side, and front views. Select a perspective for public disclosure and submit two accompanying drawings indicating 'for public disclosure'.
All accompanying drawings (excluding those used for publicity) should be signed.
4. Review and Authorization
Within 5 working days from the receipt of the application by CIPC, the applicant will receive a D1 return form confirming that CIPC has received the application and assigned a formal design application number.
After a formal review period of 6 months (to verify compliance with formal requirements), CIPC will issue a registration (acceptance) notice to the applicant.
The applicant must publish the notice of CIPC in the prescribed manner in the patent journal. CIPC will issue the registration certificate within 44 working days from the date of public announcement.
5. Modify
After the application is submitted, only limited corrections can be made to the application. Article 26 of the Design Law allows for the correction of typographical or obvious errors; Article 27 allows for the correction of design applications or designs at any time before or after registration based on the following reasons:
Change in ownership of exterior design
Change of residential or document delivery address
Resolve some defects to allow the registration application process to continue
Explanation incorrect
Incorrect wording in the application
The maximum protection period for aesthetic designs in South African design patents is 15 years, and the maximum protection period for functional designs is 10 years, starting from the date of registration or initial publication (whichever is earlier).
The owner of the right to design shall pay maintenance fees annually from the registration date or the first public disclosure date of the design before the expiration of the third year, otherwise the right will become invalid.
It should be noted that according to the South African Designs Act, anyone can apply to revoke a registered design at any time.
