哪些情况必须注销？
What situations require cancellation?
1. 主动终止类：聘用合同到期未续签、双方协商解除劳动关系、外籍员工主动离职等。
Active termination type: Employment contract expires without renewal, both parties negotiate to terminate the labor relationship, foreign employees voluntarily resign, etc.
2. 法定触发类：外籍员工死亡或丧失行为能力、用人单位依法被终止（如注销、吊销执照）。
Statutory trigger category: death or loss of legal capacity of foreign employees, or termination of the employer in accordance with the law (such as cancellation or revocation of license).
3. 自动注销类：工作许可有效期届满未延续，或许可被依法撤销、撤回、吊销。
Automatic cancellation category: Work permit expires but is not renewed, or the permit is revoked, withdrawn, or revoked in accordance with the law.
特别提醒：用人单位与外籍员工终止关系后，需在10个工作日内提交注销申请，逾期可能引发风险。

2. 聘用关系解除、合同终止或其他与注销原因相关的证明材料（聘用关系解除、合同终止需双方签字。）

• 特殊情形补充材料Supplementary materials for special circumstances：
1. 员工失联/擅自离职：超过15日未能取得联系的，用人单位应在市级以上的报纸（写明公司名称、护照、工作许可号码等）对外籍人员擅自离职公告进行为期10日的公示。公示期满仍未取得联系的，外籍人员本人未提出异议的，用人单位可提交注销工作许可申请，上传注销申请表、离职证明(加盖公章，免除外籍人员签字)、报纸原件(公告栏和报头体现登报时间及报纸等级)、情况说明(载明外籍人员基本信息，外籍人员为擅自离职，所述内容真实，如后续出现任何问题单位承担一切责任，加盖公章并有法定代表人签字)等材料。
Employee loss of contact/unauthorized resignation: If contact cannot be obtained for more than 15 days, the employer shall publish a notice of unauthorized resignation of foreign personnel in newspapers at or above the city level (indicating company name, passport, work permit number, etc.) for a period of 10 days. If contact has not been obtained after the expiration of the public notice period and the foreign personnel themselves have not raised any objections, the employer may submit an application for cancellation of the work permit, upload the cancellation application form, resignation certificate (stamped with official seal, exempt foreign personnel from signing), original newspaper (the bulletin board and header reflect the time of publication and newspaper level), situation explanation (stating the basic information of the foreign personnel, the foreign personnel resigned without authorization, the content is true, and if any problems arise in the future, the unit shall bear all responsibilities, stamped with official seal and signed by the legal representative) and other materials.
2. 单位注销：申请人可自行申请，申请表无需公章，但需提供市场监管部门的注销证明及个人情况说明。
Unit cancellation: Applicants can apply on their own, and the application form does not require an official seal, but they need to provide a cancellation certificate from the market supervision department and a personal information explanation.
3. 涉及薪酬承诺：需提交个人所得税纳税记录及扣缴端查询截屏（加盖公章），未提交将记录失信。
Regarding salary commitments: Personal income tax payment records and screenshots of withholding end queries (stamped with official seals) need to be submitted. Failure to submit will result in record breach.

注销流程怎么走？
How to go through the cancellation process?
目前全国已实现全程在线办理，无需提交纸质材料（特殊情况需核验原件）
At present, the whole process of online processing has been achieved nationwide, without the need to submit paper materials (original documents need to be verified in special circumstances)
1. 系统申请：用人单位登录“外国人来华工作管理服务系统”并提交申请。
System application: The employer logs in to the " Service system for foreigners working in China" and submits the application.
2. 材料上传：在线填写并打印《外国人来华工作许可注销申请表》（需加盖公章及申请人签字），同步上传相关证明材料。
Material upload: Fill out and print the "Application Form for Cancellation of Foreigner's Work Permit in China" online (stamped with official seal and signed by the applicant), and upload relevant supporting materials simultaneously.
3. 预审审查：3-5个工作日(外国高端人才(A类)1-5个工作日)，预审通过后2个工作日内在线受理。
Pre review: 3-5 working days (1-5 working days for foreign high-end talents (Class A)), and online acceptance within 2 working days after passing the pre review.
4. 领取证明：审查期限约3-5个工作日，全程在线;决定通过后可前往线下领取《外国人来华工作许可注销证明》。
