理赔金额虽然不算高，但保险公司对跨境支付理赔款的审查极为严格。这笔交易涉及多个境外主体：实际付款人、实际收货的买方公司，以及因当地进口资质限制而委托的进口商。进口商在提单、出口报关单上被列为买家，且是被保险人，而中国卖家出具的合同与商业发票上记载的买家却是实际买方公司，单证之间存在明显不一致。保险公司因此要求逐笔说明交易背景、资金流向、各主体之间的关系以及货权归属。

赵雅芳律师接受委托后，重新整理理赔材料并提交保险公司。材料仍多次被退回补件，客户数次以为理赔无望。面对保险公司提出的每一轮疑问，律师梳理交易链条，理清各主体之间的关系、付款路径与货权转移过程，起草书面说明，指导客户提供补充文件，持续与保险公司对接沟通，遇到的问题均一一顺利解决。

Representing a U.S. Enterprise in a Cross-Border Cargo Damage Insurance Claim and Securing the Full Insurance Payout

Recently, Avon Zhao, an attorney on Larry Zhou's team at Landing (Shenzhen) Law Office, represented an overseas enterprise in a cross-border cargo damage insurance claim. The full insurance payout has been received.

The overseas enterprise purchased large vehicles from a Chinese seller. During transit, an accident occurred, damaging the vehicles, and the repairs were costly. The client filed a claim with a Chinese insurer on its own, but the claim was initially rejected; coupled with poor communication, the payout could not be obtained. The client therefore engaged Larry Zhou's team at Landing (Shenzhen) Law Office, with Avon Zhao handling the matter.

Although the claim amount was not particularly high, the insurer's review of cross-border payouts was extremely rigorous. The transaction involved multiple overseas entities: the actual payer, the actual buyer that received the goods, and an import company engaged due to local import licensing restrictions. The import company was listed as the buyer on the bill of lading and the export customs declaration and was also the insured, while the sales contract and commercial invoice issued by the Chinese seller named the actual buyer—an obvious inconsistency across the documents. The insurer therefore required item-by-item explanations of the transaction background, fund flows, relationships among the entities, and title to the goods.

After being retained, Avon Zhao reorganized the claim materials and submitted them to the insurer. The materials were still returned several times for supplementation, and the client came to believe more than once that the claim would not succeed. In response to each round of questions from the insurer, Avon traced the transaction chain, clarifying the agency relationships among the entities, the payment path, and the transfer of title. She drafted written explanations, organized the client to supplement authorization documents, joint statements, payment vouchers, and translated customs documents, and communicated with the insurer repeatedly to explain the rationale behind the transaction structure. Each issue encountered was resolved one by one.

In the end, after strict review, the insurer paid the claim proceeds to the overseas beneficiary, and the client received the funds in full. During the process, the client was dissatisfied with the insurer's processing efficiency, but was highly satisfied with Attorney Avon's problem-solving capability and professional expertise.
