[Financial Service] NFRA to Regulate Information Disclosure by Banking and Insurance Institutions
The National Financial Regulatory Administration (NFRA) recently released the Administrative Measures for the Information Disclosure by Banking and Insurance Institutions (Draft for Comment) (the "Draft") for public consultation by October 3, 2026.
The Draft consolidates previous disclosure measures for banks, insurance institutions, and trusts, unifying standards and expanding scope to all NFRA-regulated entities. It streamlines fragmented provisions for easier implementation, strengthens management requirements, and mandates internal disclosure systems with clear responsibilities for directors and senior management. The regulatory framework is enhanced with tools like assessments, examinations, inquiries, and penalties. Differentiated disclosure requirements are established based on institution types.

日前，国家金融监督管理总局发布《银行保险机构信息披露管理办法（征求意见稿）》，公开征求意见截至 10 月 3 日。
《征求意见稿》整合了此前银行、保险及信托的信息披露规定，统一标准并覆盖所有受监管机构。通过梳理零散条款，提升了法规的可执行性。新规强化了披露管理要求，明确机构需建立内部制度并压实董监高责任。同时完善监管框架，引入监管评价、现场检查、问询及处罚等手段，并针对不同机构类型实施差异化披露要求。
SPC Issues Opinions on Lawfully Adjudicating AI-related Disputes
The Supreme People's Court (SPC) recently released the Opinions on Lawfully Adjudicating Artificial Intelligence-related Disputes (the "Opinions").
Comprising 24 articles across five parts, the Opinions establish guidelines for adjudicating AI disputes, regulate AI-related infringements, address intellectual property issues, improve procedural rules, and refine working mechanisms. Focusing on high-concern issues such as AI face-swapping, voice cloning, "AI hallucinations," doxxing, big-data price discrimination, autonomous driving, and model training, the document introduces targeted substantive and procedural rules for litigation.
最高法发布《关于依法审理涉人工智能纠纷案件的意见》
近日，最高人民法院印发《关于依法审理涉人工智能纠纷案件的意见》。
《意见》共 5 部分 24 条，明确了涉 AI 纠纷的审判原则，规制侵权行为，细化知识产权争议处理，完善诉讼程序及惩戒机制，并健全相关工作体系。文件聚焦"AI 换脸拟声”、"AI 幻觉”侵权、“网络开盒”、“大数据杀熟”、自动驾驶及模型训练等热点问题，针对性地制定了实体裁判与诉讼程序规则。
[Automotives] Nine Authorities Issue the Plan for the Development of the Intelligent Connected New Energy Vehicle Industry During the 15th Five-Year Plan Period
Recently, the Ministry of Industry and Information Technology (MIIT) and eight other authorities have jointly issued the Plan for the Development of the Intelligent Connected New Energy Vehicle Industry During the 15th Five-Year Plan Period (the "Plan").
Aiming to solidify China's global leadership in the intelligent connected new energy vehicle (ICNEV) sector by 2030, the Plan targets 70% market share for new energy passenger vehicles and 40% for commercial vehicles domestically, alongside large-scale deployment of automated driving. It outlines 17 key tasks across five areas: technological innovation, industrial system upgrades, cross-sector integration, governance, and global cooperation. Four major projects and three key initiatives, including "AI + Automobiles" and ecosystem cultivation, are launched to support these goals.

近日，工业和信息化部等九部门联合印发《智能网联新能源汽车产业发展“十五五”规划》。
《规划》提出，到 2030 年巩固我国智能网联新能源汽车全产业链优势，进入世界汽车强国行列。目标国内新能源乘用车、商用车新车销量占比分别达 70% 和 40%，自动驾驶汽车实现规模应用。为此部署了技术创新、体系升级、跨界融合、行业治理及全球合作等 5 方面 17 项重点任务，并启动关键技术攻关、标准测试能力提升等 4 大工程，以及“人工智能 + 汽车”、关键零部件生态培育等 3 项重点行动。
A Brief Commentary on the Draft Administrative Measures for Fundraising by Private Investment Funds [Natasha XIE, Austin ZHANG, Yongze LI, JUNHE LLP]
On September 4, 2026, the China Securities Regulatory Commission (CSRC) issued the Administrative Measures for Fundraising by Private Investment Funds (Consultation Draft) for public comment. Comprising 45 articles across seven chapters, the Draft refines fundamental fundraising principles, qualified investor criteria, regulatory frameworks, fund safeguards, and legal liabilities compared to existing self-disciplinary rules. It further clarifies suitability obligations for private fund managers and distributors. This briefing analyzes the key provisions of the Consultation Draft.
重组中的反避税问题——从 13 号公告出发的一次系统性梳理【叶永青，王一骁，安理律师事务所】

重组税收问题因其交易复杂性和特殊性，一直是税收征管的重点与难点，其中的反避税问题尤为值得深究。
国家税务总局近日发布的《关于企业重组业务所得税处理有关征管问题的公告》（2026 年第 13 号），将合并、分立业务的股东“一致性”门槛从“全体一致”放宽至“合计持股超过 50%"，同时对持股 5% 以上及前十大居民企业股东施加了“全部一致 +12 个月锁定”的双重约束。这一“松紧结合”的制度安排体现了反避税的精细化要求。本文以此为契机，对重组中的反避税问题进行体系化梳理。
