随着全球私人财富持续增长,跨境遗产继承日益成为高净值人士财富传承规划中不可忽视的议题。新加坡凭借零遗产税政策、成熟的信托制度及完善的金融体系,吸引了大量境外资产配置,其遗产管理人制度也随之受到广泛关注。新加坡在继承英国遗产管理人制度的基础上,通过《遗嘱认证与管理法案》、《无遗嘱继承法》、《受托人法》及《家庭司法法院规则》等法律构建起本国特色的遗产管理人制度。本文拟以新加坡遗产管理人制度为研究对象,分析其产生方式、职责权限及法律责任,并在比较中新两国相关制度的基础上,探讨其对我国遗产管理人制度完善及相关法律实务的借鉴意义。本文仅为对新加坡遗产管理人制度的一般性介绍及学术探讨,不构成对任何具体事项的法律意见。

新加坡遗产管理人制度介绍
根据新加坡金融管理局(MAS)公布的数据,新加坡资产管理规模已突破6.7万亿新元,其中约76%的资金来自境外[1]。越来越多的境外高净值人士将银行账户、家族信托、公司股权及不动产等资产配置于新加坡。然而,相比于财富如何进入新加坡,一个同样重要的问题往往被忽视——当资产所有人去世后,这些资产如何顺利完成继承?账户内存款的转移、房产过户、股权变更登记等问题将随之而来。要妥善解决这些问题,有必要深入了解新加坡的遗产管理人制度。
1. 遗产代理人产生的具体方式
不同于我国,新加坡将进行遗产管理的主体统称为遗产代理人。遗产代理人又分为遗嘱执行人和遗产管理人,二者的主要差别在于遗产管理的权利来源不同,遗嘱执行人的权利来源于被继承人的遗嘱,遗产管理人的权利则来源于法院授权的遗产管理书。
(1)被继承人订立了遗嘱并指定了遗嘱执行人——遗嘱执行人
若被继承人生前订立了遗嘱并指定了遗嘱执行人,则该遗嘱执行人可以向法院申请遗嘱认证书,取得管理遗产的权利,并依据遗嘱履行相应的权利义务[2]。仅在遗嘱中指定了遗嘱执行人的情况下,产生的遗产代理人才称为遗嘱执行人;其余情况下产生的遗产代理人均称为遗产管理人。
(2)被继承人订立遗嘱但未指定遗嘱执行人,或未订立遗嘱——遗产管理人
A. 已订立遗嘱但未指定遗嘱执行人
若被继承人订立了遗嘱,但未指定遗嘱执行人、遗嘱执行人放弃担任或遗嘱执行人不存在,而有权申请的主体愿意承担遗产管理责任的,该等主体可以依据《遗嘱认证与管理法案》规定的先后顺序,向法院申请附有遗嘱的遗产管理书,以对遗产进行管理[3]。
B.未订立遗嘱[4]
在被继承人未订立遗嘱的情况下,法院可以综合考虑被继承人配偶、父母、子女或其他近亲属对遗产的权益及申请顺位,酌情向其中一人单独或数人共同颁发遗产管理书。在无上述主体申请担任遗产管理人时,法院还可以向债权人颁发遗产管理书,并可以要求该债权人签署保证书,承诺按比例清偿死者债务且不得优先清偿自身债务。
(3)特殊情形
A.公共信托人
公共信托人是新加坡设置的一个具有遗产管理职权的政府机构。在出现遗产管理延迟、中断,或遗产代理人未能有效管理遗产等《遗嘱认证与管理法案》第55条[5]规定的情形时,法院可以向公共信托人颁发遗产管理书。此外,若遗产为无遗嘱遗产、总价值不超过50,000新元,且不存在法律规定的排除情形[6](如存在未清偿债务、存在涉及被继承人的未结诉讼等),公共信托人有权在确认不存在待处理的遗产管理申请后,签署法定书面声明,宣布自己成为该被继承人的遗产管理人[7]。需要注意的是,由公共信托人管理的遗产,其分配须遵循《无遗嘱继承法》规定的顺序[8]。
B.必要遗产代理人
在任何为保全死者财产而有必要时,法院可以向其认为合适的人签发权限受限的遗产管理书,不受上述近亲属优先申请的限制。但该遗产管理书的权限仅限于收集和保全死者的财产、收取应付给死者遗产的债务及出具有效清偿证明,其行为须受法院指示约束。[9]
C.临时遗产接管人[10]
若有人在新加坡境内留有财产,且存在财产可能被挥霍或侵害的风险,公共信托人、任何声称对该财产拥有权益的人、被继承人去世时保管或控制该财产的人及其代理人,均可通过原诉传票申请法院介入。法院可以在颁发遗嘱认证书或遗产管理书之前,指定公共信托人或其他合适的人作为该财产的临时接管人,以避免遗产因无人管理而遭受不必要的损毁。
2. 遗产代理人的人数限制
新加坡对遗产代理人的人数有上限,就同一笔遗产,不得有超过四人同时担任遗产代理人。此外,若遗产涉及未成年人权益或遗嘱设有终身权益,则必须由信托法团或至少两名个人共同担任遗产代理人。[11]
当遗嘱认证书或遗产管理书颁发给了多名遗产代理人,而其中一人去世时,则由存续的遗产代理人继续管理遗产。此外,如果全部遗产代理人均在遗产尚未管理完毕时去世,则法院可就剩余遗产另行颁发遗产管理书。
在存在未成年人受益人的情况下,若仅剩的唯一遗产代理人并非信托法团,且在受益人未成年或终身权益存续期间遗产尚未完成全面管理,则法院可根据利害关系人的申请委任额外的遗产代理人,以满足信托法团或至少两名个人共同管理遗产的法定要求[12]。
3. 遗产代理人的资格认定与身份证明文件
(1)具体资格要求
在新加坡,担任遗产代理人一般须满足三项条件:年满21岁(即成年)[13]、心智健全[14],以及并非未解除破产的破产者[15]。
若有权申请遗产管理书的人未满21周岁或心智不健全,法院有权将遗产管理书颁发给其监护人或法院认为合适的人,前提是不违反遗产代理人人数的法定限制。待其年满21周岁或恢复心智健全后,须向法院重新申请遗产管理书,方可取得遗产管理的权利[16]。
未解除破产的破产者在例外情况下也可担任遗产代理人,但须主动向法院披露其破产身份,并说明获准担任遗产代理人的理由,由法院酌情决定是否准许[17]。
(2)身份证明文件
遗嘱认证书及遗产管理书是新加坡遗产代理人的身份证明文件。若遗产总价值超过500万新元,申请人须向高等法院家事审判庭申请遗嘱认证书或遗产管理书;若遗产总价值未超过500万新元,则申请人可向家事法院申请上述文书。
此外,遗产代理人在取得权利外观时,均须进行宣誓,承诺按照遗嘱指示和法律规定分配遗产并清偿债务,在宣誓委员面前签署宣誓书后,方可取得相应的文书。
4. 遗产代理人的职责
遗产代理人主要履行以下职责[18][19]:
(1)申请并取得遗嘱认证书或遗产管理书
根据上述不同的权利来源,向法院申请并取得相应的权利外观文书。
(2)编制资产清单[20]
在新加坡,资产清单是记录被继承人死亡时构成其遗产的全部资产的文书。根据新加坡法院官网提供的资产清单表格,清单需要填写的内容包括被继承人的境内及境外财产、附有不动产抵押担保的未偿债务,以及相应的估计价值。[21]
如果被继承人未留下资产清单,则遗产代理人需要编制一份资产清单,并在申请遗嘱认证书或遗产管理书时同步提交给法院。
(3)开立遗产管理账户
以遗产管理的名义开立账户,遗产代理人是该账户的签署人。该账户可用于接收遗产资产及清偿附有不动产抵押的未偿债务等。法律未强制要求遗产代理人对账户进行审计,但如果产生相关争议或法院认为有必要时,利害关系人可向法院申请对该账户进行审计,法院也可主动要求进行适当审计。需要注意的是,聘请会计师并不意味着遗产代理人可以因此免除其接受的监督以及勤勉管理遗产的义务[22]。
(4)管理遗产账目
在[2023]SGHC107[23]案件中,继承人向法院起诉,要求遗产管理人提供商铺的收支记录,但遗产管理人拒绝提供银行流水、缴费凭证等能够证明收支情况的记录。最终新加坡法院认为遗产管理人未履行忠实记账、信息披露的义务,要求其遗产管理人出示附有完整单据的账目。
新加坡遗产代理人负有管理账目的义务,有责任正确清算账目,记录资产及其处理方式、已完成的分配等,并且始终保持账目的完整性。当受益人需要时,遗产代理人应当提供适当、完整和准确的说明和文件;在法院要求时,应当出示完整的遗产账目。但是,法院保留拒绝下达出示账目命令的自由裁量权,且受益人对于遗产代理人提交账目的要求不应过于苛责。
(5)发布债权申报公告[24]
发布债权申报公告并非遗产代理人的强制性义务。遗产代理人可以在准备分配遗产时,在《政府公报》或其他足以合理使有关权利人知悉的其他方式发布公告,告知财产转让或分配的意向,并要求利害关系人在至少两个月的期限内申报债权。债权申报期限届满后,遗产代理人转移或分配财产的,无需对未知悉但主张权益的人承担法律责任,以平衡遗产代理人的权利与责任。但需要注意的是,债权申报期届满并不意味着债权人丧失该债权,其仍可以就该部分债权主张权利。
(6)偿还死者未清偿的税务、贷款和债务(统称“负债”)
在新加坡,被继承人的债务一般以其遗产清偿,家庭成员不因亲属身份而承担清偿责任。因此,遗产代理人还承担清偿被继承人依法应付的税费、贷款及其他债务的职责。只有在债务清偿完毕后,才可以根据遗嘱或《无遗嘱继承法》的规定分配剩余遗产。
如果遗产有偿付能力,即遗产价值大于债务,则遗产代理人可以直接用遗产清偿相应债务。
如果遗产无偿付能力,即遗产价值小于债务,则应优先偿还被继承人的丧葬费、遗嘱事务费用和遗产管理费,剩余部分按照《2018年破产、重组与解散法》规定的顺序进行清偿[25][26]。
此外,在存在医疗债务的情况下,如果被继承人在住院期间去世,被继承人的保健储蓄可全部用于支付最后一笔医疗账单,而不受新加坡保健储蓄提款限额的限制。
在遗产代理人完成遗产管理并依法完成债务清偿后,受益人以其应得份额取得确定的实益权益,遗产代理人即成为受益人的普通受托人[27],为受益人的最佳利益行事。若遗产代理人同时也是遗产受益人,则其应当优先考虑其他受益人的权益而非自己的权益[28]。
(7)按照遗嘱或法律规定将财产分配给受益人或其监护人
在遗产价值大于债务的情况下,债务清偿完毕后,即可按照遗嘱或《无遗嘱继承法》的规定将财产分配给受益人或其监护人。但需注意,在债务、税务、诉讼或受益人资格尚未确定时,遗产代理人不应过早完成最终分配。
5. 遗产管理人的法律责任
新加坡遗产代理人需要遵循严格的信义义务,忠实归集、清算和分配遗产,及时保存账目并向受益人说明遗产情况;若因其行为造成损失,须承担赔偿责任。若失职情节严重,或遗产代理人继续履职不利于遗产妥善管理,法院可根据利害关系人的申请撤销遗产代理人身份、修改遗嘱认证书或遗产管理书[29][30],并委任法院认为合适的其他人继续管理遗产。
此外,任何人无合法授权,意图从新加坡转移或试图转移已被指定由临时遗产代理人接管的财产,或者销毁、隐藏、拒绝向临时接管人交出该部分财产的,均构成刑事犯罪。经治安法庭定罪,可处以最高1,000新元的罚款或最长6个月的监禁。[31]
02
新加坡遗产管理人制度的本土启示
我国《民法典》及《民事诉讼法》确立了遗产管理人制度,但相应的配套制度尚未健全,目前存在遗产管理人履职积极性不足、实务推进不顺畅等实践性困境,遗产管理制度亟待优化。
借鉴新加坡遗产管理人制度的经验,可梳理出对我国的以下启示:
1. 临时遗产接管人制度
无遗嘱或遗嘱未指定遗产管理人的情况下,我国遗产管理人可通过继承人推选、继承人共同担任等方式确定,并规定了民政部门或村民委员会作为兜底主体,一定程度上减少了遗产“无人管理”的情况[32]。但我国法律并未明确遗产管理人确定前,哪些主体有权、如何暂时管理遗产,存在可能导致遗产毁损的管理空白。
新加坡的临时遗产接管人制度下,相关主体可以申请法院在颁发遗嘱认证书或遗产管理书之前,指定公共信托人或法院认为合适的其他人作为临时接管人,在遗产管理人确定前对遗产进行临时管理。对此,我国可加以借鉴,在法院指定遗产管理人案件[33]中,允许在指定遗产管理人产生前,由法院认为合适的人选担任临时遗产接管人,负责遗产管理人确定前的临时管理事务。
2. 公告制度
目前我国尚未建立统一的遗产管理公告制度或平台。但我国人口众多、社会关系复杂,遗产管理中容易出现遗产管理人难以知晓的债务。若遗产分配完毕后债权人才申报债权,容易产生新的纠纷。
新加坡遗产管理制度下,遗产代理人可以在权威报刊或其他足以合理通知债权人的平台发布遗产管理公告,要求债权人在指定期限内申报债权。这一制度有效减少了因信息不对称导致的遗产管理纠纷,同时一定程度上避免了遗产代理人因无法预见未知债务而承担不成比例的管理责任。
对此,我国亦可构建类似的公告制度,要求遗产管理人在法院平台或其他权威媒体上发布遗产管理公告,并结合我国国情,将债权申报期限适当延长至三个月或六个月,以兼顾债权人权益保护与遗产管理人履职效率。

律师从事跨境遗产管理业务的实务要点
跨境遗产管理逐渐成为律师行业的新兴领域,吸引了众多涉外团队参与。但跨境遗产管理律师在处理新加坡与中国两地遗产时,仍需注意以下问题:
1. 遗嘱效力存在冲突的可能
目前中国与新加坡的继承制度间存在较大的差别,若仅设立一份遗嘱同时处理两地遗产,极易因法域不同导致部分遗嘱无效。
例如,新加坡仅认可书面形式的遗嘱,且遗嘱有效须有两名以上见证人在场见证;而我国允许订立录音录像遗嘱,自书遗嘱亦无需见证人。因此,若共用一份未经见证的自书遗嘱或录音录像遗嘱,该遗嘱在新加坡很可能被认定为无效,导致被继承人的真实意愿难以完整实现。
因此,在处理中国与新加坡跨境遗产事务时,若被继承人留有遗嘱,首要任务是明确遗嘱在各法域的效力,避免后续产生争议。建议被继承人咨询两国律师后,分别订立两份遗嘱并分别处分中国遗产与新加坡遗产,以规避因法域差异导致的效力风险。
2. 身份证明文件不具有当然的跨境效力
在新加坡高等法院审理的SGHC(A)35[34]案件中,被继承人的配偶持瓦努阿图法院颁发的遗产管理书,试图直接在新加坡行使遗产管理权,但被继承人的父亲以“该境外授权系欺诈取得”为由提出异议。新加坡高等法院指出,境外遗产管理授权并不当然在新加坡产生效力,拟在新加坡境内管理遗产者,仍须通过新加坡法律规定的遗产代理人资格实质审查程序,方可取得在新加坡行使遗产管理权利的资格。
根据上述案例,结合我国目前尚未建立与新加坡遗产管理人制度衔接的配套制度的实践情况,我国遗产管理人的身份证明文件同样不能当然适用于新加坡。已取得中国遗产管理人资格的人,仍须经过新加坡的遗产代理人指定程序,重新取得新加坡遗嘱认证书或遗产管理书后,方可管理在新加坡的遗产。
反之,新加坡遗产代理人希望管理被继承人在我国遗产,情况亦同,根据《涉外民事关系法律适用法》第三十四条之规定,尽管已取得新加坡遗产代理人身份,仍需按照中国法律规定,经过遗嘱指定、继承人推选等相关程序,方可取得中国遗产管理人身份、管理中国境内遗产。
3. 建议设置遗产管理专用账户
我国现行法律并未强制要求遗产管理人必须设立遗产管理专用账户,但为适配新加坡的法律规定,同时更方便、清晰地管理遗产,建议有跨境需求的律师自行或协助客户设立遗产管理账户。必要时,还可以聘请会计师负责账户审计,一方面在法院要求提供相应账户资料时能够迅速提供,避免账户冻结等风险;另一方面也避免因非自身原因导致财产损毁而被追责。
结语
随着经济全球化的进一步发展,高净值人士对资产全球配置的需求不断增加,推动各国遗产管理制度的发展,而健全的遗产管理制度也同步吸引全球高净值人士在该国布局。新加坡遗产管理制度的成功和繁荣,既得益于其完善的金融体系,也源于其精细化的制度建构。随着我国遗产管理制度的不断完善,一方面需继续借鉴其他法域的成熟经验,进一步完善本国制度并构建与其他法域遗产管理制度的衔接,方便遗产管理人开展跨境遗产管理;另一方面,遗产管理业务的从业者也需深入了解新加坡等域外遗产管理制度,方能在业务实践中更好地实现涉外遗产的有效管理和衔接。

(2) A prior right to a grant under subsection (1) shall belong to the following persons in the following order:
(a) a universal or residuary legatee;
(b) a legal personal representative of a deceased universal or residuary legatee;
(c) such person or persons, being beneficiaries under the will, as would have been entitled to a grant of letters of administration if the deceased had died intestate;
(d) a legatee having a beneficial interest;
(e) a creditor of the deceased.

18.—(1) When a person has died intestate, the court may grant letters of administration of his estate.
(2) In granting such letters of administration the court shall have regard to the rights of all persons interested in the estate of the deceased person or the proceeds of sale thereof, and in regard to land settled previously to the death of the deceased, letters of administration may be granted to the trustees of the settlement.
(3) Any such grant of letters of administration may be limited in any way the court thinks fit.
(4) Without prejudice to the generality of subsection (2) —
(a) letters of administration may be granted to the husband or widow or next of kin or any of them;
(b) when such persons apply for letters of administration, it shall be in the discretion of the court to grant them to any one or more of such persons;
(c) when no such person applies, letters of administration may be granted to a creditor of the deceased; and
(d) in any case where —
(i) the next of kin of any person dying intestate, or the greater number of such next of kin, so desire; or
(ii) no next of kin or creditor or other person appears and makes out a claim to letters of administration, letters of administration of the estate and effects of the intestate may be granted by the court to such person as the court thinks fit for the purpose.
(5) Nothing in this section shall affect any law by which special provision is made regarding the estates of persons of a particular religion or race.

(a) where, after the expiration of 6 months from the death of a deceased person, no application has been made for probate or letters of administration to his estate;
(b) where any such application, though made within the said 6 months, has not within that period been proceeded with, or has been withdrawn or refused;
(c) where any person, who has received a grant of letters of administration with or without the will annexed, neglects within one month of the date of the grant to give such security as he is lawfully required to furnish;
(d) where a receiver may be appointed under section 39, but it appears that such appointment would not be a sufficient protection for the estate;
(e) where an administrator has failed to extract the grant of letters of administration; or
(f) where after the death of a last surviving executor or administrator of a deceased person’s estate 6 months have elapsed and no application for the representation of the estate has been made,

Administration by Public Trustee
62.—(1) Where any person dies leaving property in Singapore not exceeding $50,000 in value (without deduction for debts), the Public Trustee, after satisfying himself that no application for letters of administration is pending, may, if he thinks fit, by writing signed by him declare that he undertakes to administer such property.
(2) For the purpose of subsection (1), the amount of $50,000 shall not include —
(a) the value of any property which the deceased possessed or was entitled to as trustee and not beneficially; and
(b) in the case of a person who dies on or after 17 September 2005, any moneys payable by an appointed insurer pursuant to the Dependants’ Protection Insurance Scheme or any other equivalent scheme maintained by the Central Provident Fund Board under the Central Provident Fund Act 1953.
(3) Upon a declaration under subsection (1), the Public Trustee shall be empowered to administer such property as though letters of administration, with or without the will annexed, of the estate of the deceased person had been granted to him, and his receipt shall be a sufficient discharge to any person who pays any money or delivers any property to him.
(4) Notice of every declaration made under subsection (1) shall be given to the registrar.
(5) At any time prior to the distribution of any part of the property among the beneficiaries thereof under this section the Public Trustee may, if he thinks it expedient to do so, notwithstanding any declaration made by him under subsection (1), decline to proceed with the administration of the property in his hands until a grant of representation has been obtained in respect of the estate of the deceased.
[8] 《无遗嘱继承法》第7条
In effecting such distribution, the following rules shall be observed:
Rule 1
If an intestate dies leaving a surviving spouse, no issue and no parent, the spouse shall be entitled to the whole of the estate.
Rule 2
If an intestate dies leaving a surviving spouse and issue, the spouse shall be entitled to one-half of the estate.
Rule 3
Subject to the rights of the surviving spouse, if any, the estate (both as to the undistributed portion and the reversionary interest) of an intestate who leaves issue shall be distributed by equal portions per stirpes to and amongst the children of the person dying intestate and such persons as legally represent those children, in case any of those children be then dead.
Proviso No. (1) — The persons who legally represent the children of an intestate are their descendants and not their next-of-kin.
Proviso No. (2) — Descendants of the intestate to the remotest degree stand in the place of their parent or other ancestor, and take according to their stocks the share which he or she would have taken.
Rule 4
If an intestate dies leaving a surviving spouse and no issue but a parent or parents, the spouse shall be entitled to one-half of the estate and the parent or parents to the other half of the estate.
Rule 5
If there are no descendants, the parent or parents of the intestate shall take the estate, in equal portions if there be 2 parents, subject to the rights of the surviving spouse (if any) as provided in rule 4.
Rule 6
If there are no surviving spouse, descendants or parents, the brothers and sisters and children of deceased brothers or sisters of the intestate shall share the estate in equal portions between the brothers and sisters and the children of any deceased brother or sister shall take according to their stocks the share which the deceased brother or sister would have taken.
Rule 7
If there are no surviving spouse, descendants, parents, brothers and sisters or children of such brothers and sisters but grandparents of the intestate, the grandparents shall take the whole of the estate in equal portions.
Rule 8
If there are no surviving spouse, descendants, parents, brothers and sisters or their children or grandparents but uncles and aunts of the intestate, the uncles and aunts shall take the whole of the estate in equal portions.
Rule 9
In default of distribution under rules 1 to 8, the Government shall be entitled to the whole of the estate

In any case in which it appears necessary for preserving the property of a deceased person, the court may grant to any person whom the court thinks fit letters of administration limited to the collection and preservation of the property of the deceased, and giving discharges of debts due to his estate, subject to the directions of the court.

Where any person dies leaving property within Singapore, the court may, if it appears, on an application made by originating application by the Public Trustee or by any person claiming to be interested in the property, or having the custody or control thereof at the time of the death of the deceased, or being at such time an attorney of the deceased, that there is danger that the property may be wasted, appoint the Public Trustee or such other person as the court thinks fit, to be a receiver of the property pending a grant of probate or letters of administration.

6.—(1) Probate or letters of administration shall not be granted to more than 4 persons in respect of the same property.
(2) Letters of administration shall, if there is a minority or if a life interest arises under the will, be granted either to a trust corporation, with or without an individual, or to not less than 2 individuals.
(3) The court in granting letters of administration may act on such prima facie evidence, furnished by the applicant or any other person, as to whether or not there is a minority or life interest, as may be prescribed by rules made under any written law for the time being in force relating to the courts.
(4) If there is only one personal representative (not being a trust corporation) then, during the minority of a beneficiary or the subsistence of a life interest and until the estate is fully administered, the court may, on the application of any person interested or of the guardian, committee or receiver of any such person, appoint one or more personal representatives in addition to the existing personal representative in accordance with rules made under any written law for the time being in force relating to the courts.
(5) This section shall apply to grants made after 1 January 1935 whether the testator or intestate died before or after that date.
(6) For the purposes of this section, “trust corporation” means the Public Trustee or a corporation licensed as a trust company under the Trust Companies Act 2005.

24.—(1) Where the person to whom a grant would otherwise be made is an infant, administration for his or her use and benefit until he or she attains 21 years of age must, subject to paragraphs (3), (4) and (6), be granted —
(a) to both parents of the infant jointly or to the statutory guardian or testamentary guardian of the infant or to any guardian appointed by a court of competent jurisdiction; or
(b) if there is no such guardian able and willing to act and the infant has attained 16 years of age —
(i) to any next‑of‑kin nominated by the infant; or
(ii) where the infant is a married woman, to any such next‑of‑kin or to her husband if nominated by her.
(2) Any person nominated under paragraph (1)(b) may represent any other infant whose next‑of‑kin he or she is, being an infant below 16 years of age entitled in the same degree as the infant who made the nomination.
(3) Despite this Rule, administration for the use and benefit of the infant until he or she attains 21 years of age may be granted to any person assigned as guardian by order of the Registrar in default of, or jointly with, or to the exclusion of, any such person as is mentioned in paragraph (1).
(4) An order mentioned in paragraph (3) may be made on application by the intended guardian, who must file an affidavit in support of the application and, if required by the Registrar, an affidavit of fitness sworn by a responsible person.
(5) Where by virtue of section 6, a grant is required to be made to not less than 2 administrators and there is only one person competent and willing to take a grant under paragraphs (1), (2) and (3), administration may, unless the Registrar otherwise directs, be granted to such person jointly with any other person nominated by him or her as a fit and proper person to take the grant.
(6) An infant’s right to administration on attaining 21 years of age cannot be renounced by any person on his or her behalf.
《2024年家庭司法(遗嘱认证及其他事项)规则》第26条
26.—(1) Where the Registrar is satisfied that a person entitled to a grant (called in this Rule the relevant person) lacks capacity (within the meaning of the Mental Capacity Act 2008) to make decisions with respect to the management and administration of his or her property and affairs, administration for the relevant person’s use and benefit, limited until the relevant person ceases to lack mental capacity and obtains a grant for himself or herself or in such other way as the Registrar may direct, may be granted —
(a) to the person authorised by the Court to apply for a grant;
(b) to the donee authorised to make decisions about the relevant person’s property and affairs under a lasting power of attorney; or
(c) where there is no person so authorised, to such other person as the Registrar may by order direct.
(2) Unless the Registrar otherwise directs, no grant of administration is to be made under paragraph (1) unless all persons entitled in the same degree as the relevant person have been cleared off.
(3) The right of the relevant person to probate or administration when he or she regains capacity cannot be renounced by any person on his or her behalf.

29.—(1) With a view to the conveyance to or distribution among the persons entitled to any movable or immovable property, the trustees or personal representatives may give notice by advertisement in the Gazette, and such other similar notices (including notices elsewhere than in Singapore) as would, in any special case, have been directed by a court of competent jurisdiction in an action for administration, of their intention to make the conveyance or distribution and requiring any person interested to send to the trustees or personal representatives within the time, being at least 2 months, fixed in the notice or, where more than one notice is given, in the last of the notices, particulars of the person’s claim in respect of the property or any part of the property to which the notice relates.
(2) At the expiry of the time fixed by the notice, the trustees or personal representatives may convey or distribute the property or any part of the property to which the notice relates, to or among the persons entitled to the property, having regard only to the claims whether formal or not, of which the trustees or personal representatives then had notice and shall not, as respects the property so conveyed or distributed, be liable to any person of whose claim the trustees or personal representatives have not had notice at the time of conveyance or distribution.
(3) Nothing in this section —
(a) affects the right of any person to follow the property, or any property representing the same, into the hands of any person, other than a purchaser, who may have received it; or
(b) frees the trustees or personal representatives from any obligation to make searches similar to those which an intending purchaser would be advised to make or obtain.
(4) This section applies despite anything to the contrary in the will or other instrument (if any) creating the trust.

57.—(1) Where the estate of a deceased person is insolvent his estate shall be administered in accordance with the rules set out in the First Schedule.
(2) The right of retainer of a personal representative and his right to prefer creditors may be exercised in respect of all assets of the deceased, but the right of retainer shall only apply to debts owing to the personal representative in his own right whether solely or jointly with another person.
(3) Subject to subsection (2), nothing in this Act shall affect the right of retainer of a personal representative, or his right to prefer creditors.
(4) Where the estate of a deceased person is solvent his estate shall, subject to the Rules of Court and section 58 as to charges on property of the deceased, and to the provisions, if any, contained in his will, be applicable towards the discharge of the funeral, testamentary and administration expenses, debts and liabilities payable thereout in the order mentioned in the Second Schedule.

(a) first, the costs and expenses of administration or otherwise incurred by the Official Assignee;
(b) second, the costs of the applicant for the bankruptcy order (whether assessed or agreed) and the costs and expenses properly incurred by a nominee in respect of the administration of any voluntary arrangement under Part 14;
(c) third, subject to subsection (2), all wages or salary (whether or not earned wholly or in part by way of commission), including any amount payable by way of allowance or reimbursement under any contract of employment or any award or agreement regulating the conditions of employment of any employee;
(d) fourth, subject to subsection (2), the amount due to an employee as a retrenchment benefit or an ex gratia payment under any contract of employment or any award or agreement that regulates the conditions of employment, whether such amount becomes payable before, on or after the date of the bankruptcy order;
(e) fifth, all amounts due in respect of any work injury compensation under the Work Injury Compensation Act 2019 or the Work Injury Compensation Act (Cap. 354, 2009 Revised Edition) repealed by that Act accrued before, on or after the date of the bankruptcy order;
(f) sixth, all amounts due in respect of contributions payable, during a period of 12 consecutive months commencing not earlier than 12 months before and ending not later than 12 months after the date of the bankruptcy order, by the bankrupt as the employer of any person, under any written law relating to employees’ superannuation or provident funds or under any scheme of superannuation which is an approved scheme under the Income Tax Act 1947;
(g) seventh, subject to subsection (2), all remuneration payable to any employee in respect of vacation leave, or in the case of the employee’s death, to any other person in the employee’s right, accrued in respect of any period before, on or after the date of the bankruptcy order;
(h) eighth, the amount of all taxes assessed, and any goods and services tax due, under any written law before the date of the bankruptcy order, or assessed at any time before the time fixed for the proving of debts has expired;
(i) ninth, all premiums (including interest and penalties for late payment) and other sums payable in respect of the bankrupt’s insurance cover under the MediShield Life Scheme mentioned in section 3 of the MediShield Life Scheme Act 2015, and the CareShield Life Scheme established by section 5 of the CareShield Life and Long-Term Care Act 2019, respectively, before the time fixed for the proving of debts has expired.

Any person who, without lawful authority, removes or attempts to remove from Singapore any portion of the property of which a receiver has been appointed under section 39, or destroys, conceals, or refuses to yield up the same to the receiver, shall be guilty of an offence and shall be liable on conviction by a Magistrates’ Court to a fine not exceeding $1,000 or to imprisonment for a term not exceeding 6 months or to both.
