    2018 CEC i-Valley China-Germany Intellectual Property Exchange Symposium & Conference on Intellectual Property Rights Protection in the Background of Germany's Industry 4.0 Strategy Was Held Successfully

12月10日，“中电智谷2018中国-德国知识产权交流会”暨“德国工业4.0背景下的知识产权保护分享会”在深圳市福田区桑达大厦隆重举行。本次大会由深圳市福田区人民政府科技创新局主办，深圳市知识产权局、深圳新创友知识产权代理有限公司、德国MAYR KOTSCH PartmbB专利律师事务所联合主办，深圳中电智谷运营有限公司承办，深圳市知识产权研究会、深圳市福田区华强北街道办事处协办，共吸引100余家企业代表现场参与。

On Dec. 10, 2018 CEC i-Valley China-Germany Intellectual Property Exchange Symposium & Conference on Intellectual Property Rights Protectionin the Background of Germany's Industry 4.0 Strategy was solemnly held in SED Building in HBQ (Huaqiangbei)，Futian District, Shenzhen. This conference was held by Science and Technology Innovation Bureau of Futian District Shenzhen, co-sponsored by Shenzhen Intellectual Property Office, Shenzhen CYPATENT Intellectual Property Agency Co. Ltd.， and MAYR KOTSCH PartmbB, co-hosted by Shenzhen CEC i-Valley Operation Co., Ltd and supported by Shenzhen Intellectual Property Society and Sub-district Office of HQB Street, which attracted representatives of over 100 enterprises to participate on the scene.

本次大会以“德国工业4.0背景下的知识产权保护”为主题，积极响应《福田区现代产业体系中长期发展规划（2017-2035）》文件中将福田区定位“建设知识产权保护与运营示范区”的战略指示，积极引进并建设南方知识产权运营中心，支持深圳知识产权城建设提升的建设要求，邀请了来自德国MAYR KOTSCH PartmbB专利律师事务所的Claus-Michael Mayr、Petra Kotsch进行分享和交流。希望借予本次大会成功搭建起中德知识产权合作的桥梁，并希望中国的科技企业能够通过本次交流加强自身知识产权成果的保护，使其科技成果能在国际上获得更广泛的应用、创造更大的价值。

This conference is themed around “Intellectual Property Rights Protection in the Background of Germany's Industry 4.0 Strategy”, responds positively to the strategic directive of building Futian District as the “demonstration area for the protection and operation of intellectual property rights " as prescribed in Medium and Long Term Development Plan of Modern Industrial Technology System in Futian District(2017-2035), actively introduces and constructs the  China(Southern) Intellectual Property Rights Operation Center, supports the construction requirements for the construction and promotion of Shenzhen Intellectual Property City and invites Claus-Michael Mayr and Petra Kotsch from Germany MAYR KOTSCH PartmbB Patent Law Firm to share and communicatewith the participants involved. It is hoped that this conference will successfully build a bridge for China-Germany cooperation on intellectual property, and that Chinese scientific and technological enterprises can strengthen the protection of their intellectual property achievements after this exchange, so as to make their scientific and technological achievements more widely used in the world and create greater value.

活动由深圳中电智谷运营有限公司总经理孙巍主持。深圳市知识产权局促进处处长宋洋首先为本次活动致欢迎辞。她介绍了深圳市知识产权方面的总体情况以及开展知识产权保护工作的有关情况，并对深圳市的知识产权政策做了重点解读。深圳市知识产权局促进处将继续大力落实对企业、机构积极的政策支持，联合中电智谷这样的平台一起为企业服务，挖掘更多的知识产权价值。

The activity was presided by General Manger of Shenzhen CEC i-Valley Operation Co., Ltd Sun Wei. Chief of Promotion Division of Shenzhen Intellectual Property Office Song Yang first gave a welcome speech for this event, during which she gave an introduction to the general situation of intellectual property rights in Shenzhen as well as the practice of implementing intellectual property protection, and made a key interpretation of intellectual property policies in Shenzhen. The Promotion Division of Shenzhen Intellectual Property Office will continue to vigorously implement the policy support for enterprises and institutions, and work together with platforms like CEC i-Valley to serve enterprises and explore more intellectual property value.

深圳市福田区华强北街道办副主任杜涵涵在致辞中强调华强北街道将贯彻以政府引导、市场化运作为建设理念，以“知识产权交易”、“知识产权许可”、“知识产权金融”及“专有技术转移”为主要服务模块，促进知识产权的运用与转化，帮助福田区产业向创新价值链高端攀升。

Du Hanhan, Deputy Director of Sub-district Office of HQB Street, stressed in his speech that HQB Street will carry out the “government-led and market-oriented operation” as the construction concept and adopt “Intellectual Property Transactions”, “Intellectual Property License”, “Intellectual Property Finance” and “Proprietary Technology Transfer” as the main service modules to promote the use and transformation of intellectual property rights, and help the industry in Futian District to climb to the high end of the innovationvalue chain.

在“工业4.0背景下的知识产权保护现状及探讨”主题中，德国MAYR KOTSCH PartmbB专利律师事务所合伙人Claus-Michael Mayr分享了关于德国的知识产权现状、发展历程、法律体系及德国与欧洲知识产权保护环境的对比。同时德国MAYR KOTSCH PartmbB专利律师事务所合伙人 Petra Kotsch又以德国知识产权案例分析向大家更全面的展示说明了德国在具体案件中的判罚尺度。最后广东君之泉律师事务所首席法律顾问刘军结合中国知识产权保护及华强北创新企业独特的需求，为大家带来了《中国如何引导研发及挖掘高价值专利》的主题分享。

In the discussion themed “Current Situation and Discussion of Intellectual Property Protection in The Context of Industry 4.0”, Claus-Michael Mayr, partner of Germany MAYR KOTSCH PartmbB Patent Law Firm, shared the currentsituation, development history, legal system of intellectual property protection in Germany and the comparison of intellectual property protection environment between Germany and European countries. Afterwards, Petra Kotsch, another partner of the same law firm demonstrated more comprehensively the penalty scale of Germany in specific cases through the analysis of German intellectual property cases. Finally, Liu Jun, Chief Legal Officer of Guangdong Junzhiquan Law Firm, shared his opinions with the participants under the theme of “How Does China Guide R&D and Exploit High-Value Patents” in combination with intellectual property protection in China and the unique needs of innovative enterprises in HQB district.

在接下来的“中德知识产权案例交流圆桌会议” 环节，参与圆桌会议的嘉宾首先就“人工智能时代，机器通过人工智能及自学习创造的作品是否应享有知识产权”这一话题进行了探讨。随后，中外嘉宾在互动过程中详细解答了观众提出的关于”创新产品进入德国如何避免专利侵权风险“及”专利申请时技术细节披露程度和专利申请保护的关系把握”等问题，现场交流的气氛十分热烈。

In the following “China-German Intellectual Property Case Exchange Roundtable”, the guests participating in the roundtable first carried out a discussion on the topic "in the era of artificial intelligence, whether the works created by machines through artificial intelligence and self-learning should enjoy intellectual property rights". Afterwards, guests from home and abroad answered the questions raised by the audience about "how to avoid the risk of patent infringement when innovative products enter Germany" and "how to grasp the relationship between the disclosure of technical details and the protection of patent application" in detail in the processof interaction. The discussion was held in a live atmosphere.

随后，深圳市中电智谷运营有限公司董事长金皓与德国MAYR KOTSCH PartmbB专利律师事务所合伙人Claus-Michael Mayr、Petra Kotsch共同签订《中电智谷&德国MAYR KOTSCH PartmbB专利律师事务所合作德备忘录》，以此双方结为战略合作伙伴，意向建立中电智谷中德知识产权创新中心，未来将开展知识产权领域的国际保护、国际法律咨询、国际专利申请、商标注册、版权登记、交易等合作。

Subsequently, Jin Hao, President of Shenzhen CEC i-Valley Operation Co., Ltd jointly signed “Memorandum of Cooperation between CEC i-Valley & Germany MAYR KOTSCH PartmbB Patent Law Firm" together with Claus-Michael Mayr and Petra Kotsch from MAYR KOTSCH PartmbB, which symbolized the formation of a strategic partnership between the two parties with the aim of establishing CEC i-Valley  China-Germany Intellectual Property Innovation Center and conducting international cooperation in the field of intellectual property, international legal advice, international patent applications, trademark registration, copyright registration, transactions and others.
