TC260 Seeks Comments on the National Standard Classification Requirements for Consumer Intelligent Connected Device
Recently, the National Technical Committee 260 on Cybersecurity of the Standardization Administration of China (TC260) has released the Cybersecurity Technology — Classification Requirements for Consumer Intelligent Connected Device (Draft for Comment) (the "Draft") and is soliciting public comments. Comments may be submitted through October 3, 2026.
The Draft establishes a security framework and security classification rules for consumer intelligent connected devices, specifying requirements across physical hardware, system software, network communication, data information, and security assurance. It classifies devices into three security levels (Level 1 to Level 3), where higher levels build upon the requirements of lower ones. The Draft also outlines three classification combinations and six corresponding factors.
近日，全国网络安全标准化技术委员会发布《网络安全技术 消费类智能联网设备分级要求（征求意见稿）》（下称《征求意见稿》），面向社会征求意见，意见反馈截至 10 月 3 日。
《征求意见稿》构建了消费类智能联网设备的安全框架与定级规则，涵盖物理硬件、系统软件、网络通信、数据信息及安全保障等维度。文件将设备安全能力由低到高划分为三个等级，高等级需满足低等级所有要求并叠加本级特定要求。此外，《征求意见稿》明确了三个定级组合及对应的六个定级要素。

[Environmental Protection] SPC Issues the First Supporting Judicial Interpretation of the Ecological and Environmental Code
Recently, the Supreme People's Court (SPC) issued the Several Provisions on the Temporal Applicability of the Ecological and Environmental Code of the People's Republic of China (the "Provisions"), effective August 15, 2026.
Adhering to the principle of non-retroactivity and exceptions for favorable retroactive application under Article 104 of the Legislation Law, the Provisions clarify standards for applying old and new laws in ecological cases post-Code implementation. Covering 13 articles, the document addresses: (1) non-retroactivity principles and favorable exceptions; (2) rules for continuing legal facts; (3) applicability of procedural provisions in transitional cases; and (4) exclusion of the Code from retrial cases.
[环境保护] 最高法发布首个《生态环境法典》配套司法解释
日前，最高人民法院发布《关于适用〈中华人民共和国生态环境法典〉时间效力的若干规定》（下称《规定》），自 2026 年 8 月 15 日起施行。
《规定》遵循《立法法》第 104 条确立的“法不溯及既往”原则及“有利溯及”例外规则，明确了《生态环境法典》施行后新旧法律衔接适用的标准，为司法实践提供明确指引。全文共 13 条，主要内容包括：明确法典适用的不溯及既往原则及有利溯及的具体情形；规范持续性法律事实的法律适用；厘清法典程序性规定的衔接适用情形；明确再审案件不适用法典规定。

[Environmental Protection] SPC Conducts Comprehensive Review of Judicial Interpretations and Regulatory Documents Related to the Ecological and Environmental Code
Recently, the SPC issued decisions to amend nine judicial interpretations (including those on vessel-induced oil pollution), repeal pilot measures for public interest litigation, and discontinue reference to four guiding cases. Jointly with the SPP, the SPC also amended two interpretations regarding marine natural resources. All take effect on August 15, 2026.
In this review, 15 interpretations consistent with the Ecological and Environmental Code remain in force. Of the 11 requiring amendment, four involve wording adjustments while seven entail substantive changes. Additionally, the pilot measures for public interest litigation are repealed, and four guiding cases are no longer applicable.
[环境保护] 最高法全面清理《生态环境法典》相关司法解释和规范性文件
近日，最高人民法院发布决定，修改包括船舶油污损害赔偿在内的九件司法解释，废止检察院提起公益诉讼试点实施办法，并发布部分指导性案例不再参照的通知。同时，联合最高人民检察院修改了涉及海洋自然资源与生态环境公益诉讼的两件司法解释。上述文件均自 2026 年 8 月 15 日起施行。
此次清理工作中，与《生态环境法典》一致的 15 件司法解释予以保留；需修改的 11 件中，4 件作文字适应性修改，7 件进行实质性修订。此外，正式废止公益诉讼试点实施办法，另有 4 件指导性案例不再参照适用。

China Issues New Exit-Entry Regulations: Strengthening Border Restrictions for Export Control and Anti-Sanctions [David Pan, Sherry Wu, Poppy Bi, Llinks Law Offices]
The State Council has promulgated the Regulations on the Administration of Exit and Entry. Articles 4 and 5 explicitly link export control compliance, technology import/export administration, and anti-sanctions blacklists (e.g., Unreliable Entities List) with border control measures. Multinational executives and entities on these lists now face direct risks of exit bans or entry denials.
