[Trade] Two Departments Seek Comments on the E-commerce Law of the People's Republic of China
The State Administration for Market Regulation (SAMR) and the Ministry of Commerce (MOFCOM) have drafted the E-commerce Law of the People's Republic of China (Draft Amendment for Comment) (the "Draft") to solicit public opinions by August 4, 2026.
The Draft mainly has the following highlights. (1) Expanding the scope of regulation: building upon the rules for platform operators and operators on the platforms, the rights and obligations of other participants in the platform economy are clarified. (2) Improving the platform liability system: building upon the existing measures such as fixed fines and suspension of business for rectification, the Draft introduces more regulatory measures to support regular supervision. (3) Establishing a work mechanism to create synergy in regulation: in response to the cross-sector and diversified operations of platform economy businesses, the Draft sets forth the principle of consistent management for online and offline businesses and strengthens interdepartmental coordination and integrated regulation between central and local authorities. (4) Further rectifying the prominent unlawful conduct in e-commerce: relevant provisions are revised and improved to address issues of significant public concern. (5) Deepening opening-up and cooperation in the e-commerce sector: efforts will be made to promote the alignment of rules, regulations, governance, and standards with international practices, strengthen industry self-regulation, facilitate the orderly expansion of enterprises into overseas markets, introduce countermeasures against external restrictions, and safeguard the legitimate rights and interests of enterprises.
[贸易] 两部门就《中华人民共和国电子商务法》征求意见
近日,国家市场监督管理总局、商务部起草了《电子商务法(修正草案征求意见稿)》,现向社会征求意见,反馈截至 8 月 4 日。
草案亮点包括:一是扩大法律调整范围,明确平台经济其他参与主体权利义务;二是健全平台责任制度,丰富规制手段以支撑常态化监管;三是建立监管协同机制,强化线上线下归口管理及央地联动;四是规范突出违法行为,回应社会关切;五是深化开放合作,推动规则与国际接轨,加强行业自律,引导有序出海并维护企业合法权益。

Four Authorities Accelerate the Development of "AI plus Human Resources and Social Security" Applications
Recently, the Ministry of Human Resources and Social Security (MOHRSS) and three other authorities have issued the Implementation Opinions on Accelerating the Development of "AI plus Human Resources and Social Security" Applications (the "Opinions").
The Opinions set out a five-year development plan. By 2026, the authorities aim to establish the infrastructure for "AI plus Human Resources and Social Security" applications and develop around 20 application scenarios based on sector-specific large models, together with the corresponding high-quality datasets. By 2027, a number of large models and agents for the human resources and social security sector will be put into widespread use, and approximately 50 high-value application scenarios will be explored. By 2030, the goal is to achieve the broad adoption of AI across the human resources and social security sector. The Opinions also identify six major AI application scenarios in the human resources and social security sector: developing digital and intelligent employment services to create new models for employment services and management; advancing smart social insurance to enhance management and service capabilities; strengthening the targeted cultivation and utilization of talent and establishing new mechanisms for intelligent talent supply; deepening smart labor relations to build new forms of intelligent protection of labor rights and interests; developing smart human resources services to foster a new ecosystem for human resources services; and establishing a smart governance model for human resources and social security to modernize governance capabilities. In addition, the authorities have released a panorama of application scenarios, covering a total of 67 specific application scenarios.
近日,人力资源和社会保障部等四部门联合发布《关于加快推进“人工智能+人社”应用发展的实施意见》。
《意见》提出五年建设目标:2026 年建成应用基础设施,打造 20 个基于行业大模型的应用场景及高质量数据集;2027 年普及一批行业大模型和智能体,探索约 50 个高价值场景;2030 年实现人社领域人工智能普遍应用。重点打造数智就业、智慧社保、人才智能供给、智慧劳动关系、智慧人力资源服务及智慧治理六大场景,并发布包含 67 个细分场景的应用全景图。

[Financial Service] Two Authorities Accelerate the Building of Shanghai into a Global Reinsurance Hub
Recently, the National Financial Regulatory Administration (NFRA) and the Shanghai Municipal People's Government have jointly issued the Several Measures for Accelerating the Building of Shanghai into a Global Reinsurance Hub (the "Measures").
The Measures set out eight measures, including: optimizing the layout of institutions, improving the unified registration system, advancing platform development, enhancing market capacity, deepening reform and opening-up, expanding cross-border cooperation, strengthening regulatory effectiveness, and optimizing the development environment. In particular, the Measures call for optimizing the layout of institutions by facilitating the smooth flow and efficient allocation of various factors in the Lin-gang Special Area of the China (Shanghai) Pilot Free Trade Zone. They also encourage large enterprises to centralize the management of their risk protection needs in the Lin-gang Special Area, so as to promote the efficient matching of risk protection needs with underwriting capacity. In addition, the Measures call for leveraging the policy advantages of the Lin-gang Special Area to support greater cooperation and exchanges among insurance institutions and accelerate the development of a sound reinsurance market ecosystem.
近日,国家金融监督管理总局与上海市人民政府联合印发《加快上海国际再保险中心建设的若干措施》。
《若干措施》共八条,涵盖机构布局、统一登记、平台建设、能力供给、改革开放、跨境合作、监管效能及发展环境等方面。重点提出优化临港新片区机构布局,促进要素高效配置;鼓励大型企业在该区域集中管理风险保障需求,推动风险与承保能力精准对接;利用片区政策优势支持保险机构合作交流,加速构建再保险市场生态。

Trade Compliance Obligations of Outbound Businesses and the Trade Countermeasure Risks Facing Foreign businesses - A Review of the Provisions of the State Council on Outbound Investment [Deming Zhao, Xinming Zhao, Global Law Office]
Chinese companies are currently being drawn, whether by choice or by necessity, into the wave of overseas business operations. As regards the underlying causes of involuntary overseas expansion, these include both the export controls imposed by the United States, the European Union, and other countries on China-related supply chains, and the various unjustified import tariffs and non-tariff barriers that such countries have erected on the basis of discriminatory presumptions against China in areas such as labour, environment, and/or subsidies. These measures either affect the upstream supply chains of China-based enterprises (for instance, the export controls imposed by the United States and others on the high-end semiconductor sector in respect of China) or obstruct the entry of the downstream supply-chain products of China-based companies into the markets of the European Union, the United States, and elsewhere. Against this background, the overseas investment of Chinese companies is driven both by the need to develop international markets and by the necessity of responding to the foregoing measures by which the United States, the European Union, and other countries threaten the resilience and security of China-related industrial and supply chains.
