2026 年作为“十五五”开局之年,全球产业发展与合规竞争迎来全新节点。鉴于今年 11 月 APEC 领导人峰会将在深圳举行,全城进入重大主场外交保障模式,原定于 11 月举办的第五届“产业问策”知识产权高峰论坛顺延至2026 年 12 月 5 日至 6 日隆重举行。

本届论坛以“新规·新局”为主题,精准锚定全球产业创新和知识产权变革方向,直击全球化诉讼风险加剧痛点,为中国企业高质量发展提供清晰指引。

“新规”重在政策制度调整,“新局”聚焦产业与国际格局演变。当前,中外知识产权政策法规正经历深刻迭代:

国内层面,《商业秘密保护规定》正式落地,专利法及 SEP 相关规范持续完善。最高法发布《人民法院知识产权司法保护实施方案(2026—2030 年)》,明确将集成电路、先进材料、新能源等纳入重点保护,加大商业秘密刑事保护力度,规制“内卷式”竞争。中国企业正积极探索专利资产资本化,争取全球规则话语权。

国际层面,全球标准必要专利(SEP)规则加速重构。欧美强化 SEP 执法并争夺费率裁定权。韩国 LG 新能源与日本松下成立的郁金香创新(Tulip Innovation)专利池,自 2025 年起在德、韩对中国锂电企业发起系列诉讼,直接冲击中国新能源产业全球化。

同时,国内产业竞争加剧,企业间知产纠纷高频多发,“以知产为矛”成为竞争新常态。本届论坛旨在汇聚行业智慧,解读新规、剖析新局,破解出海合规难题。

  5th Industry Innovation & IP Strategy Summit | Shenzhen, 5-6 Dec 

As the opening year of China's 15th Five-Year Plan, 2026 marks a new juncture for global industrial development and compliance-driven competition. The 2026 APEC Economic Leaders'Meeting will be held in Shenzhen this November, and the city is entering a heightened readiness phase to support this major diplomatic event as host. Accordingly, the 5th"Industry Innovation & IP Strategy Summit", originally scheduled for November, has been rescheduled for December 5–6, 2026.

Under the theme"New Rules, New Landscape,"this year's Forum is closely aligned with the direction of global industrial innovation and intellectual property transformation. It directly addresses the mounting risks of cross-border IP litigation and offers clear guidance for the high-quality development of Chinese enterprises.




New Rules"and"New Landscape": Reshaping the Global IP Competitive Landscape

"New Rules"focuses on changes in policies and institutional frameworks, while"New Landscape"examines shifts in industrial and international dynamics. Intellectual property policies and regulations in China and abroad are currently undergoing profound transformation:

Domestically, the Provisions on the Protection of Trade Secrets have officially taken effect, while the Patent Law and related rules, including those concerning standard-essential patents (SEPs), continue to evolve. Administrative protection of intellectual property has been steadily strengthened, and the effectiveness of administrative enforcement has improved significantly, making it an important avenue for enterprises to protect their rights. In April 2026, the Supreme People's Court officially issued the Implementation Plan of the People's Courts for Judicial Protection of Intellectual Property Rights (2026–2030). The Plan identifies integrated circuits, advanced materials, new energy, and other key and core technology sectors as priority areas for protection; calls for stronger criminal judicial protection of trade secrets; and requires the lawful regulation of"involution-style"competition. Meanwhile, Chinese enterprises are actively exploring ways to capitalize patent assets and translate their innovation strengths into a stronger voice in shaping global rules.

Internationally, global rules governing standard-essential patents (SEPs) are being rapidly reshaped. Major European and North American economies continue to strengthen SEP enforcement while competing intensely for the authority to determine global royalty rates. Since 2025, Tulip Innovation, a patent pool jointly established by South Korea's LG Energy Solution and Japan's Panasonic Energy, has filed a series of patent lawsuits in Germany and South Korea against multiple Chinese lithium-ion battery companies, directly affecting the global expansion of China's new energy industry.

Meanwhile, as domestic industrial competition intensifies, intellectual property disputes among Chinese enterprises are becoming increasingly frequent. Patent litigation, trade secret infringement cases, and similar disputes continue to rise, and the use of IP as a competitive weapon has become a new normal in domestic industrial competition.

Against this complex and rapidly changing domestic and international backdrop, the Forum aims to bring together industry expertise, provide in-depth interpretations of new rules in China and abroad, analyze the evolving industrial landscape, and help enterprises address IP compliance challenges in their global expansion.

This year's Forum will focus on issues of pressing concern to industry and establish a high-level, five-stakeholder dialogue platform bringing together government, industry, academia, research institutions, and end users to address key industrial challenges:

(I) Main Forum: Global Industrial IP Trends and Cutting-Edge Judicial Developments

◆Release and Presentation of the 2026 China Strategy Top 100 Chinese Enterprises for Patent Innovation:Recognizing Chinese enterprises with outstanding patent-driven technological innovation capabilities and highlighting the role of intellectual property in advancing green innovation and new quality productive forces.

◆Frontier Dialogue on Global SEP Rules and Antitrust Regulation:Leading legal scholars from China and abroad, representatives of government regulators, judicial experts, senior legal executives from prominent enterprises, experienced European lawyers, and representatives of major patent pools will be invited to examine contentious issues at the heart of SEP licensing and implementation, as well as the strengthening of antitrust regulation.

◆Trends in Intellectual Property Adjudication:Focusing on the implementation of the Supreme People's Court's Implementation Plan of the People's Courts for Judicial Protection of Intellectual Property Rights (2026–2030); interpreting cutting-edge judicial developments, including stronger punitive damages, enhanced criminal judicial protection of trade secrets, and the judicial regulation of"involution-style"competition; assessing new trends in foreign-related IP cases; and exploring how enterprises can protect their rights and plan compliance strategies with precision under the new judicial protection framework.

◆Trends in Administrative Protection of Intellectual Property:Examining new approaches to improving the effectiveness of IP administrative enforcement; discussing the latest progress in coordination between administrative and judicial protection; focusing on administrative enforcement practices involving trademarks, patents, trade secrets, and other key areas; and providing practical guidance for enterprises seeking to establish a dual-track administrative and judicial rights-protection system.

◆Overseas Patent Litigation Risks and IP Compliance for Chinese Enterprises Going Global:Systematically reviewing differences in litigation rules and the latest case law across major jurisdictions, including Germany, the United States, and South Korea; examining practical challenges faced by new energy enterprises in sectors such as lithium-ion batteries, photovoltaics, and energy storage, including patent-pool licensing, compliance with technical standards, and customs seizures; and helping enterprises identify high-risk jurisdictions and develop differentiated global compliance systems.

◆Artificial Intelligence: IP Governance and Innovation:Focusing on key issues including ownership of AI-generated content, data-related IP compliance, the boundaries of foundation-model training, and protection for algorithmic innovation, with a view to jointly exploring pathways for protecting innovation.


(II) Thematic Sub-forums

◆Sub-forum 1: Trade Secret Protection and Corporate Compliance Practices

Focusing on the latest developments in China's new trade secret protection rules and relevant judicial practice, and exploring how enterprises in advanced sectors—including new materials, information and communications technology (ICT), and intelligent equipment—can establish end-to-end trade secret protection systems covering employee departures, confidentiality of technical documents, cross-border data compliance, and evidentiary strategies in litigation.

◆Sub-forum 2: Global Patent Pool Developments and Licensing Strategies

Providing an in-depth analysis of the latest operating mechanisms and fee models of major patent pools worldwide; exploring licensing negotiation strategies for SEP and non-SEP patent pools, the limits of judicial application of the fair, reasonable and non-discriminatory (FRAND) principle, and proactive strategies for Chinese enterprises in the global patent-pool landscape. Leading domestic patent-operations institutions will also be invited to explore standardized, sustainable models for the long-term operation of industry patent pools in China.

◆Sub-forum 3: Green Technology Innovation and Cross-Border Dispute Resolution

Exploring the commercialization and global deployment of patented green technologies in the low-carbon transition. The salon will bring together representatives of the World Intellectual Property Organization (WIPO) and WIPO GREEN Partners in China for in-depth discussions on green technology innovation and WIPO arbitration and mediation. It will also focus on the latest developments in cross-border patent litigation involving lithium-ion batteries, photovoltaics, and energy storage.
