[Financial Service] NPC Standing Committee Seeks Comments on Eight Draft Laws Including Financial Law

The 23rd session of the Standing Committee of the 14th National People's Congress (NPC) has deliberated eight draft laws, including the Financial Law (Draft) (the "Draft"), the Government Procurement Law (Draft Revision), the Tendering and Bidding Law (Draft Revision), the Law on Lawyers (Draft Amendment), and the Law of the People's Bank of China (Draft Revision), the full texts of which are published for public consultation for a term of 30 days.


The Draft, consisting of 11 chapters, covers general provisions, the central bank, financial institutions, financial products and services, financial markets, financial infrastructure, financial regulation, financial risk resolution, financial development and security, legal liability, and supplementary provisions. It aims to regulate the conduct and activities of financial institutions by implementing full-lifecycle regulation from their market entry, operation, to market exit; enhance the compliance among financial products and services; optimize the functions of the financial market system and improve the mechanism for ensuring financial market stability.

[金融服务] 全国人大常委会就金融法等八部法律草案征求意见

近日,第十四届全国人大常委会第二十三次会议审议了《金融法(草案)》(下称《草案》)、《政府采购法(修订草案)》、《招标投标法(修订草案)》、《律师法(修正草案)》及《中国人民银行法(修订草案)》等八部法律草案,并公布全文向社会公开征求意见,期限为 30 日。


《草案》共十一章,涵盖总则、央行、金融机构、产品与服务、市场、基础设施、监管、风险处置、发展与安全、法律责任及附则。其旨在对金融机构实施从准入、经营到退出的全生命周期监管,提升金融产品服务合规性,优化金融市场体系功能并健全稳定机制。

Eight Authorities to Boost the High-quality Development of the Industrial Internet

The Ministry of Industry and Information Technology (MIIT) and seven other government departments have jointly published the Implementation Opinions on Promoting the High-quality Development of the Industrial Internet (the "Opinions").


The Opinions set forth the development goals to be achieved by 2030 and 2035. By 2035, a world-leading industrial internet infrastructure system and an internationally advanced technology and industrial system will be established, extensive and in-depth integration of industrial internet applications across key sectors of the national economy will be realized, and the capacity of the industrial internet to support new industrialization will be fully developed. 18 specific tasks are identified in five areas, namely, infrastructure, technological innovation, integrated application, security, and industrial ecosystem. According to the Opinions, actions will be taken to optimize fundamental network capabilities, support enterprises in developing new industrial networks, steadily advance pilot programs for industrial 5G standalone private networks, and deploy industrial equipment embedded with advanced communication modules as needed. The Opinions also call for enhancing the bridging role of identification by expanding the capacity and upgrading the capabilities of national top-level nodes, improving the service capabilities of secondary nodes, and deepening the integrated application of the identification resolution system across key industries.

八部门发文推动工业互联网高质量发展

日前,工信部等八部门联合印发《关于推动工业互联网高质量发展的实施意见》(下称《意见》)。


《意见》确立了 2030 年及 2035 年两阶段发展目标。至 2035 年,将建成全球领先的工业互联网基础设施与技术产业体系,实现重点行业深度融合应用,全面支撑新型工业化。文件围绕基础设施、技术创新、融合应用、安全保障及产业生态五大方面部署了 18 项任务,包括优化网络基础能力、推动企业建设新型工业网络、开展工业 5G 独立专网试点,以及部署内嵌先进通信模组的融合设备。同时,强调增强标识解析体系的纽带作用,推动国家顶级节点扩容升级,深化其在重点行业的贯通应用。

Four Authorities Leverage Unemployment Insurance to Support Enterprises in Stabilizing and Expanding Employment

Four departments, including the Ministry of Human Resources and Social Security (MOHRSS), have jointly issued the Circular on Supporting Enterprises in Stabilizing and Expanding Employment with Unemployment Insurance (the "Circular").


The Circular sets out the arrangement in five areas, including the extension of the employment stabilization refund policy and the one-time employment expansion subsidy policy. It specifies that insured enterprises that have paid unemployment insurance premiums in full for at least 12 months and did not conduct any layoff in the previous year or maintained a layoff rate no higher than the national target for the surveyed urban unemployment rate in the previous year, or, in the case of enterprises with less than 30 employees (inclusive), maintained a layoff rate no higher than 20% of their total insured workforce, may enjoy employment stabilization refunds in accordance with the relevant provisions. The refund rate shall not exceed 30% of the unemployment insurance premiums actually paid by large enterprises and their employees in the previous year, and shall not exceed 60% for micro, small, and medium-sized enterprises. According to the Circular, employment stabilization refunds may be used for employee living allowances, payment of social insurance premiums, and the expenditures for stabilizing employment and reducing production and operating costs. The relevant policies shall apply mutatis mutandis to social organizations, law firms, accounting firms, and individual businesses participating in unemployment insurance as an employer. The Circular also clarifies that relevant policies shall come into effect from January 1 to December 31, 2026.

四部门:发挥失业保险功能作用 支持企业稳岗扩岗

近日,人社部等四部门联合发布《关于失业保险支持企业稳岗扩岗的通知》(下称《通知》)。


《通知》从延续稳岗返还、一次性扩岗补助等五方面作出部署。规定参保企业足额缴纳失业保险费 12 个月以上,且上年度未裁员或裁员率不高于全国城镇调查失业率控制目标(30 人以下企业不高于 20%),可享受稳岗返还。大型企业返还比例不超过实际缴纳额的 30%,中小微企业不超过 60%。返还资金可用于职工生活补助、社保缴纳及降低生产经营成本。社会组织、律所、会计师事务所以单位形式参保的个体户参照执行。政策执行期为 2026 年 1 月 1 日至 12 月 31 日。

From Market Access to Market Operation: China's 2026 Foreign Investment Action Plan and Its Implications [LAN Jie, XU He, GUO Huarong, ZHAO Wenjia, Haiwen & Partners]


On 16 June 2026, the Ministry of Commerce ("MOFCOM"), the National Development and Reform Commission ("NDRC"), and the Ministry of Finance jointly issued the Action Plan for Stabilizing and Enhancing Foreign Investment (Shang Zi Fa [2026] No. 97) (the "Action Plan" or the "New Policy"). As the first comprehensive policy document on foreign investments issued in the inaugural year of China's 15th Five-Year Plan, the Action Plan is not only a timely response to the need to stabilize foreign investment amid current economic conditions, but also reflects a profound development in China's foreign investment regime: a shift away from a framework centered predominantly on market access toward a regime that places growing emphasis on full-spectrum market operational safeguards.


Building on successive foreign investment stabilization and opening-up policy packages rolled out over recent years, this Action Plan underscores the central government's enduring resolve to refine China's foreign investment ecosystem and anchor stable, long-term expectations for foreign investors. Compared with earlier policy documents, the Action Plan introduces several noteworthy institutional developments, including improvements to the regulatory framework governing foreign-invested M&A, support for the domestic listing of qualified foreign-invested enterprises ("FIE(s)"), measures to facilitate reinvestment in the PRC, enhanced support for foreign participation in the high-quality development of the pharmaceutical sector, and further optimization of the regulatory framework for cross-border data transfers. This article examines each of these key developments in turn.
