Kenya: Imported goods may be seized without being filed

肯尼亚反假冒管理局（ACA）在4月26日发布公告称，自2022年7月1日起，任何进口到肯尼亚的商品，无论其知识产权权属何地，都需要在ACA进行备案。

The Kenya Anti-Counterfeiting Authority (ACA) announced on April 26 that from July 1, 2022, any goods imported into Kenya, regardless of where the intellectual property rights are owned, will need to be filed with the ACA.

5月23日，ACA又再次发布公告，将提交强制备案的截止日期延长至了2023年1月1日，并提出知识产权备案将通过反假冒管理局综合管理系统（AIMS）进行处理。这意味着从该日期起，任何进口商品的人和其知识产权所有人必须在ACA进行备案。

On May 23, the ACA issued another announcement, extending the deadline for submitting mandatory filings to January 1, 2023, and saying that intellectual property filings will be processed through the Anti-Counterfeiting Administration Integrated Management System (AIMS). This means that from that date, anyone importing goods and the owner of the intellectual property must be on file with the ACA.

不论货品的产地来源，所有企业都必须为品牌进口货物的知识产权备案，未完成制品及无品牌原材料可获豁免。违例者将构成犯罪行为，可被罚款以及监禁长达15年。

Regardless of the origin of the goods, all companies must report the intellectual property rights of branded imported goods. Unfinished products and unbranded raw materials are exempt. Violators will constitute a crime, be punishable by fines and imprisonment for up to 15 years.

成功进行知识产权备案后，ACA将以防伪装置的形式颁发认证标志。如果一旦被发现没有这种防伪装置，ACA可能会扣押并销毁商品。

Upon successful IP filing, ACA will issue a certified mark as an anti-counterfeit tool. The ACA may seize and destroy the merchandise if it is found to be without such an anti-counterfeit mark.

The new regulations on compulsory filing of IP rights make Kenya the second African country to adopt intellectual property filing after South Africa.
