导读：在华期间签证过期了怎么办？



一时疏忽，没留意到签证有效期，导致签证逾期了几周，怎么办？

Failing to notice the validity, my visa has expired weeks ago. What should I do?

我还在隔离期，但是签证快要到期了，没办法及时换发新的签证，怎么办？

My visa is about to expire but I cannot to renew it since I am still in quarantine. 



近来，不少外籍人士来咨询签证逾期相关问题。我们需要明确一点，外国人在中国居留或停留期间签证失效了属于非法居留！
Recently, many foreigners have inquired us about visa overstay. It must be noted that, Foreigners whose visas become invalid during their stay or residence in China will be considered as illegal residence!



《中华人民共和国出境入境管理法》
Exit and Entry Administration Law of the People's Republic of China

第七十八条 外国人非法居留的，给予警告；情节严重的，处每非法居留一日五百元，总额不超过一万元的罚款或者五日以上十五日以下拘留。
因监护人或者其他负有监护责任的人未尽到监护义务，致使未满十六周岁的外国人非法居留的，对监护人或者其他负有监护责任的人给予警告，可以并处一千元以下罚款。

Article 78  Foreigners who reside in China illegally shall be given a warning; where circumstances are serious, they shall be imposed with a fine of RMB 500 yuan per day, with a cap of RMB 10,000 yuan in total, or be detained for not less than five days but not more than 15 days.
Where guardians or other persons responsible for guardianship fail to perform the guardian obligation and result in foreigners below 16 years of age residing in China illegally, the said guardians or other obligated persons shall be given a warning and may also be fined not more than RMB 1,000 yuan.


那么在华期间签证逾期了该怎么办呢？
So what should you do if your visa expires when staying in China?

首先，在发现签证失效后，马上到住宿地所在区的公安局进行报备，并接受处罚。然后，需要携带公安局出具的《行政处罚决定书》和《办理签证证件告知书》到告知书上规定的时间和出入境处办理签证。
First of all, after realizing that the visa is invalid, report it immediately to the public security authority in the area where you are living in, and accept the punishment. Then, you need to bring the Decision of Administrative Punishment and the Notification for Visa Application issued by the public security authority to the designated entry-exit office at the asked time, both specified in the Notification, for visa application.

在华外籍人应当在签证注明的停留期限届满7日前向公安机关出入境管理机构申请签证延期或更换新的签证类型，否则会被判定为非法居留，被公安机关限期离境，之后想入境中国或在中国工作可就没那么容易了。
Foreigners in China should apply to the exit and entry administration for visa extension or change to a new visa type 7 days before the expiration of the stay period indicated on the visa. If not, they will be judged to be illegally overstay and be demanded to leave the country within a given time limit. What’s more it will not be so easy to enter China or work in China later.
