这话倒也说得没错，但是对于持工作签证入境的朋友来说，这可就是在违法边缘疯狂试探了。
You might be right if you are not a work visa holder. But if you are, no residence permit can lead to violation of China laws.

为什么要申请居留许可？

Why need a residence permit?



“停留期限（Duration of Each Stay）”是指游客每次入境允许在中国停留的最大天数，从入境次日00:00开始算起，到最后期限日的24:00为止。
“Duration of Each Stay” means the maximum number of days visitors are allowed to stay in China per entry. It is calculated from 00:00 on the day after entry into China, till to the 24:00 (Beijing GMT +8:00) of last permitted day.

时间因签证类型而异，从几天到30天、60天、90天、120天、180天不等。
The duration differs by the visa types. The duration ranges from a few days, to 30 days, 60 days, 90 days, 120 days and 180 days at most.

与商务签或探亲签不同，工作签证上并不会直接注明在华停留期限，而是标注着“000 days”的字样，但这并不是说持证人可以在中国无限期停留。
Unlike the business visa or family visit visa, the work visa does not directly indicate the duration of stay in China but is marked specially with "000 days". So the holder can stay in China with no limit of time? Of course not!

工作签证 Work Visa

“000”天是长期签证的特殊说明，如工作（Z）签证，学习（X1 / X2）签证，外国记者（J1）签证和居民（D）签证。这类签证的持有人必须在入境后30天内到停留地公安机关申请居留许可，具体停留期限会体现在居留许可上。
“000” days is a special note for certain long-term Chinese Visas, like China Work (Z) Visa, China Study (X1/X2) Visa, China Foreign Journalist (J1) Visa & China Resident (D)Visa. Holders are required to apply a residence permit in the local Public Security Bureau within 30 days upon arrival. Their accurate duration of stay will be specified on the residence permit.
居留许可 Residence Permit

对于持工作签证来华就业的外籍友人，若未及时申请工作类居留许可，将会面临罚款和驱逐出境的惩罚，甚至以后无法再申请来华签证。
Foreigner who come to China for employment with a work visa will face fines and be deported if they fail to apply for a residence permit for work in time, or even cannot apply for a visa to China again in the future.

第四十一条  外国人在中国境内工作，应当按照规定取得工作许可和工作类居留证件。任何单位和个人不得聘用未取得工作许可和工作类居留证件的外国人。
Article 41 To work within China, foreign nationals shall obtain a work permit and a residence permit of the work type according to legal provisions. No entity or individual shall employ foreign nationals who have not obtained a work permit and a residence permit of the work type. 　　

第八十条 外国人非法就业的，处五千元以上二万元以下罚款；情节严重的，处五日以上十五日以下拘留，并处五千元以上二万元以下罚款。
Article 80 A foreign national who is illegally employed shall be fined not less than 5,000 yuan but not more than 20,000 yuan; or if the circumstances are serious, shall be detained for not less than five days but not more than 15 days and be fined not less than 5,000 yuan but not more than 20,000 yuan concurrently.

非法聘用外国人的，处每非法聘用一人一万元，总额不超过十万元的罚款；有违法所得的，没收违法所得。
Whoever illegally employs foreign nationals shall be fined 10,000 yuan for each illegal employment but not more than 100,000 yuan in total; and any illegal income shall be confiscated.

如何申请工作类居留许可？

How to apply for a residence permit for work?



准备好申请材料，然后在停留地出入境管理局系统 https://gzwg.gzjd.gov.cn/crj-app-server/crjmsjw/index2 进行线上预约，在预约时间内前往递交申请即可。
Prepare the application documents, make an online appointment in the system of the Exit Entry Administration Bureau at the place of stay (Website: https://gzwg.gzjd.gov.cn/crj-app-server/crjmsjw/index2), and submit the application and document on site at the appointed time.

如果是首次申请，一般需要提供以下文件（以广州地区为例）：
For the first application, the following documents are generally required (take Guangzhou as an example):

1️⃣ 申请人有效护照和签证的原件和复印件；
The original and photocopy of his or her valid passport and visa.
2️⃣《外国国籍签证和居留申请表》；
Completed Foreign National Visa and Residence Application Form.
3️⃣ 广东出入境证件检验单的照片；
A digital photo for the purpose of Guangdong entry/exit documents and its Inspection Note.
4️⃣ 在广州有效的境外人员临时住宿表；
Overseas Personnel Temporary Accommodation Form valid in Guangzhou.
5️⃣ 广东出入境检疫局出具的健康证明；
Health Certificate issued by Guangdong Entry-Exit Inspection and Quarantine Bureau.
6️⃣《中华人民共和国外国人工作许可通知书》、《外国专家证书》或《外国人就业许可证》、《外国人在中华人民共和国内从事海洋石油作业许可证》或文化主管部门授权的机构颁发的演出批准文件影本（原件需核实）；
Notification Letter of Foreigners Work Permit, Foreign Expert Certificate or Foreigners Employment Permit of the People's Republic of China, Permit for Foreign Nationals to Engage in Offshore Oil Operations in the People's Republic of China, or photocopy of approval document for performances issued by agencies authorized by the cultural authority (the original document needs to be verified).
7️⃣ 雇主的确认函；
A confirmation letter from the employer.
8️⃣ 公安机关要求的其他证件。
Other certificates required by the public security authority.

出入境管理局会根据你的实际情况决定你居留许可的有效期，也就是你能在中国呆多久。
The administration will determine the validity of your residence permit according to your actual situation, that is, how long you can stay in China.

一般来说，外国高层次人才、急需的专业人员和投资者可以获得有效期不超过5年的居留许可；在有良好记录的注册实体工作的外国人可以获得有效期不超过2年的居留许可；其他人员，可获得有效期不超过1年的居留许可证。
Generally speaking, foreign high-level talents, urgently needed professionals and investors may obtain residence permits with a valid period of no more than five years; Foreigners working in a registered entity with good records may obtain a residence permit valid for no more than two years; Other persons may obtain a residence permit valid for no more than one year.

另外，如果是持其他签证入境的申请人，可凭人力资源和社会保障部门或外国专家部门出具的工作许可证申请有效期为一年或一年以下的工作类居留许可证。
In addition, applicants who enter China with other types of visas may apply for work-type residence permit valid for one year or less with work permit certificate issued by human resources and social security department or foreign experts department.

符合办理条件的，7个工作日后就可以拿到居留许可啦，可以选择邮寄也可以去现场领取。
If you meet the requirements, you can get your residence permit in 7 working days, by mail or get it at the processing window.

居留许可是有有效期的，若是想继续在华工作，要在有效期届满30日前递交延期申请，提交申请材料，逾期不离境会构成非法就业以及非法居留。
The residence permit has a period of validity. If you want to continue working in China, you should submit an extension application 30 days before the expiry of your residence permit. Failure to leave the country before the expiry will be considered as illegal employment and illegal residence. 

在中国合法工作并非易事，从申请入境签证到就业卡，再到居留许可，环环相扣，层层叠叠。不仅要提交的资料一大堆，还要不停奔波于使领馆或各大政府机构，甚至还有被拒签的可能，竹篮打水一场空。
