Common Misconceptions about Work Permits

Work in any city with work permit

A foreigner with a work visa issued in city A cannot work in a city other than city A except at the company's special request, such as a business trip.

Similarly, a foreigner who has signed an employment contract with company A cannot work for another company on a part-time basis.

Working without a work residence permit

It is not in accordance with Chinese law to work with only a work permit. Therefore, before a foreigner joins a Chinese company, he or she should also apply for a work residence permit at the Public Security Bureau to ensure that he or she is working legally.

Working with other types of visas

Holders of student visa, business visa, reunion visa and other visas are not allowed to work in China as part-time or formal jobs. Part-time students will also violate the principle of work-study.

Duration of work permit

Work permits are not permanent and need to be renewed on time. The online application must be submitted at least 30 days before the expiration date of the work permit, otherwise the Administration of Foreign Experts Affairs will not accept the application (the earliest online application can be submitted 120 days in advance).

Physical and electronic card for work permit

From December 1, 2024, physical work permits will no longer be issued. Foreigners coming to China to work who have passed the application for a permit will only need to download the e-Social Security Card App on their cell phones and, after passing the real-name authentication, will be able to receive the e-Social Security Card containing the information on their work permits.

Who can Work in China without a Work Visa

Foreigners temporarily performing in China

Foreigners who have been approved by the Ministry of Culture to engage in commercial cultural performances with a Temporary Commercial Performance License are not required to apply for the work permit in China.

Foreigners employed by particular organizations

Specific foreign technical professionals or senior managers employed by the Chinese government or agency. For example, foreigners working in foreign embassies and consulates do not need to apply for a Work Permit in China.

Foreigners engaged in offshore oil operations who have not landed

Foreigners who hold the "Permit for Foreigners Engaged in Offshore Oil Operations in the People's Republic of China" and do not land in offshore oil operations do not need to apply forthe work permit in China.

Foreigners holding Chinese Permanent Residence Permit for Foreigners

Foreigners who hold China's "Foreigner Permanent Residence Permit" can work in China without a work permit, because they have already obtained permanent residence in China, which is considered to be equivalent to the treatment of domestic residents in terms of employment.
