As a matter of fact, China has implemented two laws since 2011, which require that :”Foreigners who work within China have to participate in Social Insurance.”
That means, foreigners who work legally in China mainland with working visa, and have gained work certificates like《Foreigners work Permit》, 《Foreign Specialist Certificate》,《Permanent Foreign Journalist Certificate》, should take part in China`s Social Insurance。In addition, Foreigners with 《Permanent Residence Certificate》and work legally within China have to participate too.

Enterprises,institutions, social organizations, private non-enterprise units, foundations, law firms, accounting firms and other organizations, which register legally in China, should pay Social Insurance for the foreigners they hired according to laws, so do the foreigners themselves. 

Foreigners should apply for the registration of Social Insurance within 30 days, from the date of confirming employment.
An Employer who employs any foreigner should make the Social Insurance registration for the foreigner within 30 days, upon the issuance of his/her employment certificate.

● Penison Insurance
If a foreigner leaves China before he/she is qualified for enjoying the pension benefits, his/her individual social insurance account would be maintained and his/her period of contributions may be accumulated when he/she is employed in China again; upon his/her written application for termination of the social insurance relationship, the balance in his/her private social insurance account may be refunded in a lump sum.

A foreigner, who receives social insurance benefits outside China on a monthly basis, should at least once a year provide the social insurance agency responsible for paying his/her social insurance benefits with an existence certificate issued by China embassy or consulate, or an existence certificate notarized by competent authority in the country where he/she lives in and certified by China embassy or consulate.
The balance in a foreigner's private social insurance account may be inherited according to law in case of his/her death.
● Medical Insurance
A Foreigner can choose any hospital to have medical care, the treatment fee can be reimbursed at certain percentage by the the balance in his/her private Medical insurance account. If a foreigner leaves China, the balance in his/her private medical insurance account may be refunded.

● Unemployed Insurance
Unemployed foreigners can refund the Unemployment Insurance to maintain the normal life.

Condition: The employee unit and the foreigner himself/herself must have paid the unemployment for at least 1 year, and the unemployment must agaisnt the foreigner`s own willing. In addition, that unemployed foreigner need to make an unemployment registration at first, and make an application for job.
● Maternity Insurance
Female foreigners are able to have the right of : maternity leave,the medical fees asscoiated with giving birth, birth allowance.

● Work-Related Injury Insurances
Foreign workers who get work-related injury in an accident during working hours , or suffer from occupational diseases, are able to have the Work-Related Injury Insurances.
