Infringing upon Intellectual Property
In accordance with Regulation on the Customs Protection of Intellectual Property Right, Customs have right to confiscate commodities which infringe upon Intellectual Property Right or carrying articles which exceed the reasonable quantity for personal use.

According to the law, confiscated goods will be disposed in the following 4 ways:
If the goods can be used for public welfare, Customs will give them to Institution of Public Character.
Goods can be transferred to Intellectual Property rights holders with compensation.
If the goods cannot be used for welfare purpose or be acquired, Customs have right to auction the items after removing counterfeit trademarks on the packages.
Specifically, imported counterfeit products are prohibited to be sold in Chinese market even though their counterfeit trademarks have been removed.
If the products cannot be auctioned either, Customs will destroy them all.
