How to get your own trademark registered?

Once a trademark for goods or services is registered, legal protection for it is guaranteed. When someone counterfeits your trademark, you can seek legal sanctions and obtain compensation according to law. However, the registration of a trademark requires the various documents and a certain amount of fee, which is a cumbersome process.

将自己的商品、服务等注册了商标，就能受到法律的保护，一旦有人假冒商标，就可以寻求法律途径予以制裁，并依法获得赔偿。商标的注册需要准备一系列的材料并需缴纳一定的费用，过程比较繁琐。

There are two ways for registering a trademark: one is to apply for registration at the Trademark Office by yourself; the other is to entrust an agency.

注册商标有两种方式可供选择：一是自己到商标局申请注册；另一种是委托商标代理公司代理服务。

In addition, before registration, it is better to find a more authoritative inquiry company to conduct pre-registration inquiry to reduce the risk of high trademark similarity and enable the success of application.

此外，在注册前，最好先找一家比较权威的查询公司，进行注册前的查询，以减少商标注册的风险，提高商标注册的成功率。

Next, let's take a look at the normal process of registering a trademark.

接下来我们就来看看注册商标的一般流程有哪些：

确定需要注册商标的商品或类别。

The applicant should decide which category does the trademark to be registered belong to.

申请前对商标进行查询，对商标能否获得注册做出初步判断。

The applicant should examine distinctiveness of the trademarkbefore applying and make a preliminary judgment on whether the trademark can be registered successfully.

向商标局提出注册申请, 并提交商标注册的相关申请文件。

Apply to the Trademark Office and submit relevant documents.

商标局对申请进行形式审查，合格的下发《受理通知书》，不合格的下发《不予受理通知书》。

The Trademark Office will conduct a formal examination of the application, and issue a Notification of Acceptance for qualified applicants, and a Notice of Rejection for unqualified applicants.

商标局对申请进行实质审查，审查通过的编入商标初审公告，不通过的下发《商标驳回（或部分驳回）通知书》

The Trademark Office will conduct a substantive examination of the application. Those that have passed the examination will be listed in publication notification, and those that have not passed will be issued a Notification of Refusal (or Partial Refusal).

商标初审公告期为三个月，期满无人提出异议，则核准注册、颁发商标注册证。

There is a three-month period for public notice, during which if no objection is raised, the registration will be approved and a trademark certificate will be issued.

Documents required 所需材料

1. If applying for registration under the name of an enterprise, a copy of the business license, affixed with the official seal, shall be provided.

以企业名称申请注册的，需提供营业执照复印件，并需在营业执照复印件上加盖公章。

2. If applying for registration in the name of an individual, a copy of the personal ID card and a copy of the business license of the individual business, both with the applicant’s signature, should be provided.

以个人名称申请注册的，需提供个人身份证复印件1份和个体工商户营业执照复印件，并于复印件上签名。

3. Specimen or text of the trademark. A color specimen is required if the color needs to be protected.

提供商标文字或图样，需要保护颜色的，还需要提供彩色图样。

4. The applicant shall decide the goods/services to which the registered trademark belongs according to the goods or services he provides.

可根据申请人自己经营的商品或提供的服务确定拟注册的商品/服务项目。

5. A Power of Attorney for stamped with the official seal or signed. In particular, the address on the Power of Attorney should be exactly the same as the registered address on the business license.

提供加盖公章或签字的《商标代理委托书》，尤其注意，《商标代理委托书》上的地址应与营业执照上的注册地址完全一致。
