导读:外籍员工社保缴纳不可少!


随着越来越多的外籍人来中国定居工作,在办理了工作证和居留许可可以合法在华就业后,是否需要缴纳社保一直是个备受关注的问题。

As more and more foreigners come to China for employment and settlement, apart from work permit and residence permit, whether they need to pay social security has always been a matter of concern.

根据《中华人民共和国社会保险法》第十二章第九十七条规定,外籍人员从2011年7月起在中国境内就业的应当参加社会保险。

According to Article 97 of Chapter XII of the Social Insurance Law of the People's Republic of China, foreigners who have been employed in China since July 2011 shall participate in social insurance.

哪些外国人可参缴?

Who can participate in the social insurance payment?

1️⃣ 依法获得《外国人来华工作许可证》、《外国常驻记者证》等就业证件和外国人居留证件,并在我市境内合法就业的非中国国籍人员。

Non-Chinese nationals who have obtained employment certificates such as foreigner's work permit in China, Permit for Foreign Resident Reporters and foreigner's residence permit and are legally employed. 

2️⃣ 持有《外国人永久居留证》,并在我市境内合法就业的非中国国籍人员。

Non-Chinese nationals who hold the permanent residence ID card and legally employed. 

3️⃣ 与境外雇主订立雇用合同后,被派遣到在中国境内注册或者登记的分支机构、代表机构(以下称境内工作单位)工作的外国人。

Foreigners who, after concluding an employment contract with an overseas employer, are dispatched to work in a branch or representative office registered in China.

有哪些参缴项目?

What's the item of the social insurance?

应当依法参加职工基本养老保险职工基本医疗保险工伤保险失业保险生育保险,由用人单位和本人按照规定缴纳社会保险费。

The employee’s basic endowment insuranceemployee’s basic medical insurancework-related injury insuranceunemployment insurance and maternity insurance shall be covered in accordance with the law, and social insurance premiums shall be paid by the employer and himself in accordance with regulations.

已在境外参保外国人可按协定享有免缴费期

Foreigners who have been insured abroad may enjoy a fee free period in accordance with the agreement. 

目前我国已与多个国家签订了双边社会保障协定,包括德国、韩国、丹麦加拿大芬兰、瑞士、荷兰、西班牙、卢森堡、日本及塞尔维亚,即依据双方协定的规定,拥有以上国籍的员工无需在我国缴纳相应险种。

At present, China has signed bilateral social insurance agreements with some countries, including Germany, South Korea, Denmark, Canada, Finland, Switzerland, the Netherlands, Spain, Luxembourg, Japan and Serbia. That is to say, according to the provisions of the bilateral agreements, employees from above countries do not need to pay corresponding types of insurance in China.

享受什么社保待遇?

What kind of social insurance benefits?

按规定参保的外国人可依法享受同等的养老保险待遇。

Foreigners insured can enjoy the same endowment insurance benefits as Chinese citizens.

在达到法定的领取养老金条件前离境的,其养老保险个人账户予以保留,再次来中国就业的,缴费年限累计计算;经本人书面申请终止养老保险关系的,也可以将其养老保险个人账户储存额一次性支付给本人。

For those who leave China before meeting the statutory pension conditions, their pension insurance personal accounts shall be retained. When come to China for employment again, the payment years shall be calculated cumulatively; If the pension insurance relationship is terminated by written application, the amount stored in his individual account of pension insurance may also be paid to the person in a lump sum.

参保后死亡的,其养老保险个人账户余额可以依法继承。

If a person dies after participating in the insurance, the balance of his individual account of endowment insurance may be inherited according to law.

在中国境外享受按月领取养老保险待遇的外国人,应当至少每年向负责支付其待遇的社会保险经办机构提供一次由中国驻外使、领馆出具的生存证明,或者由居住国有关机构公证、认证并经中国驻外使、领馆认证的生存证明。

Foreigners who enjoy monthly endowment insurance benefits overseas shall provide the social insurance agency responsible for paying their benefits with a survival certificate issued by the Chinese embassy or consulate abroad, or a survival certificate notarized and certified by the relevant institutions of the country of residence and certified by the Chinese embassy or consulate abroad at least once a year.
