可不少外籍人对我国法律并不熟悉，新生儿出生在中国，外籍父母只为其办理了出生证明，却没有及时到出入境管理机构办理出生登记！这看似是小小的无心之过，但却会招来无尽麻烦！

根据《中华人民共和国出境入境管理法》规定，每一个出生在中国的外国宝宝除了出生证明之后，还需要进行出生登记。

第四十条 在中国境内出生的外国婴儿，其父母或者代理人应当在婴儿出生六十日内，持该婴儿的出生证明到父母停留居留地县级以上地方人民政府公安机关出入境管理机构为其办理停留或者居留登记。
Article 40 For foreign babies born in China, the parents of such a baby or their agent shall, within 60 days of the birth of the baby, conduct stay or residence registrationfor the baby with the exit-entry administration division of the public security authority of the local people's government of the place at or above the county level where the parents stay or reside on the basis of the baby's birth certificate.
Attention: The registration can be exempted for a foreign baby who can obtain a foreign passport within 60 days of birth, and the visa can be directly applied according to regulations.

出生登记之后需要办理签证吗？
Is a vias application needed after the birth registration?
其父母或代理人凭出生登记回执，可向所属国驻华使、领馆申请新护照，并在办理出生登记手续后120日内为其办理签证证件。
YES! With the receipt of birth registrationt, the parents or surrogates can apply for a new passport at the embassy or consulate of their country in China, and apply for a visa within 120 days after the birth registration.

Receipt of acceptance of the baby’s birth declaration
婴儿出生60天内没有办理出生登记的，或出生登记后120天内未持婴儿护照办理签证证件的，视为在华非法居留。
If the baby is not registered for birth within 60 days of birth, or fails to apply for a visa with the baby's passport within 120 days after the birth is registered, it will be deemed to be illegally residing in China.
婴儿出生60天内没有办理出生登记的，需要取得婴儿护照后接受处罚，处罚后才能办理签证证件，具体处罚会根据《中华人民共和国出境入境管理法》进行。
If the birth registration is not completed within 60 days of birth, punishments shall be imposed after obtaining the baby's passport, and the visa can be issued only after the punishment.

第七十六条 有未按规定办理外国人出生登记的，给予警告，可以并处二千元以下罚款。
Article 76 People concerned fail to register the birth of a foreigner in accordance with the regulations shall be given a warning and a fine of not more than 2,000 yuan may be also imposed.
第七十八条 外国人非法居留的，给予警告；情节严重的，处每非法居留一日500元、总额不超过10000元的罚款或者5日以上15日以下拘留。
因监护人或者其他负有监护责任的人未尽到监护义务，致使未满16周岁的外国人非法居留的，对监护人或者其他负有监护责任的人给予警告，可以并处1000元以下罚款。
Article 78 Foreigners who reside in China illegally shall be given a warning; where circumstances are serious, they shall be imposed with a fine of RMB 500 yuan per day, with a cap of RMB 10,000 yuan in total, or be detained for not less than five days but not more than 15 days.
Where guardians or other persons responsible for guardianship fail to perform the guardian obligation and result in foreigners below 16 years of age residing in China illegally, the said guardians or other obligated persons shall be given a warning and may also be fined not more than RMB 1,000 yuan.
