首先， 我们需要明白，什么是“三非”外国人？
First of all, we need to know, what does the “Three-Illegals” Foreigner mean?
“三非”外国人是指非法入境、非法居留、非法就业的外国人。
"Three illegals" foreigners refer to whose entering, residing, or working in China without valid paperwork (illegally).
“三非”外国人身份不清、来路不明，难以进行人员管理，既存在着极大的治安隐患，又容易将疫情从境外带进中国。
Those foreigners whose identities and origins are unknown, which make it difficult to manage them. There are not only great risks in social security but also in easily bring the epidemic into China from abroad.

为维护社会稳定，中国是严令打压“三非”外国人的。根据法律规定，非法聘用和容留藏匿“三非”外国人不仅要承担法律责任，还要负责“三非”人员遣送出境费用。
In order to maintain social stability, China strictly suppresses foreigners with the three illegal behaviors. According to the law, hiring and hiding “Three Illegal” Foreigner will not only bear legal responsibility, but also be responsible for the cost of deportation of the foreigners.

非法入境是指外国人未持有中国主管机关签发的有效入境签证或合法有效的入境证件、或未从我对外开放、指定的口岸入境、或未经边防检查站查验而进入中国国境的违法行为。
Illegal entry refers to the illegal act of a foreigner entering China without a valid visa or entry certificate issued by the Chinese competent authority, or without entering from a port open and designated by China, or entering China without inspection at a border inspection point.
如果你持有的是普通护照，除非符合中国免签政策，不然都必须先取得有效的签证才能入境中国。
Foreigners holding ordinary passport are required to obtain a valid visa to visit China, unless you meet relevant policies of Chinese Visa Exemptions.
中国签证分为外交签证(W)、礼遇签证(U)、公务签证(Y)和普通签证，大多数外国人申请的都是普通签证。普通签证一共分16种，分别用汉语拼音字母和阿拉伯数字标识以作区分。中国签证机关会根据申请人的入境目的和身份，决定发给何种签证。
Chinese visas fall into the types of diplomatic visas(W), courtesy visas(U), public service visas(Y) and ordinary visas. Most foreigners apply for ordinary visas. There are 16 types of ordinary visas, which are marked with Chinese pinyin letters and Arabic numerals to distinguish them. The Chinese authority will decide which visa to issue based on the applicant's purpose for entry and qualifications.
1、外国人非法入境的，处一千元以上五千元以下罚款；情节严重的，处五日以上
Foreigners who enter China illegally shall be fined not less than 1,000 yuan but not more than 5,000 yuan; for a severe violation, they shall be detained for not less than 5 days but not more than 10 days, and may also be fined not less than 2,000 yuan but not more than 10,000 yuan.
2、协助他人非法出境入境的，处二千元以上一万元以下罚款；情节严重的，处十日以上十五日以下拘留，并处五千元以上二万元以下罚款，有违法所得的，没收违法所得。
Those who assist others to illegally exit or enter China shall be fined not less than 2,000 yuan but not more than 10,000 yuan; for a severe violation, they shall be detained for not less than 10 days but not more than 15 days, and shall be fined not less than 5,000 yuan but not more than 20,000 yuan, and be confiscated illegal gains if any.
3、弄虚作假骗取签证、停留居留证件等出境入境证件的，处二千元以上五千元以下罚款；情节严重的，处十日以上十五日以下拘留，并处五千元以上二万元以下罚款。
Those who fraudulently obtain exit and entry documents such as visas, stay and residence permits shall be fined not less than 2,000 yuan but not more than 5,000 yuan; for a severe violation, they shall be detained for not less than 10 days but not more than 15 days, and shall be fined not less than 5,000 yuan but not more than 20,000 yuan.
非法居留是指外国人没有合法有效的身份证件、居留证件或签证在中国停留居留，外国人超出签证、停留居留的有效期限或超出限定的停留居留区域活动的违法行为。
Illegal residence refers to the acts of foreigners staying in China without valid identity documents, residence permits or visas, or exceeding the validity period of visas, or traveling beyond the restricted area of stay and residence.
在中国签证页会注明“停留期限（Duration of Each Stay）”，指游客每次入境允许在中国停留的最大天数，从入境次日00:00开始算起，到最后期限日的24:00为止。
The “Duration of Each Stay” will be marked on the Chinese visa page, which means the maximum number of days visitors are allowed to stay in China per entry. It is calculated from 00:00 on the day after entry into China, till to the 24:00 (Beijing GMT +8:00) of last permitted day.
时间因签证类型而异，从几天到30天、60天、90天、120天、180天不等。如果想在华停留超过签发的期限，要至少在到期日前一周向公安机关申请签证延期，否则视为逾期非法居留。
The duration differs by the visa types. The duration ranges from a few days, to 30 days, 60 days, 90 days, 120 days and 180 days at most. If you want to stay longer than the issued duration, you need to apply for China Visa Extension from public security authorities at least one week before the expiration date. Overstaying is against the laws of China.
若签证上“停留期限”一栏写着的是“000 days”，就说明持有人必须在入境后30天内到停留地公安机关申请居留许可，具体停留期限会体现在居留许可上。
If the "Duration of Each stay" on the visa says "000 days", it means that the holder is required to apply a residence permit in the local Public Security Bureau within 30 days upon arrival. Their accurate duration of stay will be specified on the residence permit.
外国人必须在居留许可有效期满前离开中国，或申请延期。
Foreigners must leave China before the expiry of the residence permit, or apply for an extension.
1、外国人非法居留的，给予警告；情节严重的，处每非法居留一日五百元，总额不超过一万元的罚款或者五日以上十五日以下拘留。因监护人或者其他负有监护责任的人未尽到监护义务，致使未满十六周岁的外国人非法居留的，对监护人或者其他负有监护责任的人给予警告，可以并处一千元以下罚款。
Foreigners who illegally reside shall be given a warning; for a severe violation, they shall be fined 500 yuan per day of illegal stay, with a total amount not exceeding 10,000 yuan, or detention for not less than 5 days but not more than 15 days. If a foreigner under the age of 16 illegally resides because the guardian or other person with guardianship fails to fulfill the responsibility, the guardian or other person with guardianship responsibility shall be given a warning, and a fine of not more than 1,000 yuan may be imposed concurrently.
2、容留、藏匿非法入境、非法居留的外国人，协助非法入境、非法居留的外国人逃避检查，或者为非法居留的外国人违法提供出境入境证件的，处二千元以上一万元以下罚款；情节严重的，处五日以上十五日以下拘留，并处五千元以上二万元以下罚款，有违法所得的，没收违法所得。
A fine of not less than 2,000 yuan but not more than 10,000 yuan shall be imposed on anyone who accommodates or hides foreigners who have entered or resided illegally, or assists legal foreigners in evading inspections, or provides them exit and entry documents; for a severe violation, they shall be detained for not less than 5 days but not more than 15 days, and shall be fined not less than 5,000 yuan but not more than 20,000 yuan; illegal gains should be confiscated if any.
非法就业是指外国人未按照规定取得工作许可和工作类居留证件在中国境内工作的；超出工作许可限定范围在中国境内工作的；外国留学生违反勤工助学管理规定，超出规定的岗位范围或者时限在中国境内工作的违法行为。
Working in China without obtaining a work permit and residence permit for work in accordance with regulations; working beyond the location of the work permit allowed; foreign students violating the work-study management regulations or exceeding the prescribed posts or time limit of working in China, are considered as illegal employment.
外国人在中国就业须具备特定条件，才可能申请到来华工作签证。
Only foreigners meeting certain conditions can apply for a work visa and work in China lagally.
At least 18 years old and in good health.
2️⃣ 具有从事其工作所必须的专业技能和相应的工作经历；
Possess the necessary professional skills and corresponding work experience to engage in their work.
There is a definite employing unit.
5️⃣ 持有有效护照或能代替护照的其他国际旅行证件。
Hold a valid passport or other international travel documents equivalent to the passport.
同时，外国人在中国境内工作，应当按照规定取得工作许可和工作类居留证件。
At the same time, foreigners working in China should obtain work permits and residence permits for work in accordance with regulations.
1、外国人非法就业的，处五千元以上二万元以下罚款；情节严重的，处五日以上十五日以下拘留，并处五千元以上二万元以下罚款。
Foreigners who work illegally shall be fined not less than 5,000 yuan but not more than 20,000 yuan; for a severe violation, they shall be detained for not less than 5 days but not more than 15 days, and a fine of not less than 5,000 yuan but not more than 20,000 yuan shall be imposed.
2、介绍外国人非法就业的，对个人处每非法介绍一人五千元，总额不超过五万元的罚款；对单位处每非法介绍一人五千元，总额不超过十万元的罚款；有违法所得的，没收违法所得。
Individuals who introduce foreigners for illegal employment shall be fined 5,000 yuan for each illegally introduced person, with a total amount not exceeding 50,000 yuan; A unit shall be fined 5,000 yuan for each introduced person, with a total amount not exceeding 100,000 yuan; illegal gains should be confiscated if any.
3、非法聘用外国人的，处每非法聘用一人一万元，总额不超过十万元的罚款；有违法所得的，没收违法所得。
Anyone who illegally employs foreigners shall be fined 10,000 yuan for each illegally hired person, with a total amount not exceeding 100,000 yuan; illegal gains should be confiscated if any.
各位不要心存侥幸，还是要通过合法手续来华。另外，若在中国境内签证、居留许可逾期，护照丢失未及时补办等都会构成非法居留，一旦被公安机关查处，不仅要缴纳罚款，还会被遣返出境，甚至会被拒绝再次入境中国。
Don't try to take chances! Everyone must come to China through legal procedures. Moreover, if your visa or residence permit is overdue in China, or if your passport is lost and not reissued in time, you will be considered as illegal residence. Once found by the public security authority, not only will you be fined, but also be deported, or even refused to re-enter China.
