近日,内蒙古伊金霍洛旗公安局治安管理大队民警在例行检查时发现,辖区某教育咨询公司有一名外籍男子涉嫌非法就业。Recently, the police of the Public Security Management Brigade of the Public Security Bureau of Ejin Horo Banner, Inner Mongolia found during a routine inspection that a foreign man was suspected of illegal employment in an education consulting company.(source: National Immigration Administration)经查,该公司聘用一外籍男子担任外教,但该外籍男子未取得在我国就业的就业许可及就业类居留许可,属于非法就业。该教育咨询公司主要负责人在未核查相关证件的情况下便聘用该外籍男子从事教学活动,已构成非法聘用外国人行为。After investigation, it turned out that the foreign man had no work permit and residence permit for work in China but was hired as a foreign teacher, which should be regared as illegal employment. The main person in charge of the education consulting company hired the foreign man to engage in teaching activities without checking the relevant documents, which constituted illegal employment of foreigners.根据《中华人民共和国出境入境管理法》相关规定,涉案外籍男子依法被罚款5000元,涉案教育咨询公司负责人王某依法被罚款10000元。According to the relevant provisions of the Exit and Entry Administration Law of the People's Republic of China, the foreigner involved in this case shall be fined 5,000 yuan, and the person in charge of the education consulting company shall be fined 10,000 yuan. 《中华人民共和国出境入境管理法》Exit and Entry Administration Law of the People's Republic of China第四十一条 外国人在中国境内工作,应当按照规定取得工作许可和工作类居留证件。任何单位和个人不得聘用未取得工作许可和工作类居留证件的外国人。Article 41 To work within China, foreign nationals shall obtain a work permit and a residence permit of the work type according to legal provisions. No entity or individual shall employ foreign nationals who have not obtained a work permit and a residence permit of the work type. 外国人在中国境内工作管理办法由国务院规定。The administrative measures for foreign nationals working within China shall be formulated by the State Council. 第四十三条 外国人有下列行为之一的,属于非法就业:Article 43 Under any of the following circumstances, a foreign national is working illegally:(一)未按照规定取得工作许可和工作类居留证件在中国境内工作的;Working within China without obtaining a work permit and a residence permit of the work type as required;(二)超出工作许可限定范围在中国境内工作的;Working within China beyond the scope specified in a work permit; or(三)外国留学生违反勤工助学管理规定,超出规定的岗位范围或者时限在中国境内工作的。Working within China beyond the prescribed scope of jobs or period in violation of rules for the administration of work-study foreign students, if the foreign national is a foreign student. 第八十条外国人非法就业的,处五千元以上二万元以下罚款;情节严重的,处五日以上十五日以下拘留,并处五千元以上二万元以下罚款。Article 80 A foreign national who is illegally employed shall be fined not less than 5,000 yuan but not more than 20,000 yuan; or if the circumstances are serious, shall be detained for not less than five days but not more than 15 days and be fined not less than 5,000 yuan but not more than 20,000 yuan concurrently.介绍外国人非法就业的,对个人处每非法介绍一人五千元,总额不超过五万元的罚款;对单位处每非法介绍一人五千元,总额不超过十万元的罚款;有违法所得的,没收违法所得。An individual who provides reference for illegal employment of foreign nationals shall be fined 5,000 yuan for each illegal reference but not more than 50,000 yuan in total; an entity which provides reference for illegal employment of foreign nationals shall be fined 5,000 yuan for each illegal reference but not more than 100,000 yuan in total; and any illegal income shall be confiscated.非法聘用外国人的,处每非法聘用一人一万元,总额不超过十万元的罚款;有违法所得的,没收违法所得。Whoever illegally employs foreign nationals shall be fined 10,000 yuan for each illegal employment but not more than 100,000 yuan in total; and any illegal income shall be confiscated.我国严厉打击非法就业行为,切勿持侥幸心理。若外国人被发现非法就业,很有可能会影响到签证以及工作许可的后续申请、更换以及延期。China is cracking down on illegal employment, and no one will be able to take chances.
