前段时间，接到一个外国朋友的电话，对方语气些许慌张，说自己在公司被警察抓了。
Some time ago, I got a call from a foreign friend. Sounded a little flustered, he told me that he had been arrested by police at the company.

原来，新换了职场之后，他没有注销前公司的工作许可，也没有去申请新的许可，构成了非法就业。
It turned out that after moving to a new job, he did not cancel the work permit of the former company, nor did he apply for a new permit. He was arrested for illegal employment.
朋友疑惑了，怎么换份工作还要重新办理工作许可呢？工作许可不是没过期就可以了吗？
My friend was confused. "My permit is still in validity, why do I need a new work permit?"
当然不是！工作许可是由工作单位申请的，工作单位变了，原来的工作许可需要进行注销。找到了新工作之后，还要由新工作单位申请新的工作许可。
Of course a new one is needed! A work permit is applied by the employer. If the employer is changed, the original work permit should be cancelled and invalided. What’s more, a new permit should be applied when moving to a new job.
最后，那位朋友不仅被罚了20000块，还留下了非法就业记录，后续申请新的来华签证可能就没那么容易了。
At last, my friend was fined 20,000 CNY. And the record of illegal employment will have a negative impact on his subsequent application for a new visa to China.
如果你最近也想换份工作，或者现在已经是离职状态了，那么你一定要处理好工作许可的变更或注销，不然轻则罚款拘留，重则驱逐出境。
If you are planning to change job, or already have quit, make sure to handle well the change or cancellation of your work permit, otherwise you may be fined and detained, or even deported.
同样，对于企业来说，只有给外籍人士同时办理工作许可和居留许可注销后，才被视为劳动关系解除。如工作签证关系仍在原公司，此期间如果外籍人士出现违法，或者人身意外，公司可能负连带责任。
Similarly, for employers, only after canceling the work permit and residence permit for foreigners, can it be regarded as the termination of the labor relationship. Before the cancellation, if the foreigner violates the law or has a personal accident, the employer may be jointly and severally liable.
Generally speaking, there are four types of cancellation.
由用人单位申请注销
Cancellation applied by the employer
外籍员工死亡或者丧失行为能力或者雇佣双方决定提前终止合同并解除聘用关系，用人单位要在事由发生后10个工作日内向决定机构申请注销工作许可。
If a foreign employee dies or becomes incapacitated, or both parties decide to terminate the contract early and terminate the employment relationship, the employer shall apply to the decision-making body for cancellation of work permit within 10 working days after the occurrence of the cause.

用人单位被终止的，申请人可以向决定机构申请注销工作许可。
Second, the cancellation applied by the foreign employee. If the employer is terminated, the applicant may apply to the decision-making body for cancellation of the work permit.
比如说，你的公司被注销或吊销营业执照或被查封了，你可以自行向有关部门提交注销工作许可的申请。如果不注销，可能无法与新的用人单位签订劳动合同或申办新的工作许可证。
For example, if the company that you work for has been cancelled or revoked its business license or has been seized, you can apply for cancellation of the work permit to the relevant authorities. If not, you may not be able to sign a labor contract with a new employer or apply for a new work permit.

Automatic cancellation
工作许可证有效期届满未延期，就会被自动注销，不打算继续在华工作，可以不理会。但如要继续在华工作，就必须在工作许可证到期前至少30天提交网申，否则外专局不再受理延期申请，最早可以提前90天申请。
Third, automatic cancellation. If the work permit expires but is not extended, it will be automatically cancelled. If you do not intend to continue working in China, you can just ignore it. However, if you do continue working in China, you must submit the online application at least 30 days before the expiration of the work permit, otherwise the application will no longer be accepted. You can apply as early as 90 days in advance.

这是由于政府认定该外国人不再符合在华工作的条件，比如产生犯罪行为，就会将工作许可证撤销、撤回，以及吊销的，不再允许其在华工作。
Fourth, statutory cancellation. This is because the authority determines that the foreigner no longer meets the requirements for working in China. For example, if the foreigner commits a crime, the authority will revoke, withdraw, or cancel the work permit.
在华工作的外国人，除了努力搞钱之外，也要多注意自己的证件，如工作许可、居留许可、签证等。
Therefore, working in China, beside making a fortune, you may also take care of your legal documents, such as work permit, residence permit and visas.
不过这些证件的延期、变更流程都较为繁琐，要准备的申请材料繁多，对于外国人来说，还是有一定操作难度的。那么可以考虑找一个信得过的代理机构，他们专业也有经验，省时省力。
But, the procedure for extending and changing these documents are cumbersome, it seems difficult for foreigners to handle. Or you can consider finding a trusted agency, professional and experienced, they can greatly save your time and effort.

Exit and Entry Administration Law of the People's Republic of China
第四十一条 外国人在中国境内工作，应当按照规定取得工作许可和工作类居留证件。任何单位和个人不得聘用未取得工作许可和工作类居留证件的外国人。
Article 41 To work within China, foreign nationals shall obtain a work permit and a residence permit of the work type according to legal provisions. No entity or individual shall employ foreign nationals who have not obtained a work permit and a residence permit of the work type.
The administrative measures for foreign nationals working within China shall be formulated by the State Council.
第四十三条 外国人有下列行为之一的，属于非法就业：
Article 43 Under any of the following circumstances, a foreign national is working illegally:
（一）未按照规定取得工作许可和工作类居留证件在中国境内工作的；
Working within China without obtaining a work permit and a residence permit of the work type as required;
Working within China beyond the scope specified in a work permit; or
（三）外国留学生违反勤工助学管理规定，超出规定的岗位范围或者时限在中国境内工作的。
Working within China beyond the prescribed scope of jobs or period in violation of rules for the administration of work-study foreign students, if the foreign national is a foreign student.
第八十条 外国人非法就业的，处五千元以上二万元以下罚款；情节严重的，处五日以上十五日以下拘留，并处五千元以上二万元以下罚款。
Article 80 A foreign national who is illegally employed shall be fined not less than 5,000 yuan but not more than 20,000 yuan; or if the circumstances are serious, shall be detained for not less than five days but not more than 15 days and be fined not less than 5,000 yuan but not more than 20,000 yuan concurrently.
介绍外国人非法就业的，对个人处每非法介绍一人五千元，总额不超过五万元的罚款；对单位处每非法介绍一人五千元，总额不超过十万元的罚款；有违法所得的，没收违法所得。
An individual who provides reference for illegal employment of foreign nationals shall be fined 5,000 yuan for each illegal reference but not more than 50,000 yuan in total; an entity which provides reference for illegal employment of foreign nationals shall be fined 5,000 yuan for each illegal reference but not more than 100,000 yuan in total; and any illegal income shall be confiscated.
非法聘用外国人的，处每非法聘用一人一万元，总额不超过十万元的罚款；有违法所得的，没收违法所得。
Whoever illegally employs foreign nationals shall be fined 10,000 yuan for each illegal employment but not more than 100,000 yuan in total; and any illegal income shall be confiscated.
