导读：Foreign graduates without 2 years of relevant work experience can also apply for work visas in China
China's economy is steadily improving as the pandemic control is removed. It has also attracted many foreigners to come here for employment, and many foreign students are planning to work in China right after their graduation.
But, to work in China, one must have a work visa and a work permit. Otherwise, he will be fined or even detained for illegal employment. Moreover, he even cannot get protection from laws.
Exit and Entry Administration Law of the People's Republic of China
Article 41 To work within China, foreign nationals shall obtain a work permit and a residence permit of the work type according to legal provisions. No entity or individual shall employ foreign nationals who have not obtained a work permit and a residence permit of the work type. 　 
Article 43  Under any of the following circumstances, a foreign national is working illegally: 
1. Working within China without obtaining a work permit and a residence permit of the work type as required;
2. Working within China beyond the scope specified in a work permit; or
3. Working within China beyond the prescribed scope of jobs or period in violation of rules for the administration of work-study foreign students, if the foreign national is a foreign student.
Article 80 A foreign national who is illegally employed shall be fined not less than 5,000 yuan but not more than 20,000 yuan; or if the circumstances are serious, shall be detained for not less than five days but not more than 15 days and be fined not less than 5,000 yuan but not more than 20,000 yuan concurrently.
An individual who provides reference for illegal employment of foreign nationals shall be fined 5,000 yuan for each illegal reference but not more than 50,000 yuan in total; an entity which provides reference for illegal employment of foreign nationals shall be fined 5,000 yuan for each illegal reference but not more than 100,000 yuan in total; and any illegal income shall be confiscated.
Whoever illegally employs foreign nationals shall be fined 10,000 yuan for each illegal employment but not more than 100,000 yuan in total; and any illegal income shall be confiscated.
However, the basic requirement for applying for a work visa in China is a bachelor's degree or above+2 years or more of relevant work experience.
“But I just graduated, how supposed I have 2 years of work experience?”
So, the newly graduated have nothing to do but pack up and leave China? Of course NO!
Let’s have a check on the polices first.
According to the classification standard of foreigners' work in China, Foreign professional talents who meet the requirements of the work guidance catalogue and posts for foreigners to come to China and are in urgent need of China's economic and social development are recognized as category B.
Category B Judgment Criteria 1: Foreign professional talents with a bachelor's degree or above and 2 years or more related work experience.
Category B Judgment Criteria 3: Foreign language teaching staff. Foreign language teaching staff should, in principle, engage in the teaching of their mother tongue in their native language, have a bachelor's degree or higher, and have more than 2 years of language education work experience. 
Among them, those who have obtained a bachelor's degree or above in education, language or teaching, or obtained the teacher qualification certificate of the country, or obtained the international language teaching certificate that meets the requirements (TEFL in China 120 hours), may be exempt from the work experience requirements.
According to the classification criteria for foreigners' work in China, other foreign personnel meeting the needs of the domestic labor market and in line with the provisions of state policies are classified as category C.
Category C Judgment Criteria 3: foreign students and foreign graduates of overseas universities who meet the specified conditions, etc.（take Guangzhou as an example, foreign student who has obtained a master's degree or above in Chinese universities or overseas universities within one year）
From the above policies, we can see that foreign graduates without 2 years of relevant work experience can also apply for work visas in China.
The work permit that is successfully applied for the first time is valid for 1 year. If expires, you can submit application again, and the validity period can be up to 2 years!
As for the application materials, foreign graduates will be needed to provide a little different, but in general, degree embassy certification, non-criminal embassy certification, physical examination and so on are the same.
