Open a China Company, But Listed as Abnormal Operations 4 Times!

COVID-19, which lasted more than three years, finally came to an end this year! After the pandemic, the Canton Fair was really vibrant. It welcomed foreigners from over 200 countries, including our friend Mak. Mak, an Indian, opened a trading company in Guangzhou in 2015.

When the pandemic broke out, Mak's business took a big hit. So he went back to India and waited until the pandemic was over before returning to continue his business. He thought the pandemic would end soon, but he waited four years.

He didn't run a company for these years, so he stopped making accounts. During the period from 2020 to 2023, the Industrial and Commercial Bureau came for a routine inspection and they found that Mak's company was neither operating nor deregistered. So they listed his company as abnormally operating.

When the pandemic ended this year, Mak wanted to continue running the company but found that his company was included in the List of Abnormal Operations. What should he do?

1. If he wants to remove the abnormal operation, firstly, he needs to submit the Declaration Form to the tax bureau. He has to submit it as many years as he missed. Mak hasn’t submitted it for five years, so he needs to submit the Declaration Form for the past five years. Moreover, he must pay a fine, which is up to 2,000 yuan.

2. After that, he has to go to the Industry and Commerce Bureau to submit the annual report. Likewise, he needs to submit report of the missing years. Later, he can apply for removal of the anomaly, which can be removed in about 1 to 2 months.

Once an enterprise has been included in the List of Abnormal Operations for more than three years, it will be considered a seriously illegal enterprise!
