The birth of a baby is a happy thing, but some parents have been fined thousands of yuan due to a single oversight. What happened here?



Recently, one of our foreign clients failed to register the birth of their daughter within 60 days after her birth. When the client discovered this, it was already 129 days past the registration deadline. As a result, he was fined 1,800 yuan!

If both parents are foreigners, then after the baby is born in China, make sure to do these three things!


01

Birth certificate

Within 3-5 days after the baby's birth, obtain the birth certificate issued by the hospital;

Residence permit

Within 60 days after the baby's birth, report to the public security bureau's exit-entry administration and complete the birth registration procedures, and obtain a residence permit;


03

China visa

Within 120 days after completing the birth registration procedures, apply for a visa for your baby.


(PS:If the baby can obtain a foreign passport within 60 days after birth, it can avoid this registration and directly apply for a visa in accordance with the regulations and legally reside in China.)



What penalties will be imposed for exceeding the reporting time for newborns?

Administrative Penalty

According to the "Exit and Entry Administration Law of the People's Republic of China", if parents or agents fail to register the birth of a child within 60 days after the child's birth, they may be given a warning and fined up to 2,000 yuan.

Risk of Illegal Residency

If the birth registration is not completed within 60 days and the visa or residence permit is not obtained within the prescribed time frame (usually within 120 days after obtaining the passport), the infant may be regarded as "illegally residing". In severe cases, a fine of 500 yuan per day (up to a total of 10,000 yuan) or short-term detention may be imposed.

Subsequent procedures 

are restricted

Failure to report on time may affect the processing of subsequent visas and residence permits. You must first accept the penalty before you can continue with the relevant procedures.
