乘坐高铁时,最怕遇到“霸座”。若与之协商不成,请不要慌张和担忧,直接去找列车员或乘警,他们会帮助你解决。2018年年初,铁路12306推出了铁路旅客信用记录管理办法。若被定性为严重失信行为,将影响旅客的铁路出行。

 

那什么是严重失信行为?有哪些相应的惩戒措施?严重失信人员名单在哪里公示?今天让我们一起来了解一下。

 

什么是严重失信行为?

1.  扰乱铁路站车运输秩序且危及铁路安全、造成严重社会不良影响

2.  在动车组列车上吸烟或者在其他列车的禁烟区域吸烟

3.  倒卖车票、制贩假票

4.  冒用优惠(待)身份证件、使用伪造或无效优惠(待)身份证件购票乘车

5.  持伪造、过期等无效车票或冒用挂失补车票乘车

6.  无票乘车、越站(席)乘车且拒不补票

7.  依据相关法律法规予以行政处罚


有哪些相应的惩戒措施?

▪  发生上述第1、2、3、7种情形即认定为失信行为。自公示期满无有效异议之日起180 天内限制其购买车票

▪  发生上述第4、5、6 种情形即认定为失信行为。其中,发生第4、5种情形即使旅客按规定补票也认定为失信行为,发生第6种情形旅客在结束本次旅行前最终按规定补票则不认定为失信行为。旅客未补票的,自公示期满无有效异议之日起至失信人补齐所欠票款前限制其购买车票;失信人补齐第一次所欠票款后(自补票次日算起)一年内,三次发生上述第4、5、6 种情形的,失信人补齐所欠票款后90天(含90天)内限制其购买车票

▪  失信人的限制购票期限期满次日起自动解除对其的购票限制


严重失信人员名单在哪里公示?

▪  对于失信人的相关信息,铁路总公司将在每月的第一个工作日,在中国铁路客户服务中心(12306 )网站、“信用中国”网站进行发布,信息自发布之日起7个工作日为公示期

▪  公示期内,被公示人可通过铁路“12306”客服电话提出异议。被公示人未提出异议或者提出异议经审查未予支持的,公示期满后,开始按照公示名单执行惩戒措施

It is most afraid of meeting an unreasonable traveller on the high-speed rail. If you cannot negotiate with him/her, please do not be panic. You can ask the conductor or railway policeman for help. Railway 12306 issued measures for the management of railway passenger credit records.


What is dishonesty behavior? What are the corresponding disciplinary measures? Where is the list of dishonesty person published? Following will help you to know more about this.


What is dishonesty behavior?

1.  Those who disturb railway station and train operation orders, affect railway safety and cause severely adverse effects on the society.

2.  Those who smoke on EMU trains or in the no-smoking area on other types of trains.

3.  Those who are found scalping train tickets and making fake tickets.

4.  Those who buy the train ticket by using others' preferential (privilege) ID cards or by using forged or invalid preferential (privilege) ID cards.

5.  Those who take the train with a fake, expired or otherwise invalid ticket, or on another person's replacement ticket.

6.  Those who take the train without any ticket and those who travel beyond destination station (seat) and refuse to pay the excess fare.

7.  Those who shall get administrative punishments according to relevant laws and regulations.


What are the corresponding disciplinary measures?

▪  The occurrence of the above-mentioned 1, 2, 3, and 7 circumstances is considered as dishonesty behavior. The purchase of tickets shall be restricted within 180 days from the date when the public notice period expires without a valid objection.

▪  The occurrence of the above-mentioned 4, 5 and 6 circumstances is considered as dishonesty behavior. Among them, it is still regarded as a dishonesty behavior that the passenger pays the excess fare of the ticket in accordance with the regulations in 4 and 5 circumstances. However, it’s fine for the passenger to pay the ticket in accordance with the regulations in the 6 circumstances. If the passenger fails to pay the excess fare, the purchase of tickets shall be restricted from the date when the public notice expires without a valid objection until the dishonest person pays off the owed ticket. During the year after the dishonest person pays off the first owed ticket (from the second day of the payment), his purchase of tickets shall be restricted within 90 days after he pays off the exceed fare in the 4,5 and 6 circumstances mentioned above.

▪  The restriction of ticket purchase will be automatically released the day after the expiration of the period of purchase.


Where is the list of the dishonesty person published?

▪  The related information about dishonesty passengers will be published on the China Railway Customer Service Center (12306) website and the "Credit China" website for 7 working days from the date of publication.

▪  During the publicity period, the published person can raise an objection through the railway service hotline "12306". If the published person has not raise an objection or the objection has not been supported by the examination, disciplinary measures shall be implemented in accordance with the public list after the expiration of the publicity period.


CWT China recommends that passengers consciously abide by the relevant regulations on safe transportation of railways and take transportation civilly to avoid affecting personal credit.
