ECHAupdate to its Guidance on requirements for substances in articles
2015年12月17日，紧随欧盟法院2015年9月15案号case C-106/14关于物品定义的裁决，ECHA迅速发布关于物品中物质的更新引导性文件。ECHA在2016年会有更详细的更新文件发布。这份最新的指导性文件纠正了关于SVHC0.1%限值与欧盟法院判决不一致的内容。
法院的裁决阐明了制造商关于超过0.1%的SVHC信息通告的责任。根据这条法规，法律义务同样适用于复杂产品中的物品（例如构成复杂产品的物品），只要物品有特殊的外形设计，除非物品被丢弃。
更加详细的更新会在2016年发布。可以预见，一份更加综合和结构化的文件将会发布出来，也会有一些新的例子会与欧盟法院裁决相对应，目前欧盟法院的裁决提供一些例子和经验反对ECHA第一份引导性文件。这次更新将会依据传统的三步式咨询过程，包含与利益攸关者进行听证。
Following the judgement of the Court of Justice, ECHA has publisheda quick update to its Guidance on requirements for substances in articles.A more comprehensive update will follow in 2016.
Helsinki, 17 December 2015 - Following the judgement of theCourt of Justice of 10 September 2015 in case C-106/14,ECHA has now updated its guidance on requirements for substances in articles.This quick update corrects the parts of the guidance with references to the0.1% limit that are no longer consistent with the conclusions of the court'sjudgement.
The court's judgement clarified the scope of the notification andcommunication obligations of companies in relation to articles containingsubstances included in the Candidate List of substances of very high concern ina concentration above 0.1% weight by weight. According to the ruling, the legalobligations also apply to articles that are present in complex products (i.e.products composed of several articles) as long as these articles keep a specialshape, surface or design or as long as they do not become waste.
A more comprehensive update of the guidance will follow in 2016. Itis foreseen to include a general update and re-structuring of the document, newexamples that are aligned with the court's judgement and a review of thecurrent examples against the experience gained and questions received by ECHAsince the guidance was first published. This update will be subject to thenormal three-step guidance consultation process, which will include aconsultation with ECHA's accredited stakeholders.
